Chairman Peltier at 7:04PM.

Motion made by Kellison, seconded by Olson to approve the minutes of April
27, 1994 as amended.
All aye, motion passed.
A public hearing was held to consider the request of Harold and Nancy
Bramstedt, 6104 Egg Lake Rd., to rezone approximately 20 acres, located in
the northwest quadrant of the intersection of Egg lake Rd. and Goodview
Ave. from SFE to SFU. The area subject to the request lies within the
City's MUSA with municipal sewer and water available to the site.
Adjacent property zoning is a combination is SFE and SFU. The property is
also within the shoreland district of Egg Lake and a portion of the
property lies within a designated floodplain. The soil map indicates that
a large portion of the site may be unsuitable for building due to wetness.
Several commissioners felt it would be appropriate to wait until the
wetland delineation has been made. Mr. Museus reminded the Commission to
review this as a rezoning and not a subdivision request.
Motion made by Schumann, seconded by Olson, to recommend approval of the
request of Harold and Nancy Bramstedt to rezone 22.7 acres from SFE to
SFU.

Gerhardt and Clara Pareigat, 7993 140th St. North, have applied for a
minor subdivision of 20 acres into one ten acre parcel and two, five acre
parcels. The southeastern 5 acre parcel labeled Parcel C on the survey is
landlocked and has not received approval for a septic system. It is the
Pareigat's intention to sell this parcel to the adjacent property owner
who will combine it to their existing parcel. The northeast parcel has
been found suitable for a septic system by the Washington County
Department of Public Health and has immediate access to 140th St. Parcel
A, the western half of the subdivision is the Pareigat's home. The
property is zoned RR2.
Mr. Pareigat reviewed this request with the Commission and requested that
they waive the parkland dedication fee for Parcel C which will be combined
with adjacent property and will not create a new home site.
Motion made by Agness, seconded by Schumann to recommend approval of the
request of Gerhardt and Clara Pareigat to subdivide 20 acres into one ten
acre parcel and two 5 acre parcels subject to the following conditions.

1. Parcel C be deeded to the adjacent property owner and included in
their parcel description in order to avoid creation of a landlocked
parcel.
2. Approval of subdivision be subject to comments, restrictions, and
requirements by the Rice Creek Watershed District if any.
3. Parkland dedication fee be collected for parcels B and C.
After further discussion regarding the collection of parkland fees and the
transfer of property Agness moved to rescind his motion, seconded by
Schumann
All aye, motion passed.
Motion made by Olson, seconded by Peltier to recommend approval of request
of Gerhardt and Clara Pareigat to subdivide 20 acres into one ten acre
parcel and two 5 acre parcels subject to the following conditions.
1. Parcel C be deeded to the adjacent property owner and included in
their parcel description in order to avoid creation of a landlocked
parcel.
2. Approval of subdivision be subject to comments, restrictions, and
requirements by the Rice Creek Watershed District if any.
3. Waiver of the parkland fee for Parcel C based on the fact that it
will not be a buildable lot.
All aye, motion passed.
Ronald and Ila Mae DesLauries, 2095 East Larpenteur Ave., Maplewood, have
submitted an application to subdivide agriculturally zoned property into
two, ten acre parcels. The property is generally located east of Elmcrest
Ave. and north of 129th St. The Rice Creek Watershed District has stated
they will require wetland delineation and the City has not yet received
evidence that the sites are suitable for septic systems. The public
hearing was opened and closed without any comments from the public.
Commissioners concurred that the request was consistent with the
surrounding area, was high property, and the property is adjacent to
Elmcrest Ave.
Motion made by Kellison, seconded by Agness to recommend approval of the
request for subdivision of 20 acres into two, ten acre parcels subject to
the following conditions:
1. Compliance with all requirements of Rice Creek Watershed District.
2. Approval by Washington County Public Health for septic systems for
the two parcels.

A public hearing has been scheduled to consider the request of Richard
Carron and Darrel Hanson to conduct mining operations on the northwest 1/4
of the southwest 1/4 of Section 23, T31N, R21W, and the east 1/2 of the
southeast 1/4 of Section 23, T31N, R21W. This permit has been the subject
of litigation between the City of Hugo, the applicants, and the citizen's
group known as Hugo 2000. On May 2, 1994, the Hugo City Council entered
into a settlement agreement with the other parties in the litigation to
satisfy, to the best extent possible, the claims and competing interests
of the groups involved. Staff recommends approval of the Special Use
Permit, subject to the conditions and restrictive covenants of the
settlement agreement filed with the Tenth Judicial District Court, as
court file number C7-92-4225.
Jonathan Miesen, representing Hugo 2000 stated that River City Asphalt
should be required to obtain a mining permit before any further mining
would be done and also file a reclamation plan with the City prior to the
SUP being approved.
Administrator Museus has recommended that the SUP and the Mining Permit be
dealt with individually and because of the pending litigation.
Motion made by Agness, seconded by Schumann to recommend approval of the
request of River City Asphalt for a Special Use Permit to mine the
property described above subject to the terms and conditions of the
Settlement Agreement known as Tenth Judicial Court file #C7-92-4225.
All aye, motion passed.
Commissioner Agness encouraged the applicant to file a reclamation plan
and obtain a mining permit as soon as possible.
David Schumann from the Environmental Committee, Sandy Malaski, from the
Image Committee, and Jim Kellison from the Economic Development Committee
reviewed the work done by each of their groups for revision of the City's
comprehensive plan.
Commissioner Rubenzer arrived.
CONSULTANT INTERVIEWS - COMPREHENSIVE PLAN
The Planning Commission interviewed David Licht of Northwest Associated
Consultants, and Mr. Ed Elliot of Loucks and Associates, to determine
their ability to assist with the preparation of the City's Comprehensive
Plan.
Concerns were expressed by Kellison and Agness regarding the large
difference between the cost associated with the two proposals and the
question if the two proposals were similar enough in scope for the
Planning Commission to make a decision.

Kellison made motion, seconded by Peltier, to have Planning Commission
members Peltier and Kellison work with the City Administrator to review
the proposals made and develop a common request for proposals to aid in
comparisons.
