The regular meeting was called to order by Chairman Peltier at 7:05PM.
PRESENT: Waller, Schumann, Rubenzer, Malaski, Kellison, Peltier,
Ed Elliott, Carole LaBelle
Motion made by Kellison, seconded by Schumann, to approve the minutes of
August 28, 1996, as amended.
AYE: Schumann, Malaski, Kellison, Peltier

SPECIAL USE PERMIT - PELTIER/COMMUNICATIONS TOWER
Kevin Peltier and SBA, Inc. are requesting to construct a 150 foot
wireless communications tower on his property 5787 130th St. The 104 acre
property is zoned Agricultural and guided residential. The property is
currently used for agricultural and generally located south of 103th ST.
and west of Goodview Ave.
The tower is erected from a 15' X 20' platform, 50 feet from adjacent
properties, 65 feet from Minnesota Pipeline easement, 80 feet from the
nearest building. Access to the 2500 sq. ft. tower site is via the
existing driveway connecting to Goodview Avenue.
Several residents were unsure of the exact location of the proposed
ower. After clarification and a lengthy discussion, it was determined
iat notices will be sent to property owners to identify the location of
zhe tower.
Motion made by Kellison, seconded by Schumann to recess the public hearing
and table the application of Kevin Peltier/SBA, Inc. until October 23,
1996.
All aye, motion passed.
SUBDIVISION - RICHARD SCHREIER
Richard Schreier is proposing to subdivide 191.7 acres into 25 residential
lots using a cluster development PUD. Mr. Schreier previously had the 97
acres north of 140th St. approved as an eight lot subdivision. The
approved plat was based on the property's zoning, wetland constraints and
a ten acre density.
In response to Planning Commission recommendations during concept review,
the proposed subdivision now includes a roadway between lots 13 and 14 in
Phase 2, providing access to the east in the future. The developer is
aware that no development would take place in Phases 2 and 3 until the
water problem in that area has been resolved.
Area residents were concerned with the intensifying the existing water
problem, road surfaces, on site septic systems, intense development in
Phases 2 and 3. Larry Ehret was concerned with flooding which may occur
on his property to the north. Don Rice did not oppose the subdivision
ily development on the lake prior to a solution to the water problem.

A septic collection system rather than individual septic treatment of the
Phase II-III lots was recommended. The 43 acre open space north of 140th
St. is available for the homeowners association drainfield.
Excluding public water, the PUD has approximately 158 acres. This
translates to 11 acres of park dedication. The proposed park is 5.17
acres. Outlot A is 2.17 acres. The acreage of outlot B, a potential
resolution to condemnation for 140th St., is another 1.44 acres. The
combination of these properties is 8.78 acres or 5.5% of the land area.
Ed Elliott advised the applicant that the application was considered
incomplete until engineering work had been submitted.
The Commission had reservations recommending approval of the subdivision
with the existing problems, such as lake and road flooding, Keystone Ave.
drainage, and alignment of the south cul-de-sac.
Motion made by Kellison, seconded by Peltier to recess the public hearing
until such time that the application is completed.

UBDIVISION - LARRY GERTEN
Larry Gerten is requesting to subdivide approximately 22.2 acres into 2
lots. The property is located southwest of Horseshoe Lake with access
from Henna Avenue North. The land is zoned agricultural and guided rural
residential. The proposed lot sizes are 9.6 and 12.6 acres. The 12.6
acre lot requires an 881variance to road frontage. These proposed lot
sizes are being requested due to the location of a drainage ditch running
north -south through the property, providing a natural separation of the
properties.
The existing driveway serves the Gerten residence, approximately 700 ft.
west of Henna Ave. The new lot will provide a house pad more oriented
toward the street. Strict enforcement of the ordinance would move the
12.4 acre parcel lot line north 88 feet, reducing the 9.6 acre parcel by
.6 acres. Little practical value would be gained by the change.
Mr. Gerten provided a letter from NSP stating that they would not object
to deeding the property back to the Gerten's and NSP would obtain an
easement over the property to maintain their equipment.
Motion made by Kellison, seconded by Peltier to recommend approval of the
request of Larry Gerten to subdivide 22.2 acres (Parcel 93004-0016) into
two lots subject to the following special conditions:

1. An 88 foot variance for frontage on a public road be granted to
Parcel A.
2. Collection of parkland dedication fee of $500.00.
3. Approval of Parcel B as a buildable lot by Washington County per their
review of soil conditions for an on-site septic system.
4. Mr. Gerten obtain an easement in perpetuity to cross NSP property.

SITE PLAN APPROVAL - LOKEN/WOOD
Gary Wood is proposing to construct a 32' X 42' (1344 sq. ft.) addition to
the existing 1792 sq. ft. structure at 5819 165th Street north. The
existing pole structure is being used as a hobby shop for reupholstering
of classic cars. Typical hours of operation are after 6:OOPM. The
proposed addition is a similar pole building linked to the primary
building by an entrance door. The addition will also have an overhead
door. The addition is proposed to be used for storage of classic cars,
parts, machinery, a snowblower, engine stands, and materials. The 0.37
acre property is zoned and guided for industry.
There are no employees and usually only one person on site. Rice Creek
Watershed District has no requirements of the applicant.
Dtion made by Rubenzer, seconded by Schumann, to recommend approval of

32' X 42' addition to the industrial building at 5819 165th St.
All aye, motion passed.
TRACHTE STORAGE BUILDING
Trachte Buildings is proposing to construct a total of 50,400 sq. ft. of
storage buildings south of 140th St. and west of Highway 61. Landscaping,
fencing, keyless entry, asphalt parking and driveway, sprinkler system and
decorative block building ends are proposed for the site. Mr. Kellison
suggested the applicant provide all of the above details with his
application. The general consensus of the Planning Commission was
affirmative.
PLANNED UNIT DEVELOPMENT - WENZEL PROPERTY CONCEPT REVIEW
This 136 acre property is proposed as a combined single family residential
and single family townhouse development. The plan is developed around the
proposed Clearwater Creek recreational corridor and integrates the
parkland into the residential layout. The townhouses are proposed as a
transitional component to the commercial/industrial area along CSAH 8.
Access is proposed from Elmcrest Avenue. The development is contingent
upon extension of utilities (public sewer and water to the property).
The Planning Commission generally supported the development concept with
the improvement of Elmcrest Avenue, paved roads, utilities, and runoff to
the creek being addressed.

SUBDIVISION - DEAN JOHNSON
Dean Johnson is proposing to subdivide approximately 29 acres lying north
of 152nd St. and east of Irish Avenue into three lots with a variance to
lot size on two lots. This property is part of a larger property owned by
Lloyd Duraine. Mr. Johnson was advised that they would have to identify
the entire property to be subdivided, not create simply a residual parcel.
Motion made by Kellison, seconded by Malaski to adjourn at 11:15PM.
