PRESENT: Mezzano, Davis, Olson, Peltier ABSENT: Henry, Thoreson, Oswald Motion made by Davis, seconded by Mezzano to approve the minutes of the October 23, 1991 as amended. All aye, motion passed. The oath of office was administered to Brian Olson who was appointed to the Planning Commission by the City Council to serve a four year term to expire December 31, 1995. He will also be serving at the November and December meetings of 1991. At the request of Mr. Gerald Papenheim of 2472 Taylor Ave., White Bear Lake, Minnesota, the Planning Commission has agreed to table this request until January 22, 1992. Commissioner Mezzano reviewed this request with the Planning Commission. Mr. Mezzano stated that Arnie and Elvira Gruett of 12433 Ingersoll Ave. No., have made application to the City of Hugo for a minor subdivision and waiver of the formal platting requirements. The property in question is described as, that part of Gov't Lot 3, Section 5, T31N, R21W, Washington County, Minnesota, lying northerly of the center line of County State Aid Highway No. 7. The property consists of 12.89 acres and is currently zoned RR2. It is Mr. Gruett's intent to subdivide the parcel into two lots, one consisting of approximately 7.89 acres and one of 5 acres. The required permit from Rice Creek Watershed District has been secured and a copy was provided. The soil tests submitted have been reviewed by the Washington County Public Health Dept. and they have indicated that the site is suitable for the installation of an individual sewage treatment system, pursuant to city code. If the planning commission feels that this request is consistent with the comprehensive plan and other development in the area adjacent to the property in question, we would recommend subdivision approval subject to special conditions. Mr. Gruett was present and stated that the driveway would be located on Irish Ave. After a brief discussion the Planning Commission concurred that this request was consistent with the comprehensive plan and the surrounding area. Motion made by Mezzano, seconded by Davis to recommend approval of the request of Arnie and Elvira Gruett to subdivide 12.89 acres (93035-0405 & 0500) into two parcels as described above and waive the formal platting requirements subject to the following special conditions. P.C. Minutes - November 26, 1991 Page 2 1. Survey must be submitted to the Council within 90 days of preliminary survey acceptance or Planning Commission approval shall be null and void. 2. Survey approval shall be contingent on compliance with the survey conditions, as well as a grading, stormwater drainage, and a survey submitted. 3. All conditions of survey approval must be met prior to the stamping of any deeds for recording by the`city clerk unless permitted by council action. 4. The property lines on site be identified by the owners to assure property setbacks when buildings are to be constructed if required by the building inspector. All lots must be properly staked. 5. Proposed driveway or drainage areas within the area surveyed must include the installation of a minimum 15" diameter, corrugated metal culvert in a manner acceptable to the City. 6. No building permits shall be issued until survey has been approved and recorded with Washington County. 7. All conditions of approval by Rice Creek Watershed District must be complied with. S. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 9. Any driveway permits requiring access to highways or county roads may not be issued until the necessary permits are secured from Washington County. 10. The minimum lowest floor elevation on Parcel B shall be 2' above the 100 year flood mark or 4' above the high groundwater mark which ever is greater. 11. No improvements, grading, or landscaping shall be permitted in the identified drainage areas without the express written authorization of the City and the appropriate watershed district. 12. All property owners shall be responsible for maintenance of drainage areas within easements on their property. The owners shall comply with all conditions and restrictions applicable to identified wetlands. 13. The developer shall permit access to the referenced site for periodic inspections to assure conformance with the conditions of survey approval. All aye, motion passed Commissioner Mezzano has graciously volunteered to serve on the Board of Zoning Adjustments. A recommendation will be made to the City Council to appoint Mr. Mezzano for a one year term. David Schumann asked if the city council denies a request, where can the applicant appeal the decision. He was informed that the Planning Commission would inquire for him. Motion made by Mezzano, seconded by Davis to adjourn at 7:28PM. All aye, motion passed.
