We would be particularly concerned about the number of calls to law enforcement agencies regarding incidents taking place on an unsecured area of this nature. The Planning Commission has discussed the potential for commercial development along Highway 61 to 170th St., and this type of use would appear to be consistent with that approach, if properly developed. As of the time of this memo, the City has not received driveway permits from MNDOT or Washington County. The applicant has requested that the Planning Commission review this proposal to determine whether this type of land use is acceptable for the area in question. Mr. Deslauries was present at the meeting, and reviewed his site plan explaining the different phases of development. He stated his plans for open storage of boats, recreational vehicles, pontoons, trailers, and in the event these plans do not "get off the ground" as quickly as he would like, the storage of construction equipment. He stated that his 25 year old son would live in the trailer on site. At this time, Chairman Senkler opened the meeting for public input. Sharon Sarvela and Jerry Hammer both expressed opposition to the storage The meeting was called to order by Chairman Senkler at 7:00 PM. PRESENT: Thoreson, Oswald, Barnes, Senkler City Engineer, Howard Kuusisto Secretary, Mary Ann Creager ABSENT: Mezzano, Henry SPECIAL USE PERMIT REQUEST URIES/HATH1"A"-*`*) Mr. Ron Deslauries and Marjorie Hathaway have made application to the City of Hugo for a special use permit to develop and operate a recreational vehicle storage facility in an agricultural zoning district. The property in question contains approximately 21 acres and is located south of 170th St. and east of Highway 61. The property in question has frontage on both 170th St. and Highway 61 with primary access being from the latter. The property is generally described as the NE 1/4 of Section 8, T31N, R21W, Hugo, Minnesota, tax parcel #93008-3200. Mr. Deslauries' application indicates that the request is to provide outdoor storage to individuals for boats, recreational vehicles, pontoons, and trailers. It would appear- ppearfrom fromMr. Deslauries' site plan that they intend to develop the site in phases, with the first phase being those areas identified for recreational vehicle storage. Although it would appear that this type of proposal is permitted in an agricultural zone by special use permit, there are a number of potential areas we feel should be addressed: 1. The City had received a phone call from Emil Maslowski stating this objection to the request stating that the area already had enough Junkyards. Hearing no other comments, the public hearing was closed. The Planning Commission had no real objection to the proposed use of the property with the exception of the storage construction equipment. There was a lengthy discussion regarding the turning radius required at the ends of the corridors to allow for emergency vehicles. City Engineer, Howard Kuusisto, stated that he recommends a 55' turning radius. The Commission also discussed the landscaping requirements, and indicated that the fence to be installed along Highway 61 be relocated 5' to the east to accommodate the recommended landscape screening. Barnes made motion, Oswald seconded, to recommend approval of the request of Ron Deslauries and Marjorie Hathaway for a Special Use Permit to develop and operate a recreational vehicle storage facility on property located south of 170th Street and east of Highway 61 (aka the NE 1/4 of Section 8, T31N, R21W, Parcel #93008-3200). Recommended approval is subject to the following special conditions: 1. All areas identified in the first phase of development on the site plan be properly secured by installation of an 8' high wood -stockade fence. 2. All driveway areas be of a width, and constructed of materials, capable of accommodating emergency vehicles at all times, and subject to review by the City engineer and the Hugo Fire Chief. 3. All plans for lighting of the site be submitted to the City code enforcement officer with the appropriate information to determine compliance with the municipal code. 4. A landscaping plan be submitted consisting of approximately 50 - 5 gallon container evergreens along Highway 61. Screening to be installed by developer. 5. The storage of automobiles, trucks, mobile homes, tractor trailers, and construction equipment on site be strictly prohibited. 6. No repairs or sales be permitted on site. 7. Driveway permits be secured by the Minnesota Department of Transportation and Washington County prior to Council review of this permit. G. All motorized vehicles stored on site must be properly licensed at all times. 9. Controlled access to the site must be identified and maintained at all times. 10. The site in question shall be properly maintained with regard to dumping and visual appearance so as to not create a public nuisance. 11. Percolation tests for the office and homesite shall be submitted in compliance with city ordinances prior to city council review of this permit. 