September 25, 1991
The regular meeting of the Hugo Planning Commission was called to order by
Chairman Peltier at 7:02PM.
PRESENT: Davis, Thoreson, Barnes, Peltier, Administrator Huber,
Carole LaBelle
ABSENT: Mezzano, Henry, Oswald
Motion made by Davis, seconded by Barnes to approve the minutes of August
28, 1991.
All aye, motion passed.
SPECIAL USE PERMIT REQUEST - D. DAVIS
Administrator Huber reviewed this request with the Planning Commission.
Mr. Huber stated that Dan and Gloria Davis of 8745 122nd St. No., have
made application to the City of Hugo for a Special Use Permit to construct
a 26' X 30' pole shed on their property described as Lot 1, Block 1, Round
Lake Addition' Currently there is a 30' X 48' (1440 sq. ft.) post frame
building on the site. Total square footage would be 2,220 sq. ft. of
accessory storage. City ordinances require a special use permit for
accessory storage exceeding 1,800 sq. ft. in an RR2 zoning district. In
his correspondence to the City Mr. Dan Davis has indicated that the
structure will be used for personal storage and a small hobby workshop.
He has assured the City that the shed will not be used for any business
purposes.
Mr. Davis addressed the Planning Commission to correct the dimension
listed on his SUP application. The proposed building was mistakenly
listed as 24' X 30', however, the dimension on the site plan indicated 26'
X 30' which is the size requested. Mr. Mike Ball, 8715 122nd St., was
present and stated he had no objections to the accessory building.
Motion made by Thoreson, seconded by Barnes to recommend approval of the
request of Dan and Gloria Davis, 8745 122nd St. for a special use permit
to construct a 26' X 30' accessory building and exceed the allowable limit
of 1800 sq. ft. by 420 sq. ft.
AYE: Thoreson, Barnes, Peltier
ABSTAIN: Davis

REZONING REQUEST - G. PAPENHEIM
Administrator Huber reviewed this request with the Planning Commission.
Mr. Huber stated that Mr. Gerald Papenheim of 2472 Taylor Ave., White Bear
Lake, Minnesota has made application to the City of Hugo for the rezoning
of a twenty acre tract of land from Conservancy to Agriculture. The
reason for Mr. Papenheims request is that he ultimately intends to
subdivide the property into two tracts of ten acres each for single family
residential development. Branch 3 of Clearwater Creek runs through the
property in question and visual inspection of the site indicates that it
is a large

swampy area which includes DNR Protected Wetlands 82-239W on maps provided
by the DNR. In discussions with various soils experts, they have
indicated that it is doubtful that perkable sites can be identified in
this area for the purposes of accommodating on site sewer systems.
Although this request would appear to be consistent with the City's
comprehensive plan, with regard to lot size in areas outside of the MUSA,
we would question whether soil conditions in this area make it suitable
for a residential development. The property in question is located within
Zone B of the flood plain (500 year flood frequency). The property in
question is located in the west 1/2 of the southeast 1/4 of the northwest
1/4, Section 8, T31N, R21W, Washington County, Minnesota.
Mr. Papenheim presented a 1990 letter from the DNR which indicated that
the wetland located on his property had been removed from the list of
protected wetlands. Mr. Papenheim stated that Mr. Dale Eklin had prepared
the soil borings and perc tests and these will be reviewed by Washington
County. Mr. Papenheim stated that he will be bringing in some fill and
there will be no basements. He informed the Commission that Mr. Roger
Nelson, Nelson Engineering, established the 100 year flood elevation of
916.8 ft. Rice Creek Watershed District is currently reviewing this
request.
Commissioners felt because of the poor drainage and the property
surrounding Clearwater Creek and a judicial ditch, further information
would need to be provided to make a decision regarding rezoning. The
Commission requested that the applicant provide the following:
1. Soil borings and percolation tests.
2. Rice Creek Watershed District recommendation or permit.
3. A topographic map with the location of the soil borings and proposed
building sites.
4' A current letter from the DNR reaffirming their 1990 position.
5. Report from Washington County regarding on site septic systems.
The applicant agreed to table this matter until the October 23, 1991
meeting of the Planning Commission.
Motion made by Barnes, seconded by Thoreson to table the request of Gerald
Papenheim until October 23, 1991.

REZONING REQUEST - M. HATHAWAY
City Administrator Ken Huber reviewed this request with the Planning
Commission. He stated that on behalf of Marjorie Hathaway, 790 Lower
Colonial Drive, Mendota, Minnesota, Mr. Ron Deslauries has made
application to the City of Hugo for the rezoning of a 21 acre tract of
land from Agriculture to Industrial. The property is located at the
southeast corner of 170th St. and Highway 61 (Tax parcel 3200). The
Planning Commission and City Council denied an earlier request to use this
property for an auto dismantling yard. In August of 1990, the Hugo
Planning Commission recommended approval of a Special Use Permit to erect
a single family residence and allow outdoor storage of boats, RV's,
pontoons, and trailers. This request was never brought before the City
Council for approval as the applicants apparently could not meet the
special conditions of permit approval. The rezoning request in question

does not conform with the City's current comprehensive plan for the area
and does not appear to conform with the proposed use of the property as
identified on the amended comprehensive plan map currently being worked on
by the Hugo Planning Commission.
Mr. Deslauries was present for the public hearing. He felt the background
memo reviewed his request adequately. Commissioner Barnes stated that
Highway 61 had been designated for Industrial property and informed the
property owner that any intense industrial use may require the extension
of sewer. Commissioner Thoreson felt the proposed zone change would be
compatible with current uses in the area.
Motion made by Barnes, seconded by Peltier to recommend approval of the
request of M. Hathaway/Ron Deslauries to rezone 21 acres from Agricultural
to Industrial, legally described as follows:
That part of the northeast 1/4 of Section 8, in T31N, R21W, Washington
County, Minnesota, described as follows: Beginning at the northeast
corner of Section 8; thence west, along the north line of Section 8, a
distance of 515 ft.; thence south, deflecting 90 degrees to the left, a
distance of 285 ft, thence west deflecting 90 degrees to the right, a
distance of 503 feet, more or less, to the easterly right-of-way line of
Trunk Highway No. 61; thence southwesterly, along said highway
right-of-way line, a distance of, a distance of 590 feet, more or less, to
a point distant 200 feet northeasterly, (as measured along the easterly
highway right-of-way line) of the south line of the north 1059.44 feet of
the northeast 1/4; thence east, parallel with the north line of the
northeast 1/4, a distance of 300 feet; thence southwesterly parallel with
the easterly highway right-of-way line, a distance of 200 feet to the
south line of the north 1059.44 feet of the northeast 1/4; thence east
along said parallel line, a distance of 900 feet, more or less, to the
east line of Section 8; thence northerly, along the east line of Section
8, a distance of 1060 feet, more or less, to the point of beginning,
containing 21.8 acre, more or less, and subject to the existing village
street along the north line. Including any right of title existing in the
adjacent Trunk Highway No. 61 to the westerly right-of-way line thereof.
All aye, motion passed.
Chairman Peltier has indicated that she will contact Mr. Henry to
determine whether he wishes to continue to serve on the Planning
Commission in light of the fact that he will be attending classes
throughout the winter.
The Planning Commission has requested that Mr. Ken Weber, from Kuusisto
Engineering attend the October 23, 1991 meeting to review the
recommendations of the Metropolitan Council regarding the updating of the
Comprehensive Plan.
Motion made by Davis, seconded by Thoreson to adjourn at 8:00PM.
