HomeMy WebLinkAbout1995.10.25 PC MinutesThe Hugo Planning Commission meeting was called to order at 7:08PM by Chairman Peltier. PRESENT: Miltz-Miller, Agness, Schumann, Rubenzer, Kellison, Peltier ABSENT: Malaski Motion made by Kellison, seconded by Peltier to approve the Minutes of September 27, 1995, as amended. AYE: Miltz-Miller, Agness, Schumann, Kellison, Peltier ABSTAIN: Rubenzer Motion carried. Commissioner Kellison excused himself from reviewing the McElmury SUP issue as he is an adjacent property owner and stated for the record he has refrained from expressing his opinion. Mr. Bob McElmury, 1923 Stillwater St., White Bear Lake, has requested to amend the special use permit for Bobbers Boats and Bait, 4444 129th St. North, Hugo. Mr. McElmury wishes to change the existing permit in order to: I. Provide portable and permanent fish house rentals on Bald Eagle Lake. 2. Provide a winter access point to the lake from Bobber's Boats and Bait. 3. Eliminate the City's purchase option on the existing permit. Mr. McElmury stated he would provide 20 permanent and 15 portable fish houses on Bald Eagle Lake. He added that he would provide a dumpster for lake users, emergency help, and provides parking at the north end of Bald Eagle for a $1.00 fee. He recently installed a new holding tank. Mr. McElmury stated that he not received any complaints from the public regarding his business. Mr. McElmury would provide fish houses from mid November until February 15th. Chairman Peltier opened the public hearing. Mr. Kellison provided photos of the site. There are currently 3 pontoon boats on site, with parts of 2 more. Mr. Kellison stated that 3 members of his family have personally complained to Mr. McElmury regarding late night noise, selling beer without a license, the unsightliness of the area, and that no noticeable screening has been implemented. Mr. Kellison also felt that renting parking spaces for a fee was in violation of his SUP. Other Hugo residents felt that winter access at the north end of Bald Eagle Lake and fish house rental would be an asset to the community. It was also stated that Mr. McElmury has made progress in cleaning up the site and is trying to comply with all conditions of his SUP. P.C. Minutes - October 27, 1995 Page 2 Commissioners concurred that until all conditions of the current Special Use Permit have been met, no amendments should be considered. Motion made by Agness, seconded by Peltier to table this request until the meeting of November 15, 1995, at which time the Commission would like following issues addressed. 1. Inspection report from the City's code enforcement officer. 2. A definitive site plan for the property including placement of ballards and cable and a proposed storage area. 3. Engineering report on safety regarding access to the lake. All aye, motion carried. Howard Arcand, et al, 1850 Cedar Ave., White Bear Lake, has requested a minor subdivision of his property located in Section 17, east of Highway 61 and north of 152nd St. in order to provide .8 acres of land to Northern States Power Co. for expansion of an adjacent substation. The plan has been reviewed and approved by the Rice Creek Watershed District and since public utilities are allowed in any zoning district of the City, and the remaining property will exceed the requirements of the City's agricultural district. Dave Callahan, representing Northern States Power, stated that this is a major system improvement increasing the service from 69,000 volts to 115,000 volts. NSP will remove the existing structure when the proposed structure is completed. Motion made by Rubenzer, seconded by Peltier to recommend approval of the request of Howard Arcand/NSP to subdivide .8 acres to construct a utility substation for improvement of electrical service to the area. All aye, motion carried. SL IF John and Donna Kostuch, 5342 142nd St., Hugo, and Dan and Patricia Nadeau, 14621 Fitzgerald Ave., Hugo, have requested a minor subdivision consisting of combining a 1.5 acre parcel with lot 16, block 3, Oneka Estates, subdividing the property into three, single family homesites as the second addition to Oneka Estates. All lots proposed will meet the requirements of the City's SFU zoning district. Public sewer and water services have been provided to each of the three proposed lots during the construction of the sewer and water mains of the Oneka Estates Subdivision. There were no comments from the public' Commissioners concurred that this was a reasonable request and compatible with the surrounding area. P.C. Minutes - October 27, 1995 Page3 Motion made by Schumann, seconded by Agness to recommend approval of the request of Kostuch's/Nadeau's to subdivide 1.5 acres and Lot 16, Block 3, Oneka Estates into three, single family, residential lots, subject to the following conditions: 1. Parkland dedication fee of $500.00 be paid for the new lot created in accordance with Hugo City Code Subd. 290-13. 2. A grading plan be provided for approval by the City engineer prior to issuance of the building permit for Lot 2. 3. The developer must meet all special conditions of plan filing required by Washington County. 4. A $1,500 utility connection fee be paid for the lot created IAW Hugo City Code, Chapter 262-6, Subd. A(3), prior to filing of final plat. All aye, motion carried. PUBLIC.' HEARING CONTINUED --- RICE I (AKE MEADOWS 4TH Kenco Construction, Inc., 13767 Northeast Johnson St., Ham Lake, has submitted an application for a planned unit development known as Rice Lake Meadows 4th Addition in order to subdivide 8.452 acres of land into 5, single family residential lots. This matter was subject to a hearing before the Planning Commission on September 27, 1995. Action on the request was tabled pending the engineer's review of the project and permitting by the Minnesota DNR, and the Rice Creek Watershed District. The Planning Commission expressed concerns regarding potential drainage problems on the site, wetland delineation, ordinary high water mark of Egg Lake, the proximity of an existing private driveway easement to a proposed building site, and the potential need for parkland dedication as part of this project. The Planning Commission also requested an overall plan of Rice Lake Meadows 1, 2, 3, and 4. Jim Merila stated that Kenco had received approval from RCWD and the DNR. Kate Drewry has verified wetland delineation for the site. Mr. Merila stated that 145th St. south of Geneva Ave. would have to be vacated to meet setback requirements on Lot 5. As proposed, nearly all of the front yards on lots 1 through 4 would be utility easement. Area residents reiterated their concern that there is no park in the area and part of this property should be reserved for neighborhood children. Mr. Roessler agreed to meet with the residents to establish a home owners association. Mr. Arnt was named as the spokesperson to contact Mr. Roessler to set up a meeting time and date. Mr. Roessler pointed out that the outlot in Rice Lake Meadows is as suitable for a park as any proposed lot in Rice Lake Meadows 4th. Motion made by Kellison, seconded by Peltier to table this request until November 15, 1995, and all conditions of the letter of October 19, 1995 have been complied with. Minutes - October 27. 1995 Page 4 Schumann made motion, seconded by Rubenzer to recommend approval of the request of Kenco Construction, Inc., subject to the following conditions: 1. Lot 5 will be unbuildable until the extension of Geneva Ave. south of 145th St. is vacated. 2. Water service will be installed in the street. 3. Sewer service will be installed in the front vard easement. 4. Reduce driveway easement on lot 4 to a 20' maximum. 5. Add cul-de-sac at intersection of 145th St. and Geneva Ave. 6. Add fire hydrant. 7. Add catch basin. 8. Show drainage and utility easements on survey. AYE: Agness, Schumann, Rubenzer, Peltier NAY: Miltz-Miller, Kellison Motion made by Peltier, seconded by Rubenzer to adjourn at 11:15PM. All aye, motion carried.
