June 28, 1989
The regular meeting of the Hugo Planning Commission was called to order at
7:00PM by Chairman Senkler.
PRESENT: Thoreson, Henry, Oswald, Senkler
ABSENT: Mezzano, Barnes
Motion made by Senkler, seconded by Thoreson to approves the minutes of
May 24, 1919.
All aye, motion passed.
Rezoning Request (J. i.-fellison)
Chairman Senkler reviewed this request with the planning commission. He
stated that Jim and Sherron Kellison have applied to the City of Hugo for
the rezoning of a 6.7 acre tract of land from conservancy to RR2. Mr.
Kellison has purchased an 11.6 acre tract of land from Mr. Dave Potter
earlier this year. In the past the property in question has been a
treated as a single tract of land, although the property in question is in
two different zoning districts. Part of the property is conservancy, the
other portion is zoned SFE. The previous owner Dave Potter appeared
before the city council on February 16, 1988 to request a rezoning of the
conservancy area to SFE. This request was denied and the city council
encouraged Mr. Potter to reapply for a rezoning to an RR1 or RR2 zoning
district. The city's comprehensive plan calls for a minimum lot size of 5
gross acres per dwelling unit outside the Municipal Urban Service Area.
Mr. Kellison would like to get this property rezoned to RR2 so that a
single family residence can be built on the site in question and there
will be no problems in the future with regard to the need for a variance
as the site is smaller than the required 20 acres in a conservancy zone.
The rezoning in question would be consistent with the subdivision plat
submitted for your consideration. The site is located on the east side of
Elmcrest Ave. approximately 500' north of 129th St.
Chairman Senkler called the public hearing to order. No one from the
general public was present to comment on this issue.
Mr. Kellison is rezoning in order to subdivide the 11.6 acre tract into
two lots, which is not possible unless the northern portion of the
property is rezoned.
All members of the commission concurred that this was a reasonable request
and complied with the comprehensive plan.
Motion made by Senkler, seconded by Henry to recommend approval of the
request of Jim and Sherryon Kellison to rezone 6.7 acres from Conservancy
to RR2 legally described as follows: That part of Government Lot 1,
Section 31, T31N, R21W, Washington County, Minnesota, commencing at the
northwest corner of Gov't Lot 1; thence north 89 degrees 36 minutes 34
seconds East, assumed bearing along the north line of Gov't Lot 1, a
distance of 532.50 feet to the center line of Elmcrest Ave. North and the

point of beginning of the parcel to be described; thence continuing north
89 degrees 36 minutes 34 seconds east, along said north line, a distance
of 941.41 feet to the northeast corner of Gov't Lot 1; thence south 0
degrees 40 minutes 04 seconds east, along the east line of government Lot
1, a distance of 288.00 feet; thence south 89 degrees 36 minutes 34
seconds west, parallel with the north line of government Lot 1, a distance
of 1077.97 feet to the center line of Elmcrest Ave. North; thence
northerly, along said center line, a distance of 319.65 feet to the point
of beginning. Subject to Elmcrest Ave. North and 129th St. No. Subject
to and together with any other valid easements, restrictions and
reservations (93031-0300).

Minor Subdivision (J.V**.ellison)
Chairman Senkler reviewed the application with the planning commission.
He stated that Jim and Sherrron Kellison have made application to the City
of Hugo for the subdivision of an 11.6 acre parcel of land to one 6.7 acre
tract and one 4.9 acre tract. This request is being made in conjunction
with the rezoning request discussed previously. The site in question is
located on the east side of Elmcrest Ave. and north of 129th St.
Percolation tests have been reviewed by the city building inspector and
two acceptable drainfield sites have been identified for this
subdivision. The lots in question meet minimum size requirements and the
subdivision would be consistent with the city zoning regulations and
subdivision requirements. If the planning commission feels that this
subdivision and waiver of plat requirements is consistent with the
comprehensive plan and growth of the area in question, we would suggest it
be subject to special conditions.
Chairman Senkler requested comments from the public. There was no one
present to address the issue.
Senkler made motion, seconded by Thoreson to recommend approval of the
request of Jim and Sherron Kellison to subdivide 11.6 acres into two
tracts, one 4.9 acres and one 6.7 acres in size described as Parcel
#93031-0300 subject to the following special conditions:
1. The final survey must be submitted to the city council within 90 days
of preliminary survey acceptance or planning commission approval shall
be null and void.
2. All conditions of survey approval must be met prior to the stamping of
any deeds for recording by the city clerk unless otherwise permitted
by council action.
3. The property lines on site must be identified by the applicants to
assure proper setbacks when buildings are to be constructed if
required by the building inspector.
4. Proposed driveways or drainage areas within the development must
include installation of a minimum 15" diameter corrugated metal
culvert in a manner acceptable to the city.
5. No building permits shall be issued until the survey has been approved
and recorded with Washington County.
6. Securing the required permits from the watershed district, Department
of Natural Resources is required prior to final survey approval.
7. All fees relating to this subdivision shall be paid by the applicant
including the cost of recording documents with Washington County.
8. Percolation tests for each buildable site must be submitted to the
city and approved prior to final survey or plat approval'
9. Payment of fee in lieu of parkland dedication shall be made to the
city prior to final plat approval.
10. No improvements, landscaping, or grading shall be permitted in the
defined drainage areas without the express written authorization of
the city and the approved watershed districts.
I.I. The property owner shall be responsible for maintenance of drainage
areas within easements on their property.
12. Developer shall comply with all requirements and restrictions
applicable to identified wetlands and dedicate easements where
required.
13. No significant deviations from the approved preliminary survey shall
be permitted unless reviewed by the planning commission prior to
council approval.
14. The developer shall permit access to the referenced site for periodic
inspections to assure conformance with this special use permit.
15. Legal descriptions of all parcels to be subdivided shall be included.

Plan Amendment
Recently it was brought to the city's attention that the Municipal Urban
Service Area identified on the city's maps is not consistent with that
recognized by the Metropolitan Council. There were apparently two maps
prepared, one showing an area proposed by the city and one showing the
sewered area approved by the Metropolitan Council. The map sent to the
city was incorrect and this resulted in some errors in previously approved
plats. The plat of Bald Eagle Estates approved by the city, Metro Council
and subsequently permitted by the Metro Waste Control Commission is only
partially within the city's Municipal Urban Service Area. This
development somehow slipped through the cracks in the review process by
four different agencies as a result of the confusion regarding the
approved M.U.8.A. The Metropolitan Council Planning Staff has recommend
that we apply for an expansion of our M.U.S.A. to include the sixteen
acres in question which is located north of 126th St. and west of Highway
61. The plat in question is provided with sanitary sewer, street, curb
and gutter, and homes have been built in this subdivision. The procedure
we are following is that recommended by Met Council planning staff in an
effort to clean up this error and clarify our MUSA.
Stuart Schmeling, administrative intern for the City of Hugo reviewed this
issue with the planning commission. He informed the commission that the
Metropolitan Council required the request for expansion of the MUSA be
reviewed by the planning commission.
Motion made by Senkler, seconded by Henry to recommend approval of the 16
acre addition to the Metro Urban Service Area within the City of Hugo to
include the area already served by sanitary sewer service.
All aye, motion passed
The planning commission was advised that the Shoreland Ordinance was
revised as requested by the Department of Natural Resources.
The commission was also informed that the capitol improvement project is
proceeding as scheduled.
