May 27, 1992
Chairman Peltier called the meeting to order at 7:00PM.
PRESENT: Mezzano, Davis, Agness, Rubenzer, Oswald, Olson, Peltier
Attorney Charles Johnson, Administrator Museus, Carole LaBelle
Motion made by Mezzano, seconded by Olson to approve the minutes of April
22, 1992 as amended.
All aye, motion passed.
Mr. Tim Agness was sworn in as Planning Commissioner to serve the balance
of the term vacated by Chuck Henry.
Ronald & Pauline Daubenspeck have requested to subdivide 5.6 acres zoned
Single Family Unit (10,400 sq. ft. minimum) into 4 residential lots. Ms.
Daubenspeck stated they intend to construct a home on proposed lot 1.
Washington County has indicated that driveways to the proposed lots might
be better served by individual driveways with a turn around on site,
rather than a common driveway. Mr. Joe Monno, property owner to the east
is concerned that the small ponding area on the property line between lot
4 and his lot would be enlarged by the additional runoff. Mr. Monno would
like some assurance that this potential problem could be addressed before
building permits are obtained.
Motion made by Rubenzer, seconded by Mezzano to recommend approval of the
request of Ronald and Pauline Daubenspeck to subdivide 5.6 acres into 4
residential lots, subject to the following special conditions and legally
described as; That part of the North half of the Northwest quarter of-
Section
fSection 29, T31N, R21W, Washington County, Minnesota described as
follows: Commencing at the north 1/4 corner of Section 29; thence south,
along the east line of said N1/2-NW1/4, a distance of 825 feet; thence
west, a distance of 362.5 feet to the center of a drainage ditch; thence
north 26 degrees 14 minutes west, along said drainage ditch, a distance of
150 feet to the point of beginning; thence north 40 degrees 59 minutes
west, and continuing along said drainage ditch, a distance of 908 feet,
more or less, to a point on the north line of Section 29, distant 1020.3
feet west of the north 1/4 corner of Section 29, thence east, along said
north line, a distance of 471.7 feet to a point on said north line distant
548.6 feet west of the north quarter corner of Section 29, which point is
the point of beginning of a roadway easement as described in easement deed
dated October 20, 1941, recorded October 21, 1941 in Book 136 of Deeds,
page 607, in the office of the Register of Deeds, Washington County,
Minnesota; thence southeasterly, along said road center line, a distance
of 266 feet, more or less, to the point of intersection with a line that
bears north 11 degrees 31 minutes east from the point of beginning; thence
south 11 degrees 31 minutes west, along said line, a distance of 595 feet,
more or less, to the point of beginning; containing 5.6 acres, more or
less, and subject to County Rd. No. 8A along the northerly line, also
subject to the existing drainage. ditch along the southwesterly line
thereof.

1. Final grade on Lot 4 must divert drainage to the south and avoid
runoff onto the adjacent property to the east.
2. Lot 2 may not be sold until a building permit is issued for Lot 1 to
avoid a violation of the City's zoning ordinance which prohibits
construction of an accessory building prior to construction of the
principal building on any lot.

Mr. Dan Parker, representative of School District 834 stated they would
like amend their special use permit to replace the exiting 24' X 40'
moveable classroom with a 28' X 72' moveable classroom located at Withrow
Elementary School (10158 No. 122nd St.). The district plans to find a
more permanent solution to the problem by 1995.
Motion made by Oswald, seconded by Olson to recommend approval of the
amended special use permit request of the Stillwater School District to
replace their existing moveable classroom as specified above.
All aye, motion passed.
Mr. Jim Christiansen and T. Martin Stadler were present to provide
background information and proposed site location for a new post office
facility in Hugo. The site described is located north of Co. Rd. 81
approximately one mile west of Highway 61 (Parcel No. 93019-2200). The
purpose of the new facility is to meet state requirements for handicapped
accessibility, provide employee/customer parking, and meet the growing
needs for the Hugo/Centerville area served by this post office.
Commissioners agreed this would be an acceptable site location and
suggested the postal service submit their application for rezoning of the
property.
ASPHALT j,BgYIgI'I
The City Council has referred the Amended Special Use Permit request of
River Valley Asphalt back to the Planning Commission to provide their
findings of fact for denial of this request. Concerned residents and
representatives of River City Asphalt were given an opportunity to express
their concerns. RCA acknowledged they agreed to an extension of time for
City Council to act on this request at the March City Council meeting.
The Planning Commission reviewed the reasons for their recommendation and
have requested Administrator Museus summarize their findings of fact,
conclusions, and recommendation in draft form to be reviewed by the
Planning Commission at a Special Meeting on June 10, 1992, 7:.00PM.
Motion made by Davis, seconded by Peltier to adjourn at 9:50PM.
