HomeMy WebLinkAbout1994.07.27 PC Minutes-0 , The regular meeting of the Hugo Planning Commission was called to order by Chairman Peltier at 7:00PM. PRESENT: Agness, Schumann, Rubenzer, Malaski, Kellison, Peltier Motion made by Rubenzer, seconded by Malaski to approve the minutes of June 22, 1994 as amended. All aye, motion passed. Richard Tschida of D.T. Properties has requested to subdivide 8.89 acres into three lots at the northeast intersection of Highway 61 and 170th St. The area is zoned Retail Business. The City has not received confirmation from Washington County regarding the adequacy of sites for on site sewage treatment systems. The City also, has not received driveway permits from Washington County for access to County Road 4 or MNDOT for access to Trunk Highway 61. If this subdivision is approved the City will also require legal descriptions for each of the three parcels created. Mr. Dick Tschida stated that he has not filed applications with RCWD or the DNR. He stated that approximately 18" of fill would be required for building pads on the sites. A report from Dale Eklin indicated that seasonal water level is 10" to 12" below grade. Mr. Tschida indicated he will work with the City regarding location of driveway permits and that if a holding pond is required he would comply. White Bear Furniture has expressed interest in a site of his proposed size. Motion made by Schumann, seconded by Kellison to recommend approval of the request of Dick Tschida to subdivide 8.89 acres, zoned retail business, into three lots of approximately 3 acres each subject to the following special conditions. 1. Driveway access be obtained from by city staff. 2. RCWD and DNR permits be obtained All aye, motion passed. the county and/or MNDOT and approved if required prior to approval. A public hearing was held to consider the application of Mr. William Schifsky to subdivide approximately 2.1 acres from his industrial zoned property, located at 5885 165th St. North. The proposed parcel is to be transferred to Garland & Kevin Vacinek, 5855 165th St., as expansion space for their concrete yard ornament manufacturing business. The City requires a legal description for the 2.1 acres to be subdivided from Mr. Schifsky's property, a legal description combining the subdivided property with the Vacinek property and confirmation of the public easements by the Rice Creek Watershed District. Kevin and Garland Vacinek stated they would combine the 2.1 acre parcel with their existing property. ~ P.C. Minutes - July 27, 1994 Page 2 Motion made by Kellison, seconded by Rubenzer to recommend approval of the request of William Schifsky to subdivide 2.1 acres to be combine with property owned by Kevin and Garland Vacinek, legal description on file in the city clerk's office. All aye, motion passed A public hearing was held to consider the application of William and Kathleen Wenzel, 5623 142nd St., for a special use permit to construct an accessory building of 640 sq. ft. where 260 sq. ft. is allowed in the SFU district as well as, a variance to construct the building 5' from their west property line. Mr. Wenzel stated that his existing garage is very small and he needed the proposed accessory building for storage and his woodworking hobby shop. Mr. stated that the workshop is for personal use only. Motion made by Rubenzer, seconded by Kellison to recommend approval of the request of William Wenzel, 5623 142nd St. to construct a 640 sq. ft. accessory storage building on his property, but recommend denial of the 5' ft. variance to the side property line. All aye, motion passed. A public hearing was held to consider the request of Richard J. Granger for a Special Use Permit to construct a fast food restaurant at the southwest corner of 147th St. and Trunk Highway 61, west of the abandoned railroad tracks. The property is zoned concentrated business. Area residents opposed the construction, but realize the property is zoned for commercial use. Lighting, noise in the parking lot, and hours of operation were the biggest concerns. Motion made by Schumann, seconded by Agness to recommend approval of the request of Richard Granger to construct a fast food restaurant at 147th and Highway 61 as indicated on the site plan dated July 27, 1994, subject to the following special conditions. 1. A drainage plan be prepared by Mr. Granger and approved by the City engineer and if necessary, the Rice Creek Watershed District. 2. All parking and driveways on the lot be paved. 3. A landscaping plan be developed and approved for the site. 4. All walkways on site be separated from parking and drive areas by a concrete curb no less than 6" in height. 5. Buffering of the development from adjacent residential property owners be approved as part of the landscaping plan and shall include a 6' to 7' high fence between the development and adjacent residences. 6. All lighting on site shall be directed inward and no light source shall be directly visible from any public road or adjacent residential property. P.C. Minutes - July 27, 1994 Page 3 7. Any signs for the development shall be permitted in accordance with Chapter 266 of the City code. S. Hours of operation be limited to 9:00AM to 11:00PM, Sunday through Thursday and 9:00AM to Midnight, Friday and Saturday. 9. Fence on west property line be adequate to obstruct lighting and view. 10. All construction be contained on property, specifically parking surface. All aye, motion passed. After reviewing additional information provided to the City from Northwest Associated Consultants and Loucks and Associates the following recommendation was made. Motion made by Agness, seconded by Schumann to recommend to the City Council to hire Loucks and Associates to assist the City in revision of it's comprehensive plan. All aye, motion passed.
