HomeMy WebLinkAbout1995.03.07 PC MinutesMINUTES OF THE HUGO PLANNING COMMISSION MEETING - MARCH 7. 1995 The special meeting of the Hugo Planning Commission was called to order at 7:00PM by Chairman Peltier. PRESENT: Miltz-Miller, Agness, Schumann, Rubenzer, Malaski, Kellison Peltier, Administrator Museus, Attorney Galler, Engineer Dresel, Enqineer Bourassa, Carole LaBelle WOODS OF BALD EAGLE Mr. Jim Merila, representing Grace Development presented their plan for the planned unit development. The proposed project includes 55 single family home sites and 13 attached single family home sites (26 units). The 183 acres of property is in the area from 126th St. north to 134th St. and west of Falcon Ave. and east of Ethan Ave. The addition of the Robert Peterson property bypasses the need to use wetland for the roadway. A twelve acre park is proposed in the northeast portion of the property. The lots range in size from 12,000 sq. ft. to .75 acres. Mr. Merila stated the on site ponding will be capable of holding rainfall of a 100 year storm. Proposed housing will be 300' from the nearest existing residence. The public hearing was opened at 7:30PM. Area residents opposed the proposed subdivision stating that an EAW Petition was requested but not completed, that there was no change from the original plan submitted in 1994, traffic safety issues, drainage and potential flooding, developers and City were untrustworthy, diminishes the standard of living in the area. Mr. Jess Rousch protested the oppression imposed by city government. Residents felt it was an attempt at getting approval by a "side door" Attorney Galler clarified that a PUD was in no means circumventing the ordinance and that it was a practical means of development and this request would not be precedent setting. He stated that all real estate is considered unique and evaluated individually. Commissioner Miltz-Miller expressed her concern regarding the potential City liability and maintenance of a small park abutting two city streets. Agness raised concerns with the accuracy of the traffic study formed by the City Engineer which indicated that most of the traffic in the area will move east to west. After a lengthy discussion the following motion was made by Kellison, seconded by Rubenzer to recommend approval of the preliminary plat of the planned unit development of Woods of Bald Eagle subject to the following conditions: 1. 127th Street, Europa Avenue and Ethan Avenue, within the plat, be constructed to 38 ft. paved width. This would allow two 12 foot driving lanes for traffic safety, one 8' parking lane for resident convenience, and on 6' pedestrian lane. The pedestrian lane would be on the side of the street where the mail boxes are located to avoid conflicts between the boxes and the parking lane. All other streets within phase a1 of the plat shall be constructed to the City's 32 foot residential standard. 2. The developer shall gravel Falcon Ave. from 130th St. to their north property line to allow for emergency vehicle access. It is expected that this road will be further improved as outlots C and E are developed. 3. Rice Creek Watershed District approval of the plats drainage plan. P.C. Minutes - March 7, 1995 Page 2 4. Rice Creek Watershed district approval of the developments wetland mitigation plan. 5. An Environmental Assessment Worksheet be completed for the entire 183 acres. 6. Lots 8, 9, and 10 of Block 3 and all of Block 1, shall not receive building permits or site plan approvals until the City's Municipal Utility Service Area is expanded to include them. This does not guarantee to the developer that such MUSA expansion shall occur. 7. Approval of the final utility plan by the City Engineer. B. All sanitary sewer mains and water mains will be extended to the limits of phase I on the plat in accordance with the needs of the city, as determined by the City Engineer. 9. Public water and sanitary sewer lines will be sized to allow continuation of service to potential areas of service outside of the plat. The developer shall be reimbursed by the City for any oversizing of these facilities required to serve areas outside of the plat. 10. The developer shall provide detailed plans for City approval to reconstruct the drainage ditch leading from the Wilson Tool pond to its outflow from the development. The developer shall be responsible for constructing the improvements as approved by the City. 11. The City shall receive a ponding and flowage easement at a location, and Of sufficient area to allow mitigation for the city's lowering of the elevation of the Wilson Tool pond by two feet. 12. The City shall accept the 12.5 acres of parkland dedicated in the plat as fulfillment of the City's recreational and open space requirements. Though the area provided does not meet the total requirements of City ordinance, the City recognizes that the park area proposed will meet the recreational needs of the development, provide greater buildable area for public recreational facilities than is required by ordinance, that the developer is providing a substantial area for storm water ponding not required by the development, that the developer will incur substantial expense in placing gravel on Falcon Avenue, and that 24.9 acres (13.5%) of the development will remain as open space due to wetlands. 13. The developer cooperate with the City in the City's cleaning and reprofiling of the drainage ditch extending south from -130th Street along Falcon Avenue to the ditch draining the Wilson Tool Pond. 14. At the time of development of outlot C the developer shall provide improved street access to the city park being created as part of this development. This street shall be constructed to the City's standard for a residential street. 15. Developer shall provide a bond in an amount sufficient as determined by the city engineer for maintenance of the drainage system for a minimum of three years. 16. Covenant and conditions for the lots shall be developed which will be acceptable to the City Council inclusive of a requirement to form a homeowners association that will assess sufficient monies to maintain the drainage system. 17. There shall be two accesses only from 130th St. to the 13 attached single family home sites on the south side of 130th St. IPU Thf, d@vPlc,)p@r %hall dedicate a 60' foot easement for Exhall Ave. south of 138th St. to the south property line. Developers shall terminate the road construction of Exhall Ave. a minimum of 20' from the south property line. 19. Lot 1, block 5 shall be eliminated and the coincidental lot lines of lots 2, 3 and 4 shall be extended to the south property line. Motion made by Agness, seconded by Peltier to amend the motion to include a requirement for minimum size of home construction. All aye, amendment passed. Motion made by Miltz-Miller, seconded by Agness to amend the motion to include the placement of sod from the front property line to the front yard setback of each lot and a landscape plan for the ditch area between Blocks 5 and 6. AYE: Miltz-Miller, Agness, Schumann NAY: Rubenzer, Malaski, Kellison, Peltier Amendment failed. Vote on original motion: All aye, motion passed.
