[he regular meeting of the Hugo Planning Commission was called to order by
Chairperson Peltier at 7:00 p.m'
PRESENT: Agness, Miltz-Miller, Schumann, Rubenzer, Malaski, Peltier,
Kellison, Robert Museus, City Administrator
ABSENT: None
Motion was made by Kellison seconded by Schumann to approve the minutes of
the Planning Commission meeting on February 22, 1995.
Miltz-Miller requested that the minutes of the meeting be amended as
follows; the Planning Commission recommended that Mr. Walsh contact City
staff to work on conditions of the special use permit.
Under the section regarding site plan approval for Lessard/Nyren
Utilities, condition six should be added stating that the applicant shall
clarify the number of parcels included in the proposed site plan and
provide the City with the specific property description for the parcel to
which the special use permit is to apply.
Agness requested that the section regarding the site plan approval for
Lessard/Nyren Utilities be amended to state that MnDot shall review the
proposed access to Trunk Highway 61.
Agness also recommended the following change: clarify that the Bald Eagle
Sportsmen's Association voluntarily, agreed to discontinue the use of black
powder firearms on their property' Schumann then moved, seconded by
Kellison to approve the minutes as amended.
All aye, motion passed'
Schumann made a motion, seconded by Agness, to approve the minutes of the
Hugo Planning Commission meeting of March 7, 1995 subject to changes as
follows:
Miltz-Miller requested that the section regarding the Woods of Bald Eagle
be amended' Her concerns regarding potential City liability and
maintenance of a small park abutting two city streets.
Agness also requested an amendment to the Woods of Bald Eagle section to
reflect concerns with the accuracy of the traffic study formed by the City
Engineer which indicated that most of the traffic in the area will move
East to West.

The Planning Commission reopened consideration of a reguest by Thomas
Walsh for a special use permit to process and store wood at his property
located at 5635 165th Street which had been tabled from the Planning
Commission meeting of February 22, 1995.
The Commission indicated concerns regarding the fact that Mr. Walsh was
not present at the meeting to answer Planning Commission questions. The
Commission was concerned over the location of the proposed activities on
the site.
Kellison made a motion to deny the special use permit to Mr. Walsh, which
was seconded by Schumann.
All aye, motion passed.
The Planning Commission indicated they would be willing to reconsider the
request given changes to the site plan or additional information on how
the site is to be operated.
Dan Dolan Development, Inc. and Jeff Barbour have requested a special use
permit to construct a stone/brick monument at the entrance to the Duck
Pass Subdivision on Lot 1, Block 1, at 136th St. and County Rd. 8A. The
property is zoned RR2. The monument has already been constructed.
Mr. Walter Stoltzman stated that past City policy has been to charge
double permit fees whenever an individual constructs improvement without
appropriate City permits.
As there was no additional comment from the public, Peltier then closed
the hearing.
The Planning Commission discussed the set back requirements. Miltz-Miller
expressed her concern that the monument should be subject to a separate
hearing for a variance to required set backs. Miltz-Miller then made a
motion, seconded by Rubenzer, to table action on the requested special use
permit pending a variance hearing on the set back requirement in the
presence of the applicant to answer Planning Commission questions.

SF-'E*C I AL USE PERMIT -- IYION'YANARI HOMES
Montanari Homes, Inc. has requested a special use permit to install a 4' x
8' directional sign at the intersection of County Rd. 8A and Highway 61.
The sign is currently constructed on the site replacing a previously
permitted sign erected by another developer. No one was present to
comment on the request.
Rubenzer made a motion, seconded by Agness, to approve the special use
permit as requested subject to the sign being removed from the site within
two years. Montanari Homes must be responsible for maintaining the sign
and adjacent areas in accordance with City ordinance.

