August 26, 1992
The regular meeting was called to order by Chairperson Peltier at 7:00PM.
PRESENT: Mezzano, Davis, Agness, Rubenzer, Olson, Peltier
ABSENT: Oswald
Motion made by Davis, seconded by Agness to approve the minutes of July
22, 1992 as amended.
All aye, motion passed.
Leo Muellner and Cal Stemig have applied to the City to rezone a portion
of the 26.2 acres from conservancy to agriculture. The Conservancy
portion of the property is located on the west side of Inwood Ave. The
property is divided by an NSP line running diagonally from the southwest
to the northeast. Mr. Stemig would ultimately like to subdivide the
approximately 17 acres on the west of Inwood Ave, creating a 10 acre
parcel and a 17 acre parcel. Molly Shodeen, of the DNR has notified the
City that they have no objection to the rezoning.
Mr. Stemig stated that he would like to rezone primarily for financing
purposes. Mr. Stemig stated he would like to subdivide the 10 acres east
of Inwood which is his homestead and leave the 17 acres on the west,
currently zoned conservancy as one.
Motion made by Rubenzer, seconded by Davis to recommend approval of the
request of Cal Stemig and Leo Muellner to rezone their property zoned
Conservancy to Agriculture. Legal description as follows:
The west 1/2 of the northwest 1/4 of the northwest 1/4, Section 2, T31N,
R21W, Washington County, except; A strip of land 50 feet wide running
over and across the northwest 1/4 of the northwest 1/4 of Section 2, T31N,
R21W, said strip being 25 feet wide on each side of a center line
commencing at a stake on the north line of Said Section 1057.5 feet east
of the northwest corner thereof; thence south 43 degrees 41 minutes west
233.7 feet; thence on a one degree curve to the right from said course as
a tangent, a distance of 395'; thence south 47 degrees 38 minutes west
824.8 feet to a stake on the west line of said section, 990 feet south of
the northwest corner thereof and there ending.

PURRIMINION
Keith and Barb Peterson, 6520 132nd St., Hugo have applied to the City for
the subdivision and variance to lot size of a 39.8 acre parcel, zoned
agriculture into 3 lots. Two lots of slightly under 10 acres each, and
one 20 acre lot. The property is adjacent to 132nd St., to the north.
Perc tests have been conducted on all potential lots and have passed. No
permits or correspondence have been received from the DNR or Rice Creek
Watershed District.
No one from the public was present to comment on this request.

Commissioner Mezzano felt the two smaller lots should meet the zoning size
requirement of 10 acres because there is land available. After a brief
discussion by the Planning Commission the following recommendation was
acted on.
Motion made by Peltier, seconded by Agness to recommend approval of the
request of Keith Peterson to subdivide 39.8 acres into two lots of 9.95
acres and one 20 acre lot, property described as follows: The northeast
1/4 of the southwest 1/4 of Section 28, T31N, R21W. Subject to approval
by Rice Creek Watershed District and the Department of Natural Resources.

SUBDIVISION Q. -Q
Rose of Sharon Manor, Inc. has submitted an application to subdivide two
existing parcels into four parcels. Parcel B of the surveyor's
certificate for the subdivision is exempted from the City's subdivision
regulations per Minnesota Statutes 462.358, subdivision 4.b. All of the
proposed parcels created by the subdivision exceed the ten acres required
in an agriculturally zoned district by the City's zoning ordinance.
Parcel E, requires a variance to the zoning ordinance, due to the fact
that it is 6.5 feet short in lot frontage width. All four parcels have
been tested and found suitable for on site septic systems by the
Washington County Public Health Department. This subdivision has been
reviewed by the Rice Creek Watershed District and the DNR who have no
objections to the subdivision as proposed.
Mr. Fred Fisher, attorney for Rose of Sharon Manor, Inc. was present to
answer any questions from the Commission.
Motion made by Olson, seconded by Mezzano to recommend approval of the
request of Rose of Sharon Manor, Inc for a minor subdivision, variance to
lot width frontage and waiver of the formal platting requirements to
subdivide 79 acres from two parcels into four parcels. Legally described
as follows:
Parcel A: That part of the southeast 1/4 of the northeast 1/4 of Section
28, T31N, R21W, Washington County, Minnesota lying west of the east 43
rods (709.50 feet) thereof, and
Parcel D: The east 43 rods (709.50 ft) of the east 1/4 of the southeast
1/4 of Section 28, T31, R21, Washington County, Minnesota lying north of
the centerline of the Stillwater and Centerville Rd, now known as 132nd
Street No., except that part thereof described as follows: Commencing at
a point on said centerline distant 400.00 feet west of the east line of
said southeast 1/4, as measured along said centerline; thence northerly
and parallel with said east line 450.00 feet; thence westerly parallel
with said centerline 485.00 feet; thence southerly parallel with said east
line 450 feet, more or less, to said centerline; thence easterly along
said centerline to the point of beginning, and

Parcel E: That part of the east 1/2 of the southeast 1/4 of Section 28,
T31, R21, Washington County, Minnesota lying west of the east 43 rods

Ms. Ellen St. Sauver has applied to the City to subdivide 79 acres into
two ten acre parcels and one 59 acre parcel. All three parcels exceed the
ten acre requirement of the City of Hugo's subdivision regulations for an
agricultural district. The Rice Creek Watershed District has approved the
subdivision with the condition that certain ponding and flowage easements
be established for the wetlands on the 79 acre parcel. No comment has
been received from the DNR, though the DNR protected wetlands recorded on
this property is subject to a ponding and flowage easement established by
the watershed management district. Parcel B is the location of an
existing homestead. The City is in receipt of an improved septic system
plan for parcel C (10 ac.). No percolation test has been received for
parcel C (59 acres).
Motion made by Mezzano, seconded by Olson to recommend approval of the
request of Ellen St. Sauver to subdivide 79 acres into two 10 acre
parcels, and one 59 acre parcel. Legally described as follows:
The North half of the northwest 1/4, Section 13, T31N, R21W, Washington
County, Minnesota. Subject to Jeffrey Ave. North along the west line.
Subject to the existing Northern States Power Company easements. Subject
to and together with any other valid easements, restrictions and
reservations.
All aye, motion passed.
Mr. Lloyd Duraine had requested an opportunity to visit with the
commission regarding a possible rezoning and subdivision. Mr. Duraine was
not in attendance.
Chairperson Peltier moved to table this discussion until September 23,
1992, seconded by Davis.
All aye, motion passed.
Motion made by Agness, seconded by Peltier to recommend to the City
Council to approve an ordinance amending Chapter 320 (zoning) of the City
of Hugo's municipal code allowing private garages up to 1,000 sq. ft. as
detailed in the ordinance.

City Administrator Museus will organize a work session with the Planning
Commission, City Council and a representative from the Metro Council to
discuss additional changes to the City's comprehensive plan on September
15th or 16th. Notices will be sent out when a final date is selected.
Motion made by Davis, seconded by Olson to adjourn at 8:25PM.
