PRESENT: Agness, Miltz-Miller, Schumann, Rubenzer, Malaski, Peltier, Carole LaBelle ABSENT: Kellison Motion made by Schumann, seconded by Rubenzer, to approve the Minutes of January 25, 1995, as amended. All aye, motion passed. SPE"JA -S PERM. H On January 25, 1995, the Planning Commission considered a request by Thomas Walsh, 5635 165th St., for a special use permit to store and process fire wood at the above address. Mr. Walsh stated he is using the wood chips to fill in the low portion of his front yard. He processes and sells firewood and chips for landscaping. He will be processing the wood in the rear of his property. Mr. Walsh stated that he burns 4 or 5 times per year while there is snow cover or he obtains a permit. He stated that the fires usually burn 2 or 3 days. Mr. Walsh agreed to install some form of screening (trees or fencing). Area residents opposed the commercial operation on agricultural property and felt it should be restricted to an industrial or commercial site. At the very least if the proposed use is approved, immediate screening (fencing, large trees, etc.) should be required. Commissioners requested that the proposed conditions be reviewed by the city administrator and suggested Mr. Walsh request an extension for his request to be considered. Mr. Walsh requested the Planning Commission table his request until March 22, 1995. Commissioners also requested that Mr. Walsh work on revising the conditions with city staff. This issue will be on the March 22, 1995, Planning Commission agenda. Mr. Rick Lessard, Lessard/Nyren Utilities, Inc. 17385 Forest Blvd. North, has requested site plan approval to construct a shop for equipment repairs at the above address. Dimensions of the proposed building are 40' X 72', possibly another 30' X 40' office, and 40' X 40' cold storage building. The property was rezoned to industrial on May 6, 1991 and subject to a special use permit issued July 22, 1986. Site plan approval was granted to Lessard/Nyren on February 22, 1994 to continue using the site as office, winter storage, and vehicle storage related to the utility contracting business. The site plan proposed meets all setback and dimension requirements of the city zoning ordinances, but will require permitting under Chapter 219, Parking. Rice Creek Watershed District has not yet approved the drainage plan for the site, nor has the City received notice for approval of the septic expansion from Washington County Dept. of Public Health. In addition, MNDOT should review proposed access to Trunk Highway 61. P.C. Minutes - February 22, 1995 Page 2 Mr. Lessard stated that the building would be a Lester Brand, metal, pole type structure. He also agreed he would install trees for screening to the specifications of the City. Mr. Lessard provided written approval from MNDOT approving the current driveway as adequate for the proposed building. Motion made by Schumann, seconded by Miltz-Miller to recommend approval of the request of Lessard/Nyren Utilities Co., for site plan approval to construct a 30' X 40' shop subject to the following conditions: 1. The developer obtain necessary permits from the City for all parking facilities to be installed. 2. Approval is subject to the City's receipt of approved drainage plan for the site from RCWD. 3. Prior to construction on site, necessary permits for septic systems shall be provided. 4. Additional access approval from the State shall be required for additional buildings. 5. Twelve evergreen trees (5'- 6') be planted on the west property line for screening within March 1, 1996,. 6. Applicant shall provide the City with the specific property description for the parcel to which the special use permit is to apply. All aye, motion passed. AMENDED SPECIAL USE PERMIT -- BAL 1) EAGLE SPORTSMEN ASSOCIATION A public hearing was held to consider the request of Bald Eagle Sportsmen's Association to amend their special use permit for operation of a shooting range in the east 1/2 of the southwest 1/4 of Section 33, T31, R21W. The amendments requested would allow construction of a 40' X 12' addition to an existing building on site to be used for equipment storage, allow for one DCM shoot in September, replacing a similar shoot authorized in October, and to clarify Item No. 21 of the current permit to allow for black powder firearms on the site. Mr. Gene Schutte, President of the association presented to the Planning commission with a history of the club, their current SUP, and other background information. Numerous area residents expressed their concern for construction of a permanent building for storage implying a more permanent use. They also suggested that there may have been a reason for the DCM shoot being held in October. Residents vehemently opposed the black powder firearms stating that the club was given the opportunity to shoot black powder firearms years ago and the club relinquished that right several years ago. Commission members suggested obtaining requirements from other communities regarding gun clubs, compiling complaints within the last 3 years, provide notices to area residents for review of SUP, determine why the DCM shoot was originally scheduled in October. Certain members requested a demonstration of the black powder firearms before they made a recommendation on this issue. Other residents supported the club stating that they are members and appreciate having the club in the area. The P.C. Minutes - Page 3 February 22, 1995 Dennis Schreifels offered to arrange a demonstration of the black powder firearms for anyone interested if approved by the club's board members. Motion made by Schumann, seconded by Malaski, to recommend approval of the ASUP request to construct a 28' X 32' storage building and removal of the 3 trailers currently on site at the Bald Eagle Sportsmen's Association, 6557 125th St., as per site plan dated 2-22-95. AYE: Miltz-Miller, Schumann, Rubenzer, Malaski, Peltier ABSTAIN: Agness Motion passed. Motion made by Peltier, seconded by Rubenzer to table the request to allow black powder firearms at the BESA until a demonstration can be arranged to compare permitted firearms to the black powder. AYE: Malaski, Rubenzer, Miltz-Miller, Agness, Peltier NAY: Schumann Motion passed. Motion made by Rubenzer, seconded by Malaski to recommend approval of the- herequest requestof BESA to change the date of one DCM shoot from one day in October to one day in September. AYE: Schumann, Rubenzer, Malaski, Peltier ABSTAIN: Agness, Miltz-Miller Miltz-Miller noted she did not have enough information to make a recommendation. �:� f�. All aye, motion passed. Semler Homes provided the Planning Commission with information for a proposed subdivision. No application has been received and no one from Semler Homes was available to discuss this issue. Semler Homes will be advised to submit an application for consideration by the Planning Commission.
