The regular meeting of the Hugo Planning Commission was called to order by
Chairperson Mezzano at 7:03 p.m.
PRESENT: Mezzano, Agness, Davis, Rubenzer, Olson, Administrator Museus,
Bonnie Weber
ABSENT: Peltier, Oswald
Motion made by Olson, seconded by Rubenzer to approve the minutes of
December 18, 1992.
All aye, motion passed.
Josepm and Pam Monno have applied for a special use permit to keep horses
on their property at 5773 Egg Lake Road which is zoned RR1. Chapter
320-4, subd E (3), relating to property zone RR1 states "the keeping of
non-domestic animals, other than hogs or goats, shall be permitted special
uses on lots of 5 acres or more, within the following limitations: one
horse, cow or sheep permitted on 5 acres and one additional animal for
each acre over five." The property in question is 5.3 acres in size, this
allows the keeping of one horse as a special use under the City's zoning
ordinance. The Monno's request to maintain two horses on the site is
based on evidence that more than one horse has been maintained on this
property prior to and continuously since February 6, 1975, the date of
adoption of the City's zoning ordinance, and therefore they are eligible
for the "grandfathering" provisions of state law.
Chairman Mezzano opened the public hearing.
Mr. Monno stated that two horses had been at the property since 1970 and
until he received a letter dated September 30, 1992 from the City of Hugo
he as not aware that he was in violation of the City ordinance. He was
wondering if the "grandfathering" provision would apply.
Discussion followed on the "grandfathering" provision as to what it means
and how it works. Administrator Museus explained that "grandfathering"
was quite common and has been used in the past. "Grandfathering",
however, is only an argument for a special use permit and not an action in
and of itself.
Agness asked if such a variance as requested could have a time limit on it
with and end date.
After
a brief
discussion, Olson made motion,
seconded by Davis to
recommend
approval
of the variance request
of Joseph Monno to have two
horses
at the
property as long as Joseph Monno
owns the property. The
reason
given
for this recommendation being
the fact that two horses have
already
been
at the property since 1970.
All aye, motion passed.
Administrator Museus stated the need to set up Comprehensive Plan study
committees. He went over the outline he had prepared highlighting the
eight ares of study as brought forth from the people in attendance at the
Comprehensive Plan meeting on January 14, 1993. His questions were 1.
How does the Planning Commission want to set up committees? and 2. How do
we get people on these committees?
Mezzano suggested polling the names on the sign-up list from that January
14 meeting. Davis suggested that there be 6-8 members on each
committee. Methods of contacting these people were suggested. It was
agreed by all that timing is important. Discussion followed as to getting
more people involved. Perhaps Council members could call people they know
personally. A general mailing was also suggested to make residence more
aware of the issues. Everyone agreed to get as many people involved as
possible.
All agreed to contact the people on the list immediately by calling them
and asking them two specific questions:
1. Would they be willing to serve on a Comprehensive Plan Study
Committee?
2. What are their specific areas of interest?
Administrator Museus suggested various ways to assist the study
committees. He emphasized moving quickly on this. The process has
already been outlined what is needed now is people. Museus suggested
putting chairpeople in place first and then fill in committee members from
the list. The object is to train them through a workshop. The
chairpeople should be qualified to "chair" and have some knowledge of
running a committee efficiently.
The Planning Commission made the recommendation to meet with the City
Council on February 1, 1993 to appoint chairpeople to the Comprehensive
Plan committees.
Administrator Museus will have available by Monday, February 1, 1993 a
layout of what a newsletter would cost as a mailing to the residence of
Hugo.

1. Meet with the City Council (to be put on the agenda for
February 1, 1993.
2. Poll the people on the list from the Jan. 14 meetinq.
3. To get a rough flyer with costs outlined by Monday.
4. To set goals for time limits for each study committee.
Motion was made by Davis to have the Planning Commission meet with the
City Council at their meeting on Monday, February 1, 1993 and seconded by
Agness.
All aye, motion passed.
Motion made by Rubenzer, seconded by Davis to adjourn at 8:09.
