The regular meeting was called to order by Chairwoman Peltier at 7:15PM.
PRESENT: Waller, Schumann, Kellison, Peltier
ABSENT: Malaski, Rubenzer
Motion made by Kellison, seconded by Schumann to approve the minutes of November 20, 1996 as
amended.
All aye, motion passed.
SUBDIVISION REOUEST - CRAIG & MINDY SMITH
Craig and Mindy smith are proposing to subdivide 39 acres into 6 residential lots using a cluster
development PUD. Mr. Smith has been before the Planning Commission with this property for concept
review. The revised design, discussed at the October, 1996 meeting, is divided in acreage as follows: Lot 1,
1.56; Lot 2, 2.22; Lot 3, 2.09; Lot 4, 3.10; Lot 5, 2.75; and Lot 6, 1.97.
Outlot A is a 4.15 acre parcel primarily consumed by a wetland. Outlot B is a 66 foot wide existing gravel
road providing access to the property to the south (The Garden). Outlot C is a 17.48 acre parcel housing a
communal drainfield and proposed to remain as permanent open space.
The property is accessed via the existing 66 foot driveway easement from 132nd St. North. The site plan
includes a 350 foot cul-de-sac to the west from the existing driveway easement. The plan includes paving of
both the cul-de-sac and 608.9 feet of Hannah Hill Court.
The proposal requests a 50% bonus, based on 55% of the development remaining common open space, tree
preservation, orientation of the development, and provision of a common septic field. These site design
considerations are a direct result of the City's rural character and ecological protection objectives as stated in
the Comprehensive Plan.
Mr. Warren Johnson, representing the applicants, stated the proposed subdivision has been reviewed by Rice
Creek Watershed, but no recommendation has been received by the City. Mr. Johnson stated that there is a
culvert under the existing driveway easement allowing drainage to the west. The proposed open space may
at some time contain a swimming pool or horse area. Mr. Johnson pointed out the proposed holding pond
on Lot 2 to retain additional drainage from the development.
Commissioner Waller expressed her concern for the additional water by the development and that the
holding ponds don't always serve the purpose for which they were designed.
Jim Bever, resident to the east, questioned whether the open space would remain that way permanently.
Residents supported the subdivision proposal.
Commissioner Kellison applauded the applicants for the excellent job in developing the property, preserving
open space, trees, and creating the common septic system.
Kellison made motion, seconded by Peltier to recommend approval of the preliminary plat of White Oak
Heights subject to the following conditions:
1. Approval by the City Engineer.
2. Approval by Rice Creek Watershed District.
3. Approval by Washington County of the septic system.
4. Park dedication of $500.00 per lot for the five newly created lots.
5. Approval by the City Attorney of the Homeowners Association agreement which shall include
provisions for street assessment, restrictions and responsibilities for Outlots A and C, the common
septic system, the private trail easement, tree preservation standards and other measures deemed
necessary by the City.

Motion passed.
Motion made by Schumann, seconded by Peltier to recommend that the City Council reappoint Jim Kellison
and Sandy Malaski to the Planning Commission for a four term to expire December 31, 2000.
All aye, motion passed.
A brief discussion regarding proposed ordinance changes was held. Commissioner Kellison suggested
parking, landscape requirements, and applications require more detail when submitted. He also suggested
that a nay vote on any particular issue should include reasons for that vote. Mixed zoning districts, more
generic terms for uses, and a licensing program were also recommended. Chairwoman Peltier doesn't want
the Metropolitan Council dictating to the City what should be done. Commissioner Waller would prefer to
conduct group guided tours when inspecting properties.
Motion made by Kellison to adjourn at 8:30PM.
