PRESENT: Davis, Agness, Schumann, Rubenzer, Olson, Peltier City Administrator, Bob Museus Recording Secretary, Mary Ann Creager ABSENT: Bob Oswald Davis made motion, Schumann seconded, to approve the minutes for the Planning Commission meeting of October 13, 1993, as submitted. VOTING AYE: Davis, Schumann, Olson, Peltier ABSTAINED: Agness and Rubenzer Motion Carried. APPOINTMENT OF VICE CHAIRPERSON Peltier made motion, Rubenzer seconded, to appoint Dan Davis to serve as Vice Chairperson for the Hugo Planning Commission All aye. Motion Carried. BURNING A public hearing was held to consider an amendment to City Ordinances 110-16 through 110-31 to bring the City Code into conformance with State Statute. Effective August 1, 1993, the State of Minnesota granted the Minnesota Department of Natural Resources, Division of Forestry, sole authority to regulate open burning in Minnesota. The revised ordinance adopts the pertinent state statute, as well as imposes additional restrictions to match those in existence in City ordinance at this time. Specifically, the ordinance prohibits burning of dried vegetative material in barrels, and requires permits during all seasons, where State Statutes does not require permits on snow-covered ground. The public hearing was opened, and Dennis Schreifels inquired about the existing language for burning regulations in effect as of this time. He suggested that regulations for burning be addressed in the next City Newsletter, and that a handout be available at the time of application for a burning permit. There was no further public comment, oral or written, and the Planning Commission then discussed, at length, regulation for barrel burning, and burning during the time of winter conditions. Davis made motion, Agness seconded, to recommend adoption of the proposed ordinance as submitted. VOTING AYE: Davis, Agness, Schumann, Rubenzer, Olson VOTING NAY: Peltier Motion Carried. Rubenzer made motion, Schumann seconded, recommending that the Fire Chief supply burning permit applicants with pamphlets outlining rules and regulations for open burning. Planning Commission meeting of October 27, 1993 Page 2 A public hearing was held to consider an amendment to City ordinance 290-13, Subd. B, regarding park land dedication during the subdivision of property. The amended ordinance raises the park land dedication fee from $175.00 to $500.00 per lot. The public hearing was opened, and reference was made to a letter received from Dan Dolan regarding his development of the Jeff Barbour property. Because of certain delays, he requested that the $175.00 fee be applied to his subdivision. It was agreed that if he could not get preliminary plan approval prior to the publication of the final ordinance, that the new fee would apply. Warren Arcand stated that he felt the increase was too large of an increase at one time. There were no other comments, oral or written, and the Commissioner Agness stated that he would like to see language in the ordinance excluding wetlands from land to be dedicated as park land. Agness made motion, Davis seconded, to recommend adoption of the proposed ordinance regarding park land dedication fees, and that language be added that would eliminate wetlands from land to be dedicated as park land. VOTING AYE: Davis, Agness, Schumann, Rubenzer, Olson VOTING NAY: Peltier Motion Carried. A public hearing was held to consider an amendment to the City's Comprehensive Plan committing the City to adopting certain surface water quality control measures, as required by Minnesota Statutes, 103B.231. This amendment is required by the Metropolitan Council prior to their considering any revision of the City's MUSA or amendments to the City's Comprehensive Plan. The standards stated are specifically required by Statute or the Metro Council. There were no oral or written comments regarding this matter. Schumann made motion, Agness seconded, to recommend adoption of the proposed resolution committing the City to adopt certain surface water quality control measures. All aye. Motion Carried. Peltier made motion, Davis seconded, that a letter be sent to Commissioner Oswald regarding his interest on serving on the Hugo Planning Commission. All aye. Motion Carried.
