The regular meeting was called to order by Chairman Peltier at 7:07PM.
PRESENT: Agness, Schumann, Kellison, Peltier, Administrator Museus

Motion made by Schumann, seconded by Peltier to approve the minutes of
March 22, 1995 as amended.
All aye, motion passed.
Commissioner Miltz-Miller arrived at 7:12PM.
Motion made by Kellison, seconded by Peltier to approve the minutes of
March 30, 1995 as amended.

Motion made by Schumann, seconded by Kellison to approve the Minutes of
April 18, 1.995 as amended (Ed Elliott, with Loucks and Assoc.).

SPECIAL USE PERMIT -- DOLAWBARBOUR
Dan Dolan Development Inc. and Jeff Barbour have requested a Special Use
Permit to construct a stone/brick entrance monument on Lot 1, Block 1, of
Duck Pass Subdivision, located at the intersection of 136th St. and County
Rd. 8A. The property is zoned RR2 and the monument has already been
constructed. The Planning Commission considered this request on March 22,
1995, and tabled action on this SUP pending a variance hearing on setback
requirements, as well as the presence of the developers to answer
questions.
Chairman Peltier opened the public hearing. Gene Riopel questioned hwo
something could be built without a permit. The public hearing was closed.
Commission Miltz-Miller opposed the request because she felt a variance
should not be granted because of action caused by the property owner.
Commissioner Agness opposed the request because the applicant was absent
from the meeting and questions remained unanswered.
Motion made by Kellison, seconded by Schumann, to recommend approval of
the variance request of Dan Dolan Development, Inc. and Jeff Barbour to
construct a stone/brick monument on Lot 1, Block 1, Duck Pass Subdivision
12 ft. from the east property line subject to the following conditions.

1. Maintenance of the monument and its easement shall be the
responsibility of the Duck Pass Homeowners Association.
2. The covenants of the Duck Pass Homeowners Association shall be amended
to provide for maintenance of the monument and its easement area, as
well as providing a funding mechanism for such maintenance.
3. At any time the monument falls into a state of repair, the Council may
terminate this special use permit and remove the monument subject only
to notice of the Council's intention, in advance, to the homeowners
association.
4. A fine of $500 should be imposed for failure to obtain permit.

SPECIAL USE PERMIT/SHEPHERD OF THE FIELDS
Shepherd of the Fields Lutheran Church, 6000 148th St., Hugo has requested
a special use permit to construct a tower structure to hold a church bell
on their property at the above address. The structure will meet all
setback requirements.
Chairman Peltier opened the public hearing. No one from the public
commented. James Brevig, representative from the church stated that they
may include a cross to the top of the tower or to the sides. They do not
plan to use the structure for storage.
Motion made by Agness, seconded by Schumann to recommend approval of the
request of Shepherd of the Fields Lutheran Church to construct a bell
tower at 6000 148th St.
All aye, motion passed.
SPECIAL USE PERMIT/LESSARD-NYREN
Lessard/Nyren Utilties Incorporated, 17385 Forest Blvd. North, has
requested an SUP to maintain exterior storage as a principal use on their
property at the above address. Hugo City Code 320-5, Subd. N, states that
exterior storage becomes a principal use of a lot when the exterior
storage occupies 30% or more of the floor area of the existing principal
building on the lot and established the following standards for such use.
Chairman Peltier opened the public hearing. Gene Riopel, owner of the
property on the east was concerned about runoff into his field.
Lessard/Nyren stated they will create a swale to retain the water on their
property. The applicants are proposing to use the entire property, not
already used for structures or bituminous, as exterior storage. They will
not be installing additional bituminous. Material to be stored will be
only dry goods used for utility installation. Five to six foot pine trees
will be planted around the pond, adjacent to Forest Blvd., and on the
sides. Fencing will be installed prior to planting trees. The applicants
are willing to listen to neighbors complaints and work out solutions to
any problems.

Commissioner Schumann suggested they have the Rice Creek Watershed
review the site to determine if additional water retention areas should be
included.
Motion made by Kellison, seconded by Peltier to recommend approval of the
request of Lessard/Nyren Utilities, Inc., 17.385 Forest Blvd. to use their
property as exterior storage as defined on the site plan dated 4-27-95
subject to the following conditions.
1. The lot is improved by landscaping, grading, surfacing of the storage
area, and surfacing of access drives.
2. All yard requirements of the ordinance are met.
3. Secure fencing of the storage area is provided if materials to be
stored are in any way hazardous to the public.
4. Screening of the storage area is provided to the lots adjacent to a
zoning district with a more restrictive classification.
5. Applicant shall secure all approvals required from the Rice Creek
Watershed District for any extra runoff from the site.
6. All pine trees to be installed are to be 5 to 6 feet tall except at
the east property line where seedlings may be planted. All pine trees
shall be maintained and show substantial healthy growth for a minimum
of one year.
7. The Special Use Permit shall be reviewed if the property is sold and
ownership transferred.
8. The exterior storage shall be limited to equipment and materials used
by applicant in the installation of underground telecommunications
utilities.
9. The site shall have no more than 80% impervious surface including
buildings, bituminous, and gravel storage areas.

Dr. Bill Barrett, 5673 147th St., has requested Site Plan Approval to
construct an approximately 4,000 sq. ft. building on his property at the
above address. Dr. Barrett's property is divided into two separate
parcels. The western parcel adjacent to Trunk Highway 61, is the site of
and existing 4,000 sq. ft. building. The proposed building on the east
lot, fronting on 147th St. will meet all setback requirements of the
City's CB zoning district.
The two parcels meet city requirements regarding maximum lot area to be
covered with buildings and maximum percentage of lot area to be covered
with parking surface for structures of any type.
Hugo City Code, Chapter 219-7, requires one parking space for 200 gross
sq. ft. of floor area for professional and business buildings. The 41
parking spaces proposed for the site meets the requirements of this
ordinance.
Dr. Barrett was present and stated that had been informed by his surveyor
that the property would not accommodate the building as proposed. Dr.
Barrett will review his request and contact the City when he makes a
decision on how to proceed.
Motion made by Schumann, seconded by Agness to table the request until
further notice.

L ANDSCAPE ORDINANCE DISCUSSION
Motion made by Peltier, seconded by Agness to table discussion on the
landscape ordinance until review of the comp plan with Ed Elliott.
All aye, motion passed.
COMP PLAN DRAFT REVIEW - ED ELLIOTT
Review of the comp plan resumed on Page 11, Ed Elliott of Loucks and
Associates was present. Numerous changes were recommended which will be
incorporated by Mr. Elliott. Discussion ended on page 17, Public Safety.
Meetings were scheduled for May 10, May 17, 7:00PM, Hugo City Hall to
continue the review.
Resuming discussion on a landscape ordinance, it was determined that
Administrator Museus and Commissioner Miltz-Miller would meet to organize
a committee or determine how to proceed.
Motion made by Schumann, seconded by Kellison to recess the Planning
Commission until May 10, 1995, 7:00PM, Hugo City Hall.
