PRESENT: Bill Mezzano, Gail Thoreson, and Richard Senkler City Administrator, Ken Huber Acting Secretary, Mary Ann Creager ABSENT: Chuck Henry, Bob Oswald, and Debra Barnes Mezzano made motion, Thoreson seconded, to approve the minutes for the Planning Commission meeting of September 26, 1990, as submitted. All aye. Motion Carried. SPECIAL USE PERMIT (1:.'ENCO CONSTRUCTION) On behalf of Mr. Mike Finnemanm, the Kenco Construction Co. has made application to the City of Hugo to install a temporary 4' X 8' sign on the southeast corner of Highway 61 and County Rd. 8A, and will be directional in nature. The property in question is zoned RB with total acreage of 9.45 acres. The sign is to be setback 32' from the north property line and 32' from the west property line. Earlier this fall, the Kenco Construction requested a temporary permit for the installation of this sign. That request for a temporary permit was denied by the City Council, indicating that the necessary public hearings should be held, and this type of request must be reviewed by the Planning Commission. City Administrator stated that there was a question as to the ownership of the property in question, and Kenco's representative stated that Ed Waugh is the owner, and that he has provided the City with a signed statement indicating that Mr. Waugh has no objection to the sign on his property. Chairman Senkler opened the meeting for public comment, and there were no oral or written comments. Senkler made motion, Mezzano seconded, to recommend approval of the request of Kenco Construction for a Special Use Permit to install a temporary 4' x 8' sign on the southeast corner of Highway 61 and County Rd. 8A. Approval is subject to the following special conditions: 1. The sign be classified as temporary, and this permit expire no later than December 1st, 1992. 2. The sign be unlighted and be aesthetically pleasing at all times. 3. The sign be installed in such a manner so as to not obstruct visibility at the intersection near this sign. 4. No additional signs be installed on the site in question. 5. Written permission shall be provided from the property owner. All aye. Motion Carried. SUBDIVISION REQUEST (HENRY MOL.ITOBJ Mr. Henry Molitor has applied to the City of Hugo for a minor subdivision and waiver of the formal platting requirements to subdivide a 10 acre tract of land into two lots of approximately 5 gross acres each. The property in question is located west of Geneva Avenue and north of 145th Planning Commission minutes of 10124190 Page 2 St. The site is zoned RR1 and SFE and abutts on Egg Lake. The applicants have made the necessary request for permits from the Rice Creek: Watershed District, and are having percolation tests done for parcel P. There is currently a home and out -buildings located on parcel A. The legal description of the property is somewhat vague with regard to its north property line as there is some question as to the precise location of said line. Mr. Molitor is going through the necessary legal process for property registration to clear up this matter. The applicant is requesting Planning Commission review of this request with the understanding that this matter will not go before the City Council until the necessary RCWD permits and percolation tests have been submitted for review. Mr. Molitor was present, and stated that the problem with the property line was with the meander line on Egg Lake, not the north property line. Chairman Senkler opened the meeting for public comment, and there were no oral or written comments. Mezzano made motion, Thoreson seconded, to recommend approval of the request of Mr. Henry Molitor for a minor subdivision, and waiver of the formal platting requirements, to subdivide a 10 acre tract of land into two lots of approximately five gross acres each on the property described as the South 10 acres of Gov't Lot 3 in Section 20, T31N, R21W, being a strip of land from off the south part of said Lot 3 of sufficient width making the north line thereof parallel with the south line of said Lot so as to contain 10 acres of land. Approval is subject to the following special conditions: 1. The final survey must be submitted to the City Council within 90 days of preliminary survey acceptance or Planning Commission approval shall be null and void. 2. All conditions of plat approval must be met prior to the stamping of any deeds for recording by the city clerk unless otherwise permitted by Council action. 3. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed if required by the building inspector. 4. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the city. 5. No building permits shall be issued until the survey has been approved and recorded with Washington County. 6. Securing the required permits from the watershed district is required prior to final survey approval. 7. Percolation tests for Parcel "L" must be submitted to the city prior to final survey approval. B. Dedication of required parkland or payment of fee in lieu of parkland dedication shall be made to the city prior to final plat approval. 9. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the City and the approved watershed districts. 10. All property owners shall be responsible for maintenance of drainage areas within easements on their property. Planning Commission minutes for 10/24/90 Page T 11. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 12. The developer shall permit access to the referenced site for periodic inspections to assure conformance with this special use permit. All aye. Motion Carried. REZONING REQUEST (M._WEGLEITNEF) Mr. Martin Wegleitner has made application to the City of Hugo for the rezoning of an 60 acre tract of land from SFE to SFU. The property in question consists of the southeast 1/4 of the northeast 1/4 of Section 20, T31N, R21W, and the east 1321 ft. of Gov't Lot 2, Section 20, T31N, R21W, in the City of Hugo. It is our understanding that the applicant intends to subdivide this property at a later date for residential lots of less than one acre in size. The property in question is located east of Geneva Ave. and north and south of 145th St. The property owners have been informed that if they are desirous of subdividing this property at a later date, access to the site must be provided by bituminous roads, the extension of sewer and water to the site, and an acceptable stormwater plan will be required. It has been brought to our attention that the site in question is currently located adjacent to a licensed shooting preserve. The primary responsibility of the Planning Commission is to determine if the request in question is consistent with our comprehensive plan for development in the surrounding areas. The majority of the area north of the site in question is zoned SFU, while the area to the east is conservancy, and the areas south and west are RR1. The Comprehensive Plan revisions, discussed by the Planning Commission at earlier meetings, did call for higher density residential development in the area in question. City Administrator, k::en Huber, reviewed the site in question, and Jim Merila, prospective developer, submitted visuals for review. There was discussion about the shooting preserves on the property in question, and on property to the east of the property to be rezoned. The DNR has not clearly defined the distances of shooting from residences. The distance varies depending on the use of land. Chairman Senk:ler stressed several times that Mr. Wegleitner may lose his "grandfather" rights for the hunting preserve should his property be rezoned, and Mr. Wegleitner stated that he understood the possible consequences. Mr. Senk.ler also stressed that the Planning Commission would be dealing strictly with the rezoning, land -use issues, and not development of the property. Chairman Senkler opened the meeting to public comment, and the following concerns were addressed by many of the residents in attendance: 1. Moved to the area because of rural atmosphere and wildlife. 2. Who was going to pay for extension of City improvements? 3. Run-off from development would flood their property. 4. What type of homes will be constructed. 5. Lots smaller than one acre. The public hearing was closed, and the Planning Commission discussed the rezoning as it related to the comprehensive plan, the availability of City Planning Commission minutes for 10/24/90 Page 4 improvements, road access, and the fact that the property was within the Metro Urban Service Area. There was also mention of keeping the area one acre in size to act as a buffer between the higher -density housing and the rural area. Senkler made motion, Mezzano seconded, to recommend approval of the request of Martin Wegleitner for the rezoning of a 60 acre tract of land from SFE to SFU. The property is legally described as the SE 1/4 of the NE 1/4 of Section 20, T31N, R21W, and the east 1,321' of Gov't Lot 2, Section 20, T31N, R21W, in the City of Hugo. Recommendation for approval of this rezoning is based on the following findings: 1. Site is within the M.U.S.A. 2. Site could be served by utilities. 3. Access to site adequate. 4. Consistency with Comprehensive Plan, and previous Planning Commission action in surrounding areas. 5. Not detrimental to health, safety, and general welfare of surrounding area.
