PRESENT: Agness, Schumann, Malaski, Kellison, Peltier ABSENT: Rubenzer Motion made by Schumann, seconded by Peltier to approve the minutes of October 25, 1995 as amended. AYE: Agneis, Schumann, Peltier ABSTAIN: Kellison, Malaski Motion made by Schumann, seconded by Agness to approve the minutes of November 2, 1995 as amended. AYE: Agness, Schumann, Peltier ABSTAIN: Kellison. Malaski Dean and Rosalie Stedt, 7416 132nd St. North, have requested a minor subdivision of a 20 acre parcel, they are purchasing on contract for deed from Lorraine St. Sauver, 1812 Birch 8t., White Bear Lake, into one 6.89 acre parcel and one 13.1 acre parcel. The property is currently zoned agriculture. This is an unusual situation since the property being purchased by the Stedts, parcels A and C, are recorded as one parcel with Washington County. Parcel B on the certificate of survey is a 30 acre tract owned by Mrs. St. Sauver, purchased on contract by Stedt's. Tract C being only 6.9 acres does not meet the minimum lot size of the City's agricultural district and it's lot frontage of 176.75 ft. is less than the 300 feet required by ordinance. The City has received a copy of the percolation test performed in September of this year for lot C and as yet have not received the permit for the site from Washington County Dept. of Public Health. The City does not have a perc test for Lot A. The boring log from the perc test on site C indicates that the OHW level on the site is 2 to 3 feet below t^^ surface elevation, which indicates that one to two feet of fill will be necessary to construct a home on the site. Since the underlying property title to both parcels rests with Ms. St. Sauver, it would be preferable for the requested subdivision to be altered so that the three parcels on this forty acres all meet the minimum lot size requirements of the City's agricultural district. Several residents opposed the creation of a lot which does not meet the current required road frontage and size requirements. Two other residents felt that a five acre lot was sufficient. Commissioners Agness and Kellison recommended requiring the ten acre minimum, but waiving the parkland dedication fee to aid in paying for additional surveying. Commissioner Schumann suggested leaving the 176 ft. road frontage but increasing the lot size to ten acres. Motion made by Agness, seconded by Kellison to recommend denial of subdivision request of Dean Stedt because it does not meet the City's minimum requirements for the Agricultural district. AYE: Kellison, Agness NAY: Schumann, Malaski, Peltier P.C. Minutes - 11-15-95 Page 2 Motion failed. Motion made by Schumann, to recommend approval of the request of Dean Stedt, to subdivide 6.9 acres with a variance for 176.76 ft. of road frontage, subdivide to the addition of 3.1 acres to meet the minimum requirement for the agricultural district. Motion fails for lack of a second. Motion made by Schumann, seconded by Peltier, to recommend approval of a subdivision for Dean Stedt to subdivide 10 acres, with a variance to road frontage to 200 ft., and waiver of the parkland dedication fee of $500.00. AYE: Agness, Schumann, Peltier NAY: Kellison, Malaski Motion passed. Commissioner Kellison excused himself from the Planning Commission review of the next agenda item. At the Planning Commission meeting of October 25, 1995, a public hearing was held at the request of Robert McElmury to amend his SUP for operation of Bobber's Boat and Bait, on the north end of Bald Eagle Lake to include ice house rental. The City engineer's review of the safety of establishing a winter access to Bald Eagle Lake from 129th St., a compliance review of the existing special use permit for the site by the City's building official and a detailed site plan from Mr. McElmury was provided to the Commission. The public hearing was opened by Chairman Peltier. Mr. Jim Kellison felt that the engineer's review of the safety issue from 129th Street was inadequately addressed. Mr. Mike Duffy, attorney for Mr. Kellison, stated that after review of the ordinance, felt that issuance of an SUP was not allowed for that zoning district and questioned whether the use could be intensified. Mr. Duffy also stated that the health, safety, and welfare of the adjacent property owners should be taken into consideration' It was noted that several residents complemented Mr. McElmury on the progress he has made in cleaning up the site. Commissioner Malaski would like the SUP issuance reviewed by the city attorney. Noting the date the application was received, and that it must be reviewed by the City Council within 90 days, and no extension for review was granted by the applicant, the following motion was made. Motion made by Agness, seconded by Schumann to recommend denial of the request of Robert McElmury, Bobbers Boat and Bait, for an amended special use permit to include rental of ice fishing houses on Bald Eagle Lake for the following reasons. 1. Non compliance with the current Special Use Permit. 2. Poor location for additional traffic. All aye, motion passed. P.C. Minutes - 11-15-95 Page 3 The Planning Commission conducted a public hearing on the proposed comprehensive plan for the City on November 2, 1995. Consideration of the Plan's adoption was tabled until this evenings meeting. Ed Elliott, the consultant assisting the City with revisions to the comprehensive plan, provided an update on changes made to the plan based on the workshop and hearing: A. Numerous spelling changes, corrections, and additional descriptions have been included. 2. Omit the last line of page 23. 3. On page 27, under wildlife, the second sentence now reads, " Local observation of wildlife indicates an increase in some species". 4. Page 37, a fourth sentence will read, "an access to Rice Lake is provided from homestead Ave. North." An additional two sentences will read, "The City has recently acquired two large parcels of land, 80 and 30 acres in size. Some of this land will be used for parkland and public open space. 5. Delete policy 84. Motion made by Agness, seconded by Schumann to recommend approval of the Revised Comprehensive Plan subject to the following changes: 1. The Waller property, 160 acres in the southwest quarter of Section 22 be included in the agricultural district. 2. The east side of Oneka Lake Blvd. south of 157th St. be kept agricultural. All aye, motion passed. Commissioner Schumann noted his approval was under protest. Motion made by Malaski, seconded by Peltier to move the December meeting to the 20th. All aye, motion passed.
