HomeMy WebLinkAbout1989.12.27 PC MinutesMINUTES OF THE HUGO PLANNING COMMISSION MEETING - December 27. 1989 Chairman Senkler called to order the regular meeting of the Hugo Planning Commission at 7:00PM. PRESENT: Henry, Thoreson, Oswald, Barnes, Senkler, Administrator Huber, Carole LaBelle ABSENT: Mezzano Motion made by Henry, seconded by Senkler to approve the minutes of November 21, 1989 as amended. All aye, motion passed. Chairman Senkler requested Administrator Huber review the application with the planning commission. Mr. Huber stated that on behalf of Wil Harris Investments, Inc., Mr. Wil Harris has made application to the City of Hugo for a special use permit to operate a teenage night club on the premises identified as 17255 Forest Blvd. No., Hugo, Minnesota. The property is legally described as shown on the site plan submitted. Mr. Harris has identified Mr. Murray Wright and Mr. Dave Doris as the proposed managers of this facility. The property in question is currently zoned RB on the west and agriculture on the east. The building is now the home of Willy's 61 Club. It is the intent of the owner to use the entire building and grounds as a teenage night club three days a week from 8:00PM to 12:00 Midnight. The other four days a week the building will be operated as an adult night club where alcoholic beverages would be served. As per the staff's request, the applicants have now provided an acceptable site plan identifying parking and traffic flow on site. It should be noted that Mr. Harris owns more land than that shown on the site plan, but the only portion of the property that is affected by this special use permit will be that identified on the approved plan. At the November 21, 1989 meeting of the planning commission, they indicated concern regarding the sale of alcoholic beverages on site at the same time the teenage night club would be in operation. To resolve this concern the applicants have stated in their narrative as follows: "We are requesting a permit for the operation of a nonalcoholic teen night club to be operated on Thursday, Friday, and Saturday nights at the above mentioned location and a regular night club serving alcohol would be in operation on Sunday, Monday, Tuesday, and Wednesday- All liquor and beer would be locked and inaccessible on teen nights. Bottle liquor would be locked in a storage room, all beer coolers will be locked with bar locks, and all keg beer tapping systems will be disconnected". The applicant has indicated that he will expand and improve the parking lot as shown on the site plan this winter. An application has been made with the Minnesota Department of Transportation regarding a second egress from the site in question. The applicants have indicated they will comply with the fire marshal's recommendation regarding installation of fire extinguishers and panic hardware on all exit doors. It was pointed out to the owner that the special use permit runs with the land and building in question, and that he is responsible for seeing to it that the conditions of the special use permit are adhered to if the property is to be managed by someone other than himself. Minutes 12-27-89 1 In light of the modifications made to the site plan and proposal for the operation of the teen night club, we can see no objections to the approval of the land use in question (special use permit) for the teenage night club subject to the recommended special conditions. Administrator Huber informed the commission that E.G. Rud prepared the site plan and legal description for this request and has adequately addressed the technical concerns expressed by the City at the previous meeting. Mr. Murray Wright stated that if they plan to conduct outdoor events or events for an age group other than normally allowed in the club, they would apply for permits on an individual event basis. Mr. Doris assured the commission that the existing lighting does illuminate the current parking facilities, but if the parking lot to the east is to be used, they will install additional lighting. Also, if the proposed driveway on the south of the property is approved by MNDOT, the applicants have agreed to install a light at the southwest corner. The applicants have also indicated that they will use the door on the north side of the building for the entrance and all other doors will be used as emergency exits only. Motion made by Barnes, seconded by Henry to recommend approval of the special use permit request by Wil Harris Investments, Inc. to operate a teen night club located at 17255 Forest Blvd. subject to the following special conditions. 1. The maximum occupancy load of 710 will be identified and a signed statement of such be posted in the entrance to the building in question. 2. No entertainment is to be allowed outside the building without receiving prior city council approval for each event. 3. That a minimum of 237 improved parking stalls including 5 handicapped stalls be provided as required by law. 4. That the required parking lot shown approximately 75' east of the existing building be of an approved surface (at least 2" to 6" of class 5 dolomite or as recommended by the city engineer). 5. That the parking lot be properly plowed, maintained, and signed indicating entrance and exit locations. 6. That at least 2 parking attendants be on duty while this facility is open unless the parking lot is blacktopped and each parking stall individually marked. 7. At least two law enforcement officers be present at all times while the teen night club is open for business. 8. The approved site plan shall be a part of this permit. 9. The main entrance to the building be of a minimum width as required by the fire marshal. 10. Two additional exits must also be provided while maintaining approved operable exit door hardware. 