The regular meeting was called to order by Chairman Peltier at 7:08PM.
PRESENT: Waller, Schumann, Rubenzer, Kellison, Peltier, Ed Elliott, Carole LaBelle
Motion made by Kellison, seconded by Schumann to approve the Minutes of October 23, 1996, as
amended.
AYE: Schumann, Kellison, Peltier
ABSTAIN: Waller, Rubenzer

SUBDIVISION REOUEST - SCHREIER
Ed Elliott stated that the September Public Hearing was continued until a complete application was
received . The discussion revolved around the high water table, emergency vehicle access, density,
drainage and phasing of development.
The applicant has submitted street engineering plans, drainage plans and additional detail for
plat review.
Property owners from the area expressed their opposition to the proposed development and suggested Mr.
Schreier development the property in ten acre lots. Residents do not support the realignment of 140th St.
Jyneen Thatcher, from the Washington County Soil and Water Conservation District requested that the
plans for development be sent them for review.
Commissioners concurred that development of the property south of 140th St., at this time, would be
premature in light of the flooding problem. Commissioner Kellison recommended approving Phase 1,
giving credit for open space in Phases 2 and 3 at the time there were developed in a cluster development.
Motion made by Kellison, seconded by Peltier to recommend denial of the request of Richard Schreier to
subdivide 192 acres, west of Keystone Avenue and north and south of 140th St., in view of the fact that a
substantial portion of Phases 2 and 3 are currently unbuildable and the proposed cul-de-sac exceeds city
standards by over 1,800 feet.

SUBDIVISION REOUEST - DEAN AND DAWN JOHNSON
Dean and Dawn Johnson, are requesting to subdivide 30.13 acres into 3 lots of 10.0, 9.9, and 10.2
acres. The property is located north and west of Irish Avenue and 152nd Street. The subject
property is zoned and guided Agricultural.
The applicant has conducted perk tests and delineated the wetlands on the property. Rice
Creek Watershed has reviewed the application and is requiring drainage easements on the
wetlands.

Jeff Hughes, of Wild Wings of Oneka Game Farm requested that prospective land buyers be aware of the
existence of the game farm and homes be located 500 feet from the roadway.
Motion made by Kellison, seconded by Peltier to recommend approval of the request of Dean and Dawn
Johnson to subdivide 30.13 acres into three lots with a variance for one lot of 9.9 acres and two lots of 10
or more acres each, subject to the following conditions:
1. Approval from Rice Creek Watershed.
2. Collection of Park Dedication fees of $500.00 per lot for the two newly
created lots.
3. Approval of septic, suitability by Washington County.
4. Potential buyers be made aware of the game preserve.
Motion made by Schumann, seconded by Peltier to amend condition four to "specify" that Wild Wings
Game Farm is adjacent to the proposed subdivision.

SPECIAL USE PERMIT - LS.D. 834
Mr. Ron Laughlin from BWBR presented plans for Withrow Elementary School, 10158 122nd
Street. They are proposing a library/media center, learning disabled classrooms, 6 standard
classrooms, staff lunchroom, standard classrooms, a gymnasium, (approx. 6500 sq. Ft.), and
sprinkler system. The proposed addition will replace the 28' X 72' temporary classroom
currently on the property. The 9 acre property is zoned agricultural. The proposed classroom
addition on the west side encroaches 10' into the 40 foot sideyard setback requiring a variance.
Placement of expansion east or south is not possible due to location of drainfield and
recreational field needs.
Motion made by Rubenzer, seconded by Peltier to recommend approval of the request of Independent
School District 834, for a special use permit and variance to construct an addition to the Withrow
Elementary School, 10158 122nd St., as submitted on plans dated November 20, 1996.

SPECIAL USE PERMIT - NADEAU/LETOURNEAU
Donald LeTourneau and Leon Nadeau are proposing to use the existing Nadeau's Market, 14583 Forest
Blvd.,, for off sale liquor sales once the market moves to their new location. The .5 acre property is zoned
CB and guided commercial. The property shares a common parking area with Carpenter's Steakhouse.
Off sale liquor stores are permitted as a special use in the CB district.
The proposed use requires a liquor license which is separate from the land use issue. The applicant has no
site plan changes which would affect access, drainage, public utilities or other municipal concerns.

