PRESENT: Agness, Schumann, Rubenzer, Kellison, Malaski, Peltier, Carole LaBelle Motion made by Kellison, seconded by Rubenzer to approve the minutes of 5-25-94 as amended. All aye, motion passed. Sandy Malaski was sworn in as Planning Commissioner for a term to expire 12-31-96. SPECIAL USE PERMIT REQUEST - BYRON ANDERSON Byron Anderson, 15624 Jeffrey Ave., has applied for a Special Use Permit to land treat petroleum contaminated soil on his property. The property is zoned agriculture. Approximately 300 cubic yards would be transported from Lindbeck Auto in White Bear Lake and spread over 3/4 of an acre. Steve Anderson stated that there is approximately 15 gallons of petroleum in the sand to be land treated. James Joslyn, an environmentalist from the MPCA stated that there will be virtually no silting from the spread into nearby ponds. The area is surrounded by grass that would aid in filtering any runoff, which is expected to be none. The oxygen is the agent which helps to eliminate the contaminant, combined with the organisms in the clean soil. The contaminated soil will be disked within 48 hours of being spread. The soil is then disked again in the fall. It has been determined that this is the safest and most efficient way of handling contaminated soil. Motion made by Kellison, seconded by Rubenzer, to recommend approval of the Special Use Permit request of Byron Anderson to land spread approximately 300 cubic yards of petroleum contaminated soil on 3/4 of an acre on his property at 15624 Jeffrey Ave. All aye, motion passed. SUBDIVISION REQUEST - D.T. PROPERIJES Richard Tschida, of D.T. Properties has requested to subdivide 8.9 acres into three lots. The property is zoned Retail Business and is located at the northeast intersection of 170th St. and Highway 61. Soil borings and perc tests have been received on all three parcels and require mound systems. Mr. Tschida did not attend the meeting. Members felt there were too many questions regarding access to the property, high water table, types of businesses proposed, and type of construction proposed to make a recommendation on this request. Motion made by Rubenzer, seconded Schumann to table the request of D.T. Properties until July 27, 1994 and the applicant can be present to address the questions stated above. All aye, motion passed. Atkinson has applied for a Special Use Permit to construct a gas station, automatic car wash, and convenience store at 14029 Forest Blvd. This property is at the northeast corner of 140th St. and Highway 61. The property is zoned Retail Business and is .63 acres in size. Mr. Atkinson is also requesting a variance from the 30' setback on the rear lot line to 12'. The buildings currently on the site would be removed. Mr. Wayne Anderson stated that the applicants are working with Washington County, RCWD, MNDOT, and the DNR regarding access to the site from Count-,....- Rd. ountyRd. 8A, Highway 61. Acquisition of 25' on the southwest corner of the property and the drainage in the area are also under discussion. Steve Just, the resident on the east did not object to the project but did request some type of fencing. Mike Atkinson assured Mr. Just they would agree on what type of screening will be erected. Commissioners were concerned with the landscaping for the site and the 90 degree turn required to access the pumps. All members concurred this was an excellent use for the property but were not comfortable with the site plan on file as it would undoubtedly be revised. Motion made by Agness, seconded by Schumann to recommend approval of the Special Use Permit for Michael Atkinson, 14029 Forest Blvd. to construct a gas station, car wash and convenience store, with a Variance of 18' to the rear setback subject to the following conditions. 1. Acquisition of 25' of right of way from MNDOT. / ~° 2. City engineer verify that there is an adequate water supply -L h`6 site. 3. City engineer review the ponding and water retention for the site as required by RCWD and the DNR. 4. Appropriate driveway permits be obtained from Washington County and the State. All aye, motion passed. Motion made by Peltier, seconded by Malaski to table the Site Plan request of Michael Atkinson, 14029 Forest Blvd. until July 27th or a new site plan has been developed. All aye, motion passed. Motion made by Peltier, seconded by Schumann to appoint Tim Agness as Vice Chairman. All aye, motion passed. Motion made by Schumann, seconded by Rubenzer to request the city obtain county plat books for the Planning Commission and City Council members. All aye, motion passed.
