February 26, 1992
The regular meeting was called to order by Chairperson Peltier at 7:00P11.
PRESENT: David, Rubenzer, Oswald, Olson, Peltier
ABSENT: Mezzano
Motion made by Davis, seconded by Olson to approve the minutes of January
22, 1992 as amended.

MUSA AMENDMENT -- MERILA & ASSOCIATES
Commissioner Rubenzer reviewed this application with the Planning
Commission. Mr. Rubenzer stated that the public hearing will be held this
evening to secure input on a proposal by Marty Wegleitner and Kenco
Construction to expand the City's Municipal Urban Service Area to
accommodate the Rice Lake Meadows Planned Unit Development Proposal. The
City has approved the Planned Unit Development concept for Rice Lake
Meadows, however there is a portion of the proposal in question that is
outside of the City's Municipal Urban Service Area. If recommended by the �
Planning Commission, application would be submitted to the Metropolitan
Council for their review and approval. It is the intent to realign the
MUSA line in the areas lying between Geneva Ave. No. and Goodview Ave. No.
from a line 660 ft. south of the center line of 145th St. to a line 1,000
ft. north of the centerline of 145th St. This realignment of the MUSA
line coincides more closely with the location of the Rice Lake Meadows
Planned Unit Development. The MUSA will be increased by approximately
17.5 acres consisting of 15.3 acres of upland and 2.2 acres of type 2
wetlands. None of the wetland areas are being developed, while only 8.4
acres of the upland areas are proposed to be developed into 28 lots under
a 120 unit Planned Unit Development for the 60.3 acre PUD. The enclosed |

current plan map" identifies the current MUSA line, while the "proposed '
plan map" reflects the proposed MUSA line. The staff feels that the
request in question involves a rather small parcel of land and the
addition of this area to the MUSA will result in only minimal changes in
Metropolitan Service demand. |
Mr. Ken Weber, with theKuusisto Engineering firm was present to review
this request in more detail with the Planning Commission. Mr. Weber
stated that this change in the MUSA is a net increase of 5.1 acres.
Area residents were concerned that this addition would delete another area
which might be suitable for development. Marvin LaValle questioned what
effect this would have on those residents who have already paid a SAC
charge and whether there will be adequate service when and if these
residents are ready for utility hook-up. Mr. Weber stated that the City
is billed on metered volume and the City is far from reaching its allotted
capacity. Mr. Weber informed the Commission that the amendment monitors
the growth of the area and the revision in boundaries is more logical than
current boundaries. |
Motion made by Rubenzer, seconded by Olson to recommend approval of the
MUSA Amendment for Rice Lake Meadows Planned Unit Development as per
Information Submission for Minor Comprehensive Plan Amendments, Figure 3.

The Planning Commission reviewed the request of Mr. Robert Bramstedt and
Tom Connolly, for a Minor Subdivision and waiver of formal platting
requirements to subdivide a 7.055 acre tract of land identified as 17385
North Forest Blvd., Hugo, Minnesota. The property in question is located
east of Highway 61 and approximately 508 ft. south of 175th St. It is
the applicants intent to subdivide the industrially zoned parcel in
question into three tracts of land for development purposes. Currently
there is a building located on Parcel B of the proposed certificate of
survey. The property was rezoned from Retail Business to Industrial in
1991 by the City. In reviewing this survey it appears that the lots meet
all dimensional requirements for industrial zones. If the Planning
Commission feels this request is consistent with the City's Comprehensive
Plan and development in the surrounding area, we would recommend that
Planning Commission action be subject to special conditions.
Ms. Lori Flanagan was present and expressed her concern that additional
structures on the described property (Parcel C) would create additional
flooding on her property. Mr. Bramstedt stated that the drainage system
identified on the site plan has been approved by Rice Creek Watershed
District and the City of Hugo and was inspected but he did not specify by
whom. Mr. Bramstedt felt that any development on Parcel C would be done
on the western portion of the lot and would not create more surface water
on the Flanagan's property which is east of said parcel. Mr. Bramstedt
added he did not object to any of the proposed special conditions. Ms.
Flanagan does not oppose the subdivision but would like some assurance
that further development will not flood her property.
Davis made motion, seconded by Rubenzer to recommend approval of the
request of Bob Bramstedt and Tom Connolly to subdivide 7.055 acres
(93005-2333) into three lots, two of 2+ acres and one of 3+ acres, zoned
industrial, subject to the following special conditions:
1. The survey must be submitted to the city council within 90 days of
preliminary survey acceptance or planning commission approval shall be
null and void.
2. Survey approval shall be contingent upon compliance with the survey
conditions, as well as, the grading, stormwater drainage, and utility
plans.
3. All conditions of survey approval must be met prior to the stamping of
any deeds for recording by the city clerk unless otherwise permitted
by council action.
4. The property lines on site must be identified by the applicants to
assure proper setbacks when buildings are to be constructed if
required by the building inspector. All lots must be properly staked
5. Proposed driveways or drainage areas within the development must
include installation of a minimum 15" diameter corrugated metal
culvert in a manner acceptable to the city.
6. No building permits shall be issued until the survey has been approved
and recorded with Washington County.
7. The securing of the required permits from the watershed district,
prior to final survey approval.
8. All fees relating to this subdivision shall be paid by the applicant
including the cost of recording documents with Washington County. i

9. Any driveway permits requiring access to highways or county roads may |

not be issued until the necessary permits are secured from Washington |
County or the Minnesota Dept. of Transportation. |
10. Percolation tests for each buildable site must be submitted to the
city prior to final survey approval.
11. Dedication of required parkland or payment of fee in lieu of parkland
dedication shall be paid to the city at the time of final survey |
approval. |
12. The lowest floor elevation of any structure in this subdivision shall |

be two ft. above the 100 year flood elevation or 4 feet above the �
highest groundwater level, whichever is greater. �
13. No improvements, landscaping, or grading shall be permitted in the �
�
identified drainage areas without the express written authorization of �
the City and the appropriate watershed districts. �

14. All property owners shall be responsible for maintenance of drainage
�
areas within easements on their property. �
15. No significant deviations from the approved preliminary survey shall
be permitted unless reviewed by the Planning Commission prior to
council approval. �
16. Any exterior lighting or advertising activities on site must be �
�
approved by the City.
�
17. The developer shall permit access to the referenced site for periodic �
inspections to assure conformance with the special conditions. �

18. Prior to construction of buildings, the drainage system shall be �
inspected to assure construction as per subdivision site plan dated �
January 30, 1992. �

Motion made by Rubenzer, seconded by Peltier to place the issue of pole
barn construction and usage on the March 25, 1992 agenda for discussion
and to set a public hearing.