Commissioners concurred that a facelift, without excess costs, would be appropriate at this time.
The applicants agreed that some painting and minor repairs would be done.
Motion made by Kellison, seconded by Rubenzer to recommend approval of the SUP for an off sale liquor
store at 14583 Forest Blvd. be approved subject to issuance of an off sale liquor license.

SITE PLAN AMENDMENT - KENCO CONSTRUCTION
Mr. Don Jensen, representing Kenco Construction, Incorporated stated that they
requesting to relocate a water quality pond currently located west of Geneva Ave., 350
feet south of 144th Street, 250 feet east of Geneva Ave., to Outlot B, RiceLake
Meadows, 2nd Addition, 250 feet east of Geneva Ave., 300 feet south of 144th St. The
pond will act as a stormwater quality pond for a 1.01 acre drainage area in Rice Lake
Meadows 2nd and 3rd additions. A change in development plans for the property south
of the existing development makes it impossible to leave the pond where it is.
Area residents were concerned that the new location would not handle the stormwater as
effectively as the current location. Certain residents objected to the relocation because
they bought their property based on the fact that there was or wasn't a pond adjacent to
their property. With the approval of this request their properties would be directly
affected. Jim Merila stated that the new pond would have a more gradual slope and
would be somewhat smaller than the existing pond. He also indicated that the water
would flow from the paved street through a grass swale to the pond and that there is no
plan for a catch basin or underground piping to the pond. Mr. Merila stated that the
direction of the roadway would have to be changed to direct the water to the pond. Mr.
Jensen informed the Commission stated that if necessary Kenco would install a pipe to
the pond.
Motion made by Rubenzer, seconded by Kellison to recommend approval of the Amended
Special Use Permit for Kenco Construction, Inc., to relocate the pond currently on the
Wegleitner Property south west of Geneva Avenue and 144th St., to Outlot B, Rice Lake
Meadows, subject to the following conditions:
1. Approval of the City engineer.
2. Approval of Rice Creek Watershed District.
3. Installation of a pipe from the roadway to the new pond location.

REZONING REQUEST - WALLER
Alice Waller excused herself from the Planning Commission to represent her mother in this request.
Margaret Waller, 14310 Homestead Ave. North, is requesting to rezone her 160 acre farm
from Agriculture to Long Term Agriculture (LTA) in order to enroll the property in the
Ag Preserves Program. The City Council approved the new zoning classification
November 4, 1996, which takes effect November 13, 1996. No changes to the current
farming activity are proposed.

Motion made by Kellison, seconded by Peltier to recommend approval of the request of Margaret Waller
to rezone 160 acres from Agricultural to Long Term Agricultural.

SUBDIVISION REOUEST - GROVER STORM
Mr. Grover Storm is proposing to subdivide a 24 -acre property into two lots of 10 and 14 acres.
The 10 -acre (Parcel C) property will be retained as the applicant's residence. The property is
zoned RR2 (5 acres) and subject to shoreland zoning (LS) zoning conditions:
The proposed minor subdivision complies with required zoning standards. The applicant has an
approved septic site, approval from the RCWD, and delineated wetland, pondage, and flowage
easements on the certificate of survey. The easements are intended to be dedicated to the City.
Motion made by Schumann, seconded by Peltier to recommend approval of the request of Grover
Storm to subdivide 24 acres into two lots of 10 and 14 acres subject to the following conditions:
1. Collection of the parkland dedication fee for one lot $500.00.
2. Conveyance of the conservation easements to the City.
All aye, motion carried.
AMENDED SPECIAL USE PERMIT - PULEO
Frank Puleo is requesting to amend his 1994 SUP to sell agricultural and horticultural products NOT
grown on site as well as horticultural supplies, decorative floral items and Christmas trees and
decorations. The original SUP allows for sale of agricultural goods as a special use. Mr. Puleo currently
has SUP's for two greenhouses, a telecommunications tower and a pole bam in the flood fringe, and also
his residence. The property is 40 acres in size and is zoned Agriculture.
Mr. Puleo stated that he is not a landscaping business and is proposing the sale of fertilizer, bagged soil
and other plant products. He may, in the future decide to expand his business to landscaping.
Motion made by Waller, seconded by Rubenzer to recommend approval of the request for an amended
special use permit for Frank Puleo to sell horticultural and agricultural products and related materials, not
grown on his property at 16155 Forest Blvd.

Commission Meeting to Thursday, December 19, 1996, TOOPM.
