PRESENT: Mezzano, Davis, Oswald, Olson, Peltier ABSENT: Oswald Chairman Peltier informed the Planning Commission that Commissioner Oswald is resigning his position, however we are unsure whether the resignation is effective immediately. Chairman Peltier will contact Mr. Oswald to clarify this matter. Motion made by Davis, seconded by Peltier to approve the Minutes of November 26, 1991 as amended. All aye, motion passed. RECOMMENDATION FOR PArINIBS COMMISSI(.-)N,CHAIRMAN At the January 6, 1992 regular meeting of the Hugo City Council, action will be taken to appoint the chairman of the Planning Commission for the upcoming year. The Planning Commission is recommending Bill Mezzano be appointed chairman of the Planning Commission for 1992. The Planning Commission is recommending Deputy City Clerk, Carole LaBelle, serve as the Planning Commission secretary. The Planning Commission is recommending Bob Oswald be reappointed to the Ordinance Violations Committee. Mr. William Wunderlich of P.O. Box 25, St. Ignatius, Montana has made application to the City of Hugo for formal platting of an 87 acre tract of land into two 10 acre lots and one lot consisting of approximately 67 acres. The property in question is zoned agricultural, and is located between Ingersoll Avenue and Jeffrey Avenue, in the N 1/2 of Section 14, T31N, R21W, Washington County, MN. This tract of land is connected by an easement running from Lot 2, Block 1, to Outlot A of this proposed subdivision. This lot arrangement was created by a previous minor subdivision in 1987. It is the applicant's intent to develop Lots 1 and 2, Block 1, for residential purposes, and Outlot A is not to be developed unless alternate access to the site is provided from the east. Access to Outlot A is currently provided by an existing driveway on the north and east edges of Lots 1 and 2 of Block 1. Because of the topography of the area, it would be economically difficult to construct a driveway to Outlot A from Ingersoll Avenue that would meet City standards, and provide access to a residential dwelling by public safety equipment. The applicants have indicated they will not develop Outlot A for residential purposes, unless an alternate access to the site can be provided through the securing of private road easements to the site. For the purpose of this subdivision plat approval, it is their intent to identify Outlot A as unbuildable, and it P.C. Minutes - 12-18-91 Page 2 should be so identified on the plat. If the Planning Commission feels that the request in question is consistent with the Comprehensive Plan, we would suggest that any recommendation for plat approval be subject to special conditions. The public hearing was opened by Chairperson Peltier. Mr. Dale Hebeisen of Hult and Associates and Realtor Paul Tubbs were present. They stated that Mr. Wunderlich has withdrawn his request from the Rice Creek Watershed District to develop Outlot A because of the problems in providing access to the site. The applicant would like to reserve the right to develop at such time as the property would become buildable. Mr. Hebeisen stated that any easements would be maintained by the owner and that easements on property owned by the Wunderlich's may not be recorded until the property is sold. Commissioners agreed that access to Outlot could be obtained other than from the east and the applicant should be allowed that option. Motion made by Mezzano seconded Olson to recommend approval of the request of Wm Wunderlich to subdivide 87 acres (described above) into 2, ten acre lots and one Outlot of 67 acres subject to the following conditions: 1. The preliminary plat must be submitted to the City Council within 120 days of plat acceptance, or Planning Commission approval shall be null and void. 2. Plat approval shall be contingent upon compliance with the plat . conditions, as well as the grading, storm water drainage, and utility plans. 3. All conditions of plat approval must be met prior to the stamping of any deeds for recording by the City Clerk, unless otherwise permitted by Council action. 4. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed, if required by the building inspector. All lots must be properly staked. 5. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the City. 6. No building permits shall be issued until the plat has been approved and recorded with Washington County. 7. The required permits from the Rice Creek Watershed District and Department of Natural Resources must be secured prior to Council review. B. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 9. Any driveway permits requiring access to highways or county roads may not be issued until the necessary permits are secured from Washington County or the City. 10. Percolation tests for each buildable site must be submitted to the City prior to final plat approval. 11. Payment of fee in lieu of parkland dedication for three lots shall be paid to the City at the time of final plat approval. 12. The lowest minimum floor elevation of a structure in this subdivision shall be 2' above the 100 year high water mark or 4' above the high ground water mark, whichever is greater. P.C. No improvements, landscaping, or grading shall be permitted in the identified drainage areas without the express written authorization of the City and the appropriate watershed districts. 14. All property owners shall be responsible for maintenance of drainage areas within easements on their property. 15. The owner shall comply with all requirements and restrictions applicable to identified wetlands. 16. Outlot A shall not be developed for residential purposes, unless alternate access is provided. 17. Outlot A shall not be subdivided for residential purposes, unless access to the site is provided by a bituminous surfaced street in compliance with the City's subdivision regulations. 18. All special conditions governing Outlot A shall be identified in restrictive covenants, which shall be recorded with Washington County along with these special conditions. 19. Documentation must be provided to the City insuring that easements providing access to Outlot A be identified and recorded with Washington County. All aye, motion passed. COMPREHENSIVE PLAN UPDATE Mr. Ken Weber of Kuusisto Engineering was present to update the Planning Commission on the status of the Comprehensive Plan and update his earlier discussions with the Metropolitan Council staff. Mr. Weber stated that the Metro Council and the City are not in agreement as to the growth rate of Hugo for the next ten years. Mr. Weber informed the Commission that in revising the comprehensive plan, they are trying to include those portions of Hugo with the most growth potential so that each time a development is proposed it will not be necessary to go before the Metropolitan Council. Mr. Weber does not expect a response from Met Council until mid January. Motion to adjourn made by Davis, seconded by Peltier to adjourn at 8:30PM. All aye, motion passed.
