HomeMy WebLinkAbout1989.08.23 PC MinutesMINUTES OF THE REGULAR MEETING OF THE HUGO PLANNING COMMISSION August 23, l989 The regular meeting was called to order at 7:00PM by Chairman Senkler. PRESENT: Mezzano, Oswald, Thoreson, Senkler, Administrator Huber, Carole Belle ABSENT: Henry, Barnes Mezzano made motion, seconded by Thoreson to approve the minutes of July 26, 1989 as amended. All aye, motion passed. (Preliminary Plat) Chairman Senkler requested Administrator Huber review this application request with the planning commission. Mr. Huber stated that Mrs. Lorraine St. Sauver has made application to the City of Hugo for the subdivision of a 60 acre tract of land into six lots of approximately 10 acres each. The property in question is zoned agricultural and is located at the northwest corner of Homestead Ave. and 132nd St. Mrs. St. Sauver is also asking for a variance that would allow for the platting of Lot 4 at 9'8 acres. Percolation tests have been prepared for all lots in question and all were determined suitable for construction of individual sewage treatment systems by the Washington County Planning Department. The applicants have informed us that they have made a request to the Rice Creek Watershed District for the needed permits and will dedicate the needed drainage easements as required. The subdivision of this property into 10 acre lots is consistent with the city's zoning ordinance and comprehensive plan. If the Hugo Planning Commission feels this application is consistent with the long range plans of the city, we would suggest that said recommendation for preliminary plat approval be subject to special conditions. Chairman Senkler opened the public hearing for comments. Mrs. Alice Christenson and surrounding residents wanted to verify the fact that there were only ten acre lots allowed in this area. She was assured that the application as submitted was strictly a request for 10 acre lots with the exception of a small variance on lot 4. Members of the planning commission concurred this was an acceptable use of the property in question and complied with the city's comprehensive plan' Hearing no objections to the preliminary plat a motion was made by Mezzano, seconded by Thoreson to recommend approval of the request by Mrs' Lorraine St. Sauver to subdivide a 59.8 acre tract of land (described as follows; that part of the north 105 acres of the southwest quarter, Section 27, T31N, R21W, Washington County, Minnesota, lying east of the west 1257.75' thereof, and That part of the south 150 feet of the south half of the northwest quarter, Section 27, T31N, R21W, Washington County, Minnesota, lying easterly of the following described line: Commencing at the southeast corner of the south half of the northwest quarter of Section 27; thence west, along the south line of the south half of the northwest quarter of Section 27; thence west, along the south line of the south half of the northwest quarter, a distance of 1404'20 feet to the point of beginning on or near the center line of an existing drainage ditch; thence northwesterly, deflecting 690 degrees 02 minutes 30 seconds to the right, along a line on or near the center line of said drainage ditch, to the north line of said south 150 feet and there terminating), into 6 lots of approximately 10 acres and grant a variance on Lot 4 to be 9.8 acres in size subject to the following special conditions: 1. The preliminary plat must be submitted to the city council within 90 days of preliminary plat acceptance or planning commission approval shall be null and void' 2. Subdivision approval shall be contingent upon compliance with plat requirements, as well as, the grading, stormwater drainage, and utility plans. 3. All conditions of plat approval must be met prior to the stamping of any deeds for recording by the city clerk unless otherwise permitted by council action. 4. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed if required by the building inspector. 5. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the city. 6. No building permits shall be issued until the plat has been approved and recorded with Washington County,, 7. Securing the required permits from the watershed district, Department of Natural Resources, and Army Corps of Engineers is required prior to final plat approval' B. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 9. Percolation tests for each buildable site must be submitted to the city prior to final survey or plat approval' 10. Payment of fee in lieu of parkland dedication shall be paid to the city prior to final plat approval. M. Installation of required stormwater control shall be installed at the developers expense. 12' No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the city and the approved watershed districts. 13' All property owners shall be responsible for maintenance of drainage areas within easements on their property. 14. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 15. The developer shall be responsible for street signs, identifying mailbox locations, providing as -built drawings, installation of trees, and culverts within the development as required. 16. No significant deviations from the approved preliminary plat shall be permitted unless reviewed by the planning commission prior to council approval. 17. Any exterior lighting or advertising activities on site must be approved by the city. W. The use for which this permit is sought is not in violation of any restrictive covenants applying to the property referenced herein. 19. The developer shall permit access to the referenced site for periodi c inspections to assure conformance with this special use permit. 20. Legal descriptions of all parcels to be subdivided should be included. All aye, motion passed. Commissioner Mezzano would like to thank Mayor Atkinson for the letter clarifying the Planning Commission as it relates to land use decisions and felt it will be helpful in future recommnedations being made by the planning commission.