SPECIAL USE PERMIT - CONCRETE YARD ORNAMENTS
Garland Vacinek has requested a special use permit to install a 4'x8'
plywood painted directional sign at the southwest corner of 165th Street
and Highway 61. The property is zoned industrial.
Mr. Vacinek was present to discuss this matter with the Planning
Commission. He stated the sign was necessary to direct the public from
Trunk Highway 61 to his business at 165th Street. No other comments were
received.
Miltz-Miller made a motion, seconded by Agness, to grant the special use
permit for a two year period subject to the conditions that the permitee
maintain the sign and the adjacent area in accordance with City
ordinance. The top of the sign shall not exceed 16' from the ground.
All aye, motion passed.
SITE PLAN APPROVAL. - WILSON TOOL
Wilson Tool has requested site plan approval to construct a 36,200 sq. ft.
building on their property in the Bald Eagle Industrial Park. The
proposed building is located on the south side of Farnham Ave. and south
of 130th St. The building will be used as a manufacturing machine shop
and office.
Kellison made a motion, seconded by Miltz-Miller to approve the site plan
subject to an approved landscaping plan and Wilson Tool acquiring all
necessary permits with the Watershed District and other agencies before
construction on the site.
All aye, motion passed.
FINDINGS OF FACT -- WOODS OF BALD EAGLE
Planning Commission considered findings of fact prepared by the City
attorney, Greg Galler, regarding the Planning Commissions action on March
7, 1995, concerning a new development called the Woods of Bald Eagle.
The Planning Commission reviewed the document prepared by Mr. Galler and
Agness made a motion to amend the findings of fact by changing the
wording. In the first sentence of item 9 in the staff recommendations it
is to read as follows: "Public water and sanitary sewer lines will be
sized to allow continuation of service to potential areas of service
outside of the plat extending south to 120th Street." Seconded by
Peltier.
All aye, motion passed.
Agness made a motion, seconded by Malaski, to approve the findings of fact
as amended.

SEMLER HOMES --- CONCF*.:P'T REVIEW
Tony Emmerich representing Semler Homes requested a concept review for a
proposed townhome development east of Highway 61 on Egg Lake Road. The
Planning Commission, through discussion, indicated the following concerns
with the proposal.
1. The impact of the street access proposed on the level of safety
on County Rd. 8A.
2. The need for an integrated and detailed landscaping plan for the
development.
3. The potential for future connection of the main street in the
development to the south and the implication of the street
becoming a permanent dead end.
4. The need for recreational facilities and open space in accordance
with City ordinance.
5. The impact of expected demographics of the development on the
recreational facilities.
6. The number of units proposed may be excessive for the site.
7. The offstreet parking areas being discussed may be excessive and
lead to unnecessary paving which creates an industrial appearance
to the development.
8. Is part of the landscaping plan buffering the proposed
development from existing residential to the east and commercial
development to the west?
9. Ponding and potential wetland mitigation impacts on the proposed
development.
10. The number and proximity of the private streets in the
development may pose a traffic problem.
The Planning Commission generally indicated that the placement of
townhomes in this location, given its high water table which may require
slab on grade construction and the commercial property to the west, may be
acceptable, but that substantial detail (especially in the area of the
maintenance of open space, buffering, and park areas) would be necessary
to make the final determination.
Peltier requested the Planning Commission consider recessing the meeting
in order to allow the Planning Commission to attend the black powder shoot
at the Bald Eagle Sportsmen's Association facility, as previously
discussed by the Planning Commission.

Council member LaValle informed the Planning Commission that the Council
has required the BESA to conduct a scientific analysis of the use of black
powder firearms on the site, specifically regarding to MPCA noise
standards. The Commission directed the City Administrator to request that
the BESA inform the Planning Commission of the date and time they will be
conducting the tests requested by the Council so that the Commission may
be present at the time of the shoot.
Miltz-Miller requested that discussion of a landscaping ordinance be
included on the aqenda of the next Planninq Commission.
Motion made by Rubenzer, seconded by Miltz-Miller to adjourn at 9:55 p.m.
