Driveway access to highways or county roads will riot be permitted until the necessary permits are secured from Washington County and the Minnesota Dept. of Transportation. 12. Dedication of required parkland or payment of fee in lieu of parkland dedication shall be paid to the city prior to final plat approval. .11. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the City and the approved watershed districts. 15. All property owners shall be responsible for maintenance of drainage areas within easements on their property. 16. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 17. No significant deviations from the approved preliminary survey shall be permitted unless reviewed by the planning commission prior to council approval. 18. Mr. Huber stated that Mr. Ed Waugh has made: application to the City of Hugo for a special use permit to construct a superette, gas station, and car- wash in an RB zoning district. The site in question is located at the southeast corner of the intersection of Highway 61 and County Rd. E s and consists of approximately ^ acres. Thi=. request is being made contingent on approval of the minor subdivision re_v:i.c.:;•wc_d earlier- by the planning commission. The building proposed wi.l.l. be approximately 18' in height and 7,000 sq. ft. in size. We have requested that the developers give the City some indication of the hours of operation of this. business. P.C. Minutes - June 27, 1990 Page 4 Mr. Dan Dege, architect for the proposed superette, stated that MNDOT had no problems with the project as proposed. Mr' Dege stated that they will not be disturbing the ditch system and most of the drainage will be directed to the ditch in the rear of the property- Mr. Dege informed the commission that they intended to add approximately 3 feet of fill to the site and after the recommendation by the city engineer, it may be increased. He stated that Rice Creek Watershed District was reviewing this application at their meeting this evening. Chairman Senkler opened the public hearing where area residents expressed concerns regarding the additional use of the water and sewer facilities in the area because of the recent watermain breaks in that neighborhood. Hours of operation were also of interest. Mr' Huber stated that the watermain breaks most likely did not have anything to do with the amount of water usage. Hours of operation were estimated to be 5 A.M. until approximately 11 P.M. The Planning Commission expressed concern regarding significant traffic increase of the property at 140th St. and west of Highway 61. Administrator Huber stated that the staff was not particularly concerned about the hours of operation in that the business was not in a highly populated area. Mr. Huber did inform the audience that the city engineer would review the sewer and water facilities to assure the increase in water demand' Mr. Dege stated that the entire facility would operate under the same hours. Motion made by Senkler, seconded by Thoreson to recommend approval of the special use permit request of Mr. Ed Waugh to construct a Tom Thumb Superette at 140th St. and Highway 61 subject to the following special conditions. 1. Approval of the minor subdivision of Mr. Ed Waugh reviewed by the Planning Commission earlier. 2. The buried gasoline tanks on site be installed and maintained as per county health department and MPCA regulations. 3. That the site be maintained on a regular basis and kept free of litter and other on site nuisances. 4. All advertising signs and related lighting be in compliance with City regulations. 5. The site plan approved be, and is a part of this special use permit. 6. All refuse on site be stored in the screened area as identified on the site plan. 7. No exterior storage shall be permitted on site. G. The parking areas are to provide for short term parking of motor vehicles only' 9. Driveway and road access permits must be secured from the MNDOT and Washington County before the building permit is issued. 10- All parking and drive areas shown on the sjte shall be o! bjt"min.,us surface and shall be installed as per requi,ements "f the city engi"e�r P.C. Minutes - June 27, 1990 Page 5 11. Submittal of all permits and drainage plans from the Rice Creek Watershed District. 12. Handicapped facilities and parking shall be provided' 13. The site in question must be plowed on a regular basis in the winter- time. intertime. 14. Regular garbage and refuse service shall be provided. 15. Bituminous curbing shall be installed on the north and western edges of the site near the buried gasoline tanks to prevent any spillage of gasoline into the ditch systems adjacent to the site. 16. All conditions of the special use permit must be met prior to issuance of the certificate of occupancy. 17. A building permit must be applied for within 120 days from permit approval and substantial construction of any building and improvements must be underway within 120 days of permit issuance. 18. Property lines must be identified on site, by owner to assure proper setbacks when buildings are to be constructed if required by the code enforcement officer. 19. No significant deviations from the approved site plan shall be permitted. 20. Encroachment into the designated easement on site shall be prohibited. 21. The applicant and/or owner shall permit access to the referenced site at reasonable times for periodic inspections to assure compliance with this permit. 22. On site facility shall be served with municipal sewer and water as per City policy. 23. The elevation at or near the gas pumps be increased by one foot as per the city engineers recommendation. All aye, motion passed. Chairman Senkler also requested that the drainage issue concerning the gas pump islands and the water and sewer facilities in the area be reviewed by the staff. Chairman Senkler informed commission members that a special planning commission meeting will be held on July 2, 1990 at 8:00PM in conjunction with the regular city council meeting to review the proposed wood treatment facility north of Bald Eagle Industrial Park. Chairman Senkler requested Administrator Huber draft a letter to the City of Lino Lakes expressing the planning commission's interest in attending the planning meetings in regard to their proposed industrial development along the west corporate border of Hugo. Mr. Senkler has volunteered to attend the meetings on a regular basis and would like the invitation to be open to any other commissioners interested in attending the meetings. Mr. Senkler would, however, appreciate an agenda of scheduled meetings two months in advance. Motion made by Senkler, seconded by Mezzano to adjourn at 8:18PM.
