The regular meeting was called to order by Vice Chairman Agness at 7:OOPM.
PRESENT: Miltz-Miller, Agness, Schumann, Rubenzer, Malaski, Kellison,
Administrator Museus, Carole LaBelle
ABSENT: Peltier
Motion made by Kellison, seconded by Miltz-Miller to approve the minutes
of April 26, 1995, as amended.
All aye, motion passed.
Motion made by Schumann, seconded by Kellison, to approve the minutes of
May 10, 1995 as amended.
All aye, motion passed.
Motion made by Kellison, seconded by Miltz-Miller to table action on the
minutes of May 17, 1995, until the June 28, 1995 meeting.
All aye, motion passed.
SUBDIVISION REQUEST - DARL._E:-NE NORR I S
Ms. Darlene Norris, 5812 147th St., Has requested to subdivide her
property into two parcels. This property is currently zoned SFU and
public water, sewer, and storm sewer- is available. Both parcels will meet
the minimum dimension requirements of the City but the subdivision will
create a non conforming use for a stied located to the rear of Ms.. Norris'
property. City ordinance requires a 50' rear- yard setback. If the new
property line is approved the existing shed will be located 10.6 feet from
the rear property line of Parcel B. Staff recommends approval of this
request subject to special conditions.
Ms. Norris provided the City with a letter from her attorney indicating
that she is the only fee owner of the property to be subdivided. She also
stated she would remove the storage building from the newly created lot to
conform with City_ ordinance. There was no comment from the general
public.
Motion made by Kellison, seconded by Rubenzer to recommend approval of the
request of Darlene Norris, to subdivide .5 acres into two parcels which is
bordered by 148th St. on the north and 147th St. on the south as proposed
in preliminary survey dated April 26, 1995.
All aye, motion passed.
SPEC I AL_ USE PERM I T - THOMAS WALSH
Mr. Thomas, 56.55 165th St. North, has resubmitted an application for a
special use permit to store and process firewood at the above address. A
previous application for this special use permit was denied by the City
Council on April 3, 1995 in response to the Planning Commission's
recommendation. The Planning Commission recommended denial of the request

on March 225 1995 because Mr. Walsh was not present to address questions
from the Planning Commission. At that time, the Commission indicated that
if Mr. Walsh presented new evidence the SUP could be reconsidered.
Motion made by Malaski, seconded by Kellison, to reconsider the request of
Thomas Walsh for a Special Use Permit to process wood at 5635 165th St.
based on the additional information provided by Mr. Walsh regarding time,
dates, and location of the activities.
All aye, motion passed.
The public hearing was opened and several area residents were in
attendance objecting to the request. Art Munger, Rick Suess, Ken Gervais,
and John Thommes stated the area is being filled with wood chips, it is
agriculture property not industrial, area looks like a slum, the area is
residential, and numerous piles of cut wood and chips are stored on site.
The public hearing was closed at 8:04PM.
Rice Creek Watershed District indicated that a permit would be necessary
only if filling was needed to cross a wetland area. Commissioners
concurred that there should be a specific site plan indicating placement,
size, and type of trees to be planted, hours of operation, SUP be limited
to 18 months, clean-up of the north portion of the property, and all
material moved to the rear of the property, and setbacks maintained.
Motion made by Kellison, seconded by Schumann, to table Thomas Walsh's
request for a Special Use Permit until July 26, 1995 to address the issues
previously specified.
Amendment made by Kellison to include issues of access, driveway filling,
emergency vehicle access, RCWD permit, Hugo Fire chief and city engineer
to conduct site inspection, delineation of wetlands, delineation of
property lines. Seconded by Agness.
Motion withdrawn by Kellison.
Motion made by Kellison, seconded by Malaski to table the request of
Thomas Walsh until the following information is provided; specific site
plan, including tree planting, survey, delineation of wetlands, RCWD
approval, approval by Hugo Fire Chief for emergency vehicle access to be
submitted to the City by July 19, and to area residents by July 12 for
review.

Mr. Jerry Lovegren 8355, 122nd St', Hugo, has applied for a Special Use
Permit to construct a 40' X 63' accessory building on a lot adjacent to
his resideAce' The proposed building -is 2,520 sq. ft', where 1800 sq' ft.
is allowed. The building would be located within the shoreland district
of Round Lake which requires a 100' setback from the lake's ordinary high
watermark' The property lines on the site plan provided by' Mr. Lovegren
do not clearly define the setbacks of the proposed building' As an
option, the Planning Commission may wish to consider denying the special
use permit but granting the variance subject to Mr. Lovegren combining his
parcel into one lot of record. If the resulting combined parcel exceeds
20 acres in size, then a variance to the building size would not be
required. If the Planning Commission wishes to recommend approval of the
SUP, staff recommends special conditions.
The public hearing was opened. No one from the general public was present
to comment. Mr. Lovegren stated that the combined total of his two lots
is 17.65 acres. He stated that he will file the document with Washington
County in the fall to combine his two parcels which would eliminate the
necessity for a Special Use Permit. Mr. Lovegren stated he plants six
acres in alfalfa and needs this size building for storing his farm
equipment.
Commissioner Schumann felt that this was a reasonable request for an
agricultural use. Other Commissioners questioned the size of the proposed
building in an RR2 zone and what adverse effect there may be should the
property be subdivided in the future.
Motion made Kellison, seconded by Schumann to recommend approval of the
request of Jerry Lovegren, 8355 122nd St. for a variance to construct a
40' X 63' accessory structure on his property exceeding the allowable
limit by 720 sq, ft., subject to the following special conditions:
1. The two parcels be combined and recorded at Washington County into
one parcel no later than December 31, 1995.
2. A deposit of $3,000 be submitted to the City to ensure compliance.
VOTING AYE: Agness, Malaski, Schumann, Kellison, Rubenzer
VOTING NAY: Miltz-Miller
Miltz-Miller stated that her recommendation for denial was not a personal
issue, but felt a variance could only be granted as a hardship to the land
and not simply as an owners preference.
Miltz-Miller requested that the City Council and Planning Commissioners
receive copies of the state statutes regulating the granting of variances.

Agness requested that Administrator Museus contact the Land Trust to set
up a meeting for May 31, 1995 to discuss the preservation of agricultural
land.
A public hearing has been scheduled for June 14, 1995, 7:00PM, at Hugo
Elementa'ry School.

Commissioner Malaski stated she received a complaint regarding the
operation of the gravel pit not observing the hours specified in the
Mining Permit and careless driving on 8A.
Motion made by Schumann, seconded by Agness to recess the meeting until
May 31, 19955 7:00PM, Hugo City Hall to resume discussion on the comp
plan.
