Huber reviewed this application
with the
Planning Commission
at the request
of Chairman Senkler. Mr.
Huber stated that
on behalf of
Northern
States Power Company, Mr. Mark
Mickelberg has
made application to
the City
of Hugo for a Special Use Permit
to construct
a 16" diameter gas
main in the
City of Hugo. The gas main
in question will
run from 175th
St. south
to 120th St' and will be located
between trunk
Highway 61 and
the Burlington
Northern Railroad tracks.
This matter was
reviewed by the
Planning
Commission at their August 22,
1990 regular meeting
at which
time, said
request was tabled in an effort
to give Northern
States Power
representatives
ample time to answer the
questions and
concerns of the
Planning
Commission and city engineer.
The Planning Commission
requested
that the
applicants respond in a narrative
outlining the
alternate routes
that were
considered for this and
why NSP chose
this particular
pipeline
location.
In that this request requires
permits from both
Rice Creek
Watershed
District and the Environmental
Quality Board,
we would recommend
that any
action by the Planning Commission
recommending
approval of this
pipeline
be subject to securing said permits
Of major
concern to the
city engineer
was the location of the gas
main as it relates
to possible
future installation
of municipal utilities
and how NSP
intends to put this
pipe under
our municipal streets. The City
has received
a letter dated
September
13, 1990 which responds to the
questions raised
by the Planning
Commission
at their previous meeting. The
city engineer
has met with the
design engineers
from NSP to discuss the
actual pipe locations
proposed.
Howard Kuusisto
has indicated that they
have reached an
agreement as to
the location
of the pipeline which should
be acceptable
to both the City
and NSP.
The final design plans will be
submitted to the
city engineer
for review
and approval before this matter
is placed on
the City Council
agenda.
Earlier discussions with NSP representatives
indicate
that they
would like
to get the required permits secured,
along with
design
approvals
this winter, so that they can
start construction
in May of
1991. If
the Planning Commission feels
that their previous
questions and
concerns
have been adequately addressed
and that the permit
request is
consistent
with the City's comprehensive
plan, we would
suggest that any
recommendation
for approval be subject to
special conditions.
Mr. Dave
Schwartz, Gary Kreisel, and Mark
Mickelberg from
NSP were present
to address
any further questions from the
Planning Commission.
NSP
representatives
stated that the EDP has
informed them that
there is no
significant
impact because of this request.
NSP stated
they would like to
install the
pipeline in the highway right-of-way
on the
southern portion
of
Hugo south of 145th St. The proposed pipeline
will be uncased, will be
located
in the ditch, with concrete slabs over
the pipe. Any water pipes
would
be lower than the proposed gas pipeline.
Members concurred that
they
had no objections to the pipeline, but its
exact location should be
such
sewer.

made by Senkler, seconded by Thoreson to
recommend approval of the
request
by Northern States Power for a special
use permit to install a 16"
gas
main in the City of Hugo subject to the following
special conditions:
I.
All conditions of the special use permit must
be met within 180 days
of cour'cil approval unless otherwise stipulated
in this permit. If
all conditions are not met the permit will
be null and void.
2.
No significant deviations from the site plan
and special use permit
will be permitted unless reviewed by the planning
commission and city
3.
council.
The site must be policed and maintained on
a regular basis with regard
to litter, on site nuisances, and safety during
the course of project
4.
construction.
All fees related to the review and issuance
of this permit shall be
paid by the applicant.

The owner/applicant shall permit access to
the site for periodic
inspections to assure conformance with this
permit'

The activities on site shall not cause the
altering of any
watercourse, ditch, or drainage system.
7.
The required permits have been secured from
the Rice Creek Watershed

District.
Required approvals must be secured from the
Environmental Quality
Board.

Method of installing this 16" gas main under
municipal streets must be
approved by the city engineer.

The 16" gas main must be installed in a manner
as recommended by the
city engineer and agreed to by the City and
NSP.

Copies of all road crossing permits from Washington
County and the
State of Minnesota must be filed with the City
by NSP.
12.
Northern States Power shall keep the City of
Hugo informed as to the
progress of this project and must make every
reasonable effort to
implement restoration of the site to the satisfaction
of the City.
13.
NSP shall provide written and/or financial
guarantees assuring
compliance with this permit.
14.
The 16" gas main shall be installed in a location
as recommended by
the city engineer and city staff, and agreed
to by the City of Hugo
and NSP.

of drainage but it
will
be restored to its original condition.
