The regular meeting was called to order by Chairman Peltier at 7:01PM.
PRESENT: WALLER, SCHUMANN, KELLISON, PELTIER
ABSENT: RUBENZER, MALASKI
Motion made by Schumann, seconded by Waller to approve the Minutes of July
24, 1996, as amended.
AYE: Waller, Schumann, Peltier
ABSTAIN: Kellison
Motion passed.
Motion made by Kellison, seconded by Peltier to approve the Minutes of
July 30, 1996, as amended.
AYE: Kellison, Schumann, Peltier

SPECIAL USE PERMIT - ONEKA CHILD CARE CENTER
Tom Houck and Linda Mezzenga presented a revised site plan for the
proposed Oneka Child Care Center at the southeast corner of TH61 and 141st
ct. North. Hours of operation would be from 6:30AM to 6:OOPM, Monday
trough Friday. The proposed plan includes 19 parking spaces on site.
__ie applicants are proposing 10 personnel, and up to 54 children.
Surrounding residents were concerned with additional traffic on 141st,
turn lanes on Highway 61, dumpster odor, disturbing existing tree roots,
and proposed fencing.
Mr. Mezzenga stated he would be willing to install a solid wood fence
around the children's play area rather than chain link. He also stated he
would plan evergreens along the east property line parking area.
Commissioners discussed angular parking on the west property line and
granting a variance of 5' for the northern parking area to allow for
easier backing out.
Motion made by Kellison, seconded by Schumann to recommend approval of the
Special Use Permit, Site Plan and Variance request of Tom and Terri Houck
and M. and Linda Mezzenga to operate a child care center subject to the
following conditions:
1. An approved Landscape and screening plan.
2. Directional traffic signs indicating entrance and exit.
3. Fencing of play area.
4. Compliance with RCWD Permit *87-110 grading and erosion central plan.
5. Evergreen trees be planted along the east property line parking area.
6. City engineer review recommendation for the 5' variance for the
northern parking area.

7. West parking area be redesigned as angular spaces.
8. A solid wood fence be installed around the play area.
All aye, motion passed.
Motion made by Kellison, seconded by Peltier to recommend the City Council
amend the Zoning Ordinance to include day care facilities as a special
use.
All aye, motion passed.
SPECIAL USE PERMIT - BEVER
Bever's would like to establish a wholesale landscape business at 7131
132nd St. Applicant's are proposing a ten acre business site, as well as
their residence. Included are 3 driveway access point, a 40' X 80' pole
barn, septic and well locations, and parking for approximately 29 cars.
The operations area includes a 250 foot gravel access area, a 104' X 86'
hard goods area for rock, chips, brick, modular block, boulders, edging,
edging, and fountains. Jim Bever, III, stated he had received verbal
approval from Rice Creek Watershed District for the proposed use.
Commissioner Kellison did not feel that this was an agricultural use, but
rather a commercial use.

_?ecial Use Permit request of Jim Bever, 7131 132nd St. subject to the
following conditions:
1. Exterior storage to be kept in bins and/or well maintained areas as
specified on site plan.
2. Approval by Rice Creek Watershed District.
3. Allow up to five employees.
4. Hours of operation from 8AM to 7PM Monday through Friday and 8AM to
Noon on Saturday.
5. Security lighting be installed.
6. One 4' X 8' business identification sign.

CONCEPT PLAN REVIEW - RICHARD SCHREIER
Richard Schreier presented a revised plan for the proposed Oaks of Lake
Plaisted including a five acre park and lake access, 43 acres of open
space on the north side of 140th St. and an improved cluster housing plan.
Commissioners questioned the integrity of recommending approval of a plan

which includes a large portion of flooded property proposed for
residential lots. Commissioner Kellison suggested a community septic
system for the development. A three phase development was also suggested,
with development based on the flooding and improvements south of 140th St.
Mr. Schreier stated he would consider the suggestions from the Commission.
After some discussion, Kellison made motion, seconded by Schumann, to
recommend the City contract the firm of Sanders, Wacker, Wehrman, Bergly,
Inc. for park planning services.
All aye, motion passed.
Motion made by Peltier, seconded by Kellison to appoint David Schumann as
Vice Chair of the Planning Commission.
All aye, motion passed.
The Commission continued discussion on revisions of the zoning ordinance.
Motion made by Schumann, seconded by Peltier to adjourn at 10:50PM.