12. All recreational vehicles stored on site must meet the same setback requirements as required for buildings in this zoning district. 13. All driveway areas identified on the site plan shall be plowed and maintained during winter months to afford access by emergency vehicles. Snow disposal to be in the rear of site with gate provided in east fence. Planning Commission meeting of August 22, 1990 Page 3 14' Any growth of this storage facility into the expansion areas must be preceded by an amended special use permit. 15. A detailed signing plan must be submitted. 16' Developer shall be required to post security in an amount determined by the City Council until all work is completed on site. Said work shall be completed within six months of said approval or said permit shall be considered null and void' 18. No vehicles or equipment shall be stored on site until all site improvements are complete. 19. Hours of operation shall be established at the time of council approval. 20. No loud speakers shall be utilized on site. 21. The 24' X 48' house to be installed on site shall be built as per city codes and policies. 22. City staff shall be afforded access to the site at any reasonable time to assure compliance with the conditions of this permit. 23. The approved site plan shall be considered a part of this permit. 24. The developer shall relocate the west fence abutting Highway 61, 5' to the east to accommodate planting along the right-of-way. 24. Failure to comply with all conditions of this permit and development as per the site plan shall be grounds for revocation of said permit. All aye. Motion Carried. SPECIAL U1— "'MMIT REQUEST O On behalf of Northern States Power, Mr. Mark Mickelburg has made application to the City of Hugo for a special use permit to construct a 16" diameter gas main in the City of Hugo. The gas main in question will run from 175th St. south the 120th St.. and will be located between Trunk Highway 61 and the Burlington Northern Railroad tracks. The original application indicates that the pipeline will be located within the railroad right-of-way, however, since the submittal of their plans, NSP has indicated that the main could be located in the MNDOT right-of-way. Notices were sent to some 298 property owners within 300' of this project, as required. This request has been referred to the City Engineer for his recommendation. The applicants have indicated that the primary purpose of this request is to construct a new natural gas pipeline facility to serve an area which has experienced low gas distribution pressure due to customer loads in the northern metropolitan area. The proposed pipeline will reinforce NSP's gas distribution pressures and insure adequate supplies of natural gas for the northern metropolitan area. The proposed transmission line is to be designed for a maximum pressure of 720 PSIG for a Class 4 area, with an initial MOP of 350 PSIG. Permits have been applied for with the Rice Creek Watershed District, as well as other affected governmental agencies. The use of right-of-way for utility installations. 2. Site restoration. 3. Proper road crossings. 4. The aesthetic appearance of ditch in the downtown area between 150th St. and 140th St. The City Council has expressed a concern regarding the restoration in a manner so that the site can be properly mowed and maintained in the previously mentioned ten block area. Dave Schwartz, Mark Mickelberg, and Gary Kriesel, all representing NSP, were present at the meeting. Mr. Mickelberg reviewed the proposed gas -main project, and City engineer, Howard Kuusisto, reviewed his report. Mr. Kuusisto noted, in particular, the following concerns he has with the project: 1. Location of the pipe installation as it relates to possible future installation of city utilities. Would like to see it located in railroad right-of-way or enbankment. 2. Would like the same casing used under Highway 61 to be used under City streets. 3. Future crossing of gas pipes for drainage control would be difficult. 4. How close can city utilities be installed parallel and crossing the proposed main? Chairman Senkler opened the meeting for public comment. Carl Nordquist stated that he was fearful of a 350 lb. gas line going through the "heart" of the City. Had NSP considered any other route for the main; e.g., the MWCC sewer line west of town? Because of manual shut-off valves, there would be a time delay should there be an accident. There were no further comments, and the public hearing was closed. Chairman Senkler felt that this issue should be discussed further between the City's and N8P's engineers, and that the following items be addressed a later meeting: 1. Issues should be defined more clearly, and the proposed solutions to the problems be provided. 2. Provide a narrative of the alternate routes considered to better understand NSP's process. Senkler made motion, Thoreson seconded, to table this matter to the next regular Planning Commission meeting of September 26, 1990. All aye. Motion Carried.