11. Fire appliances must be installed in the building as per the fire chief's requirements 10.301 (A) of the life safety code. 12. All parking areas shown on site plan shall be improved, kept plowed and usable at all times while the facility is open. 13. No parking be allowed on Highway 61 or in the areas identified on the site plan as fire lanes. P.C. Minutes 12-27-89 2 14. The teen night club will be open from 8:00PM until Midnight, no more than five nights, which must consecutive, of each calendar week. At no time shall liquor, wine, beer, or nonalcoholic beer be displayed, sold, or consumed on site while the teen night club is open for business. 15. No parking shall be allowed adjacent to the north wall of the building east of the exist/entrance doors. No parking will be permitted south of the building. 16. Proper safety precautions shall be taken to prevent patrons from exiting from the south fire door into the exit drive areas. 17. The exit from the east parking lot along the south side of the building be identified on the site plan and the required permits secured from the Minnesota Dept. of Transportation to provide the additional exit onto Highway 61. 18. All required permits and liability insurance shall be secured by the owner/operators with limits of liability as recommended by the city attorney. Copies of insurance policies shall be filed with the city annually. 19. A more detailed parking and interior floor plan will be provided and be fully dimensioned as recommended by the city staff. 20. The city staff be allowed access to the property in question at reasonable times to assure compliance with this permit. 21. Failure to comply with the commitments of the applicant or conditions of this special use permit shall be grounds for revocation of same. 22. Entrances and exits from the site shall be identified on the site plan and on the property by proper directional signs. All aye, motion passed. Minon_Subdivision (Fred Macalus) Chairman Senkler requested that Administrator Huber review this request with the planning commission. Mr. Huber stated that Mr. Fred Macalus and Mr. Dan Ramberg have made application to the City of Hugo for a minor subdivision of an 84 acre tract of land into two residential lots. One lot to be approximately 10 acres in size and the other lot to be approximately 74 acres. Tract A of the subdivision in question has road access to 180th St. and Tract B would have road access to 170th St. via a 60 ft. strip of land being purchased from Mr. Dan Ramberg. Currently Mr. Macalus has a single family residence on Tract B with a private driveway access to 170th St. In an effort to avoid approving a subdivision that would land lock a large tract such as that identified as tract B, Mr. Macalus is providing a 60 ft. strip of land to 170th St. that could be used for public road access to the interior lots if said property were to be subdivided sometime in the future. The property is zoned agricultural and conservancy. The required permits from the Rice Creek Watershed District have been secured and the appropriate easements dedicated as shown on the enclosed certificate of survey. The applicants are requesting waiver of the formal subdivision requirement. Motion made by Senkler, seconded by Thoreson to recommend approval of the subdivision request by Fred Macalus and Dan Ramberg subject to the following special conditions. P.C. Minutes 12-27-89 3 1. The purchase of the 60 ft. wide strip of land, from Dan Ramberg to provide access to 170th St. for Tract B, be completed and an application be made to the Washington County Auditor for consolidation into a single lot as shown on the certificate of survey. 2. No further subdivision of Tract B of this certificate of survey be permitted without the formal platting of the property and construction of an approved public roadway to the site. 3. The final survey must be submitted to the city council within 90 days of preliminary survey acceptance or planning commission approval shall be null and void. 4. All conditions of survey approval must be met prior to the stamping of any deeds for recording by the city clerk unless otherwise permitted by council action. 5. The property lines on site must be identified by the applicants to assure proper setbacks when buildings are to be constructed if required by the building inspector. 6. Proposed driveways or drainage areas within the development must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the city. 7. Securing the required permits from the watershed district is required prior to final survey approval. S. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 9. Any driveway permits requiring access to highways or county roads may not be issued until the necessary permits are secured from Washington County or the Minnesota Dept. of Transportation. 10. Percolation tests for each buildable site must be submitted to the city prior to final survey approval. 11. Dedication of required parkland or payment of fee in lieu of parkland dedication shall be paid to the city prior to final survey approval. 12. This approval shall be granted with the understanding that said subdivision does not create any landlocked parcels by the petitioner and land owner. 13. No improvements, landscaping, or grading shall be permitted in the defined drainage areas without the express written authorization of the city and the approved watershed districts. 14. All property owners shall be responsible for maintenance of drainage areas within easements on their property. 15. Developer shall comply with all requirements and restrictions applicable to identified wetlands. 16. The developer shall permit access to the referenced site for periodic inspections to assure conformance with this subdivision. 17. Legal descriptions of all parcels to be subdivided should be included. All aye, motion passed. Planning commissioners held a brief discussion regarding the resumption of work on the comprehensive plan map. It was agreed that the clerk's office would forward information discussed at previous meetings for the benefit of those members not involved in earlier discussions.
