October 14, 1992
The special meeting was called to order by Chairman Peltier at 7:00PM.
PRESENT: Davis, Rubenzer, Oswald, Olson, Peltier, Administrator Museus,
Attorney Jeff Carson, Carole LaBelle
ABSENT: Mezzano, Agness
Chairman Peltier opened the public hearing. David Schumann stated that
there have been a number of inspections by various governmental agencies,
all of which Mr. Schumann says were approved. George Atkinson, Larry
Hanson, representative for Dr. Bob Kieffer, Ray Olson, John George, Cheryl
Dunn and other residents expressed their concern regarding the approval of
this request. The questions of property valuation, soil and water
contamination and other issues were raised.
After a lengthy discussion the Planning Commission made the following
recommendation.
Chairman Peltier made a motion to limit the number of vehicles in the junk
yard area to 150, seconded by Bob Oswald.
AYE: Rubenzer, Olson, Oswald, Peltier
NAY: Davis
Motion passed.
Motion made by Rubenzer, seconded by Dan Davis, to recommend the number of
vehicles waiting for repair be limited to 10.
All aye, motion passed.
Chairman Peltier made a motion to recommend approval of the Special Use
Permit request for David Schumann to conduct auto dismantling and an auto
body repair shop at his residence at 7630 137th St., Hugo subject to the
following special conditions:
1. Ti..,L ii.te legal description of the proper+y that is the subjecL of this
permit is commonly known as Parcels 3 and 4, Schumann Land Division;
that the specific descriptions of Parcels 3 and 4 are attached by
survey.
2. That Schumann's are granted permission to operate a junk/auto
reduction business on the aforementioned Parcels 3 and 4; that the
storane of all autos, junk, and debris for the business must be kept
and contained within the area delineated on the attached site plan,
which is made a part of this permit; and that the Schumann's must
insta]l and maintain corner markers visually delineating the storage
site.
3. That thc number of vehicles on the above-described property as part of
the junk and auto dismantling business must not exceed 150 units in
number.
4. That the attached site plan, having been approved, and providing for
screening of the junk/auto reduction business from the public, is made
a part of this permit; that at all times, the Schumann's must maintain
adequate screening, by vegetation, fence or birming, of the junk/auto
reduction yard so that no automobiles, junk or debris contained
therein are visible from a public road or adjacent property.

5. That Schumann's existing auto body/auto repair business is recognized
as part of this Permit as a valid nonconforming use; that this
business must be maintained in its present building structure and
cannot expand; that vehicles waiting for repair are limited to 10 in
number, and that the parking area for autos awaiting repair must be
screened from public view.
6. That all junk vehicles on Parcels 3 and 4, regardless of ownership,
must be maintained in the holding area specified in paragraph 2
above. Nothing in this permit restricts beyond normal regulations, as
applied to other residential property, the use and storage of the
personal automobiles of the owners of parcels 3 and 4, so long as they
are registered and licensed by the owners or residents of Parcels 3
and 4.
7. That Schumann must obtain an annual license to operate his junk/auto
reduction yard from the City of Hugo; that the City shall inspect
Schumann's property annually for Permit compliance prior to issuance.
S. That in addition to the annual license inspection by the City, the
City may inspect the Schumann property for compliance under this
Special Use Permit at reasonable times, following reasonable notice to
Schumann.
9. That, in addition to compliance under this Special Use Permit, and
under the ordinances of the City of Hugo, Schumann is required to keep
in force and effect all necessary and applicable permits and/or
licenses from the Washington County Department of Health, the
Minnesota Pollution Control Agency, and any other department and/or
agency having jurisdiction over the operation of his business.

Motion made by Peltier, seconded by Davis to adjourn at 10:30PM.
