PRESENT: Sullivan, Henry, Sonnenfeld, Jesinski, Barnes, Senkler, Carole LaBelle Motion made by Sullivan, seconded by Senkler to approve the minutes of April 6, 1988. All aye, motion passed. (DeFoe) Steven and Cheryl DeFoe have made application to the City of Hugo for the subdivision of a 149' X 167' tract of land located in the plat of Charpentier's Addition in the City of Hugo. The property in question is zoned SFU and is located north of 141st St. between Highway 61 and Egg Lake. Currently there is a residence located on the site in question (5598 141st St. No.) and it is the intent of the applicant to remove the house and sell proposed lots A and B for the construction of two single family dwellings. There are utilities currently available to serve the site identified as lot 1 of the recorded plat of Charpentier's Addition except the west 125' and except the east 25' thereof. The applicants have requested waiver of the formal platting procedure. The property appears to meet all subdivision requirements and are of an appropriate lot size. If the planning commission recommends approval of the subdivision we would recommend that said approval be subject to special conditions. Cheryl DeFoe stated that she has spoken to the Hugo Fire Department and they would be willing to burn the current residence as a fire drill. Chairman Senkler reviewed the proposal with all commissioners. Chairman Senkler requested comments from the public. No one from the general public was present to comment. Commissioners felt this was an appropriate subdivision request with both lots meeting all city requirements. Motion made by Henry, seconded by Sullivan to recommend approval of the subdivision request and waiver of the formal platting requirements for Cheryl and Steven DeFoe to subdivide a tract of land 149' x 167' lot into two lots, one 81.00' wide and one 86.00' wide in Charpentier's Addition subject to the following special. 1. A final survey must be submitted to the council for approval within 90 days of preliminary acceptance or this approval shall be null and void. 2. All c6nditions of the approval must be met prior to stamping any deeds or recording by the city clerk unless otherwise permitted by council action. 3. All property lines must be identified on site by the applicant to show proper building setbacks if required by the building inspector. 4. Driveways or drainage areas must include installation of a minimum 15" diameter corrugated metal culvert in a manner acceptable to the city. 5. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. P.C. Minutes April 27, 1988 - Page 2 6. On site activities permitted as a result of this subdivision shall not cause the altering of any watercourse, ditch, or drainage system in the area. 7. Payment of all parkland dedication fees shall be made prior to final subdivision approval. 8. No future subdivision of these parcels shall be permitted. 9. The existing dwelling on site must be removed prior to the stamping of any deeds or issuance of building permits unless financial security is provided to the city in the form a $2,000.00 cashiers check assuring that the building in question will be removed within 30 days of final survey approval. All aye, motion passed. ) Michael and Laurie Teadt have made application to the City of Hugo for the subdivision of a 41.6 acre parcel of land into two parcels, one containing a 20 acre tract and one a 21.6 acre tract. The property is located in the east 1/2 of the southwest 1/4 of section 6, T31N, R21W, Washington County, Minnesota. The property in question is zoned agricultural and the lots proposed appear to meet the minimum lot size requirements. The applicants have requested waiver of the formal subdivision requirement and intend to use the property for residential purposes. If the planning commission recommends approval of this request we would recommend said approval be subject to special conditions. Chairman Senkler reviewed the application with commissioners. Members did not have any objections to the proposed subdivision of a 41.6 acre parcel into two lots. Chairman Senkler asked for comments from the public. There was no one present to comment on the subdivision request. Motion made by Barnes, seconded by Jesinski to recommend approval of the request by Michael and Laurie Teadt to subdivide 41.6 acres into two parcels one a 21.6 tract and one a 20 acare parcel subject to the following special conditions. 1. Minutes April 27, 1988 - page 3 ) Mr. Brett Kostuch has made application to the City of Hugo for a special use permit to allow for the boarding of two horses and construction of an 18' X 26' accessory building to serve as a horse barn. The property owned by Mr. Kostuch is zoned RR 1 and contains approximately 5 acres in total area. The property in question is generally defined as the North 300 ft. of the south 970 ft. of the east 787.58 ft of the southeast 1/4 of the southeast 1/4 of Section 19, T31N, R21W, except the east 50 ft. thereof. Subject to Fenway Ave. (aka 14134 Fenway Ave. No.). Mr. Kostuch withdrew his application on April 26, 1988. Donald and Nancy Rieck have applied for a special use permit to allow for the boarding of one horse and installation of a 12' X 15' horse barn on their property identified generally as a part of Gov't lot 5, Section 35, T31N, R21W, Washington County, Minnesota (aka 12718 Irish Ave. No.). The property in question consists of 5 acres and is zoned RR2. Said property is within 1,000' of Sunset Lake and this request must be reviewed by the DNR. The applicants have not identified a fenced area or corral area to contain the horse in question. If the planning commission recommends approval of this special use permit we would suggest said approval be subject to special conditions. Chairman Senkler reviewed the request of Donald and Nancy Rieck with commission members. The applicants were not present to comment on their request. Mr. Senkler noted that there was no specified area for containing the horse. Mr. Senkler explained that most residents on Irish Ave. do have horses and this request would be consistent with the surrounding area. Commissioners had no objections with the request for one horse on the five acre parcel. Motion made by Jesinski, seconded by Barnes to recommend approval of the request for a special use permit for Donald and Nancy Rieck to keep one horse and construct a 12' x 15' horse barn at 12718 Irish Ave. No. subject to the following conditions. 1. The number of horses permitted on site be limited to one. 2. The animal be restricted to the area identified as the corral or- fenced rfenced in area on the site plan. 3. No resubdivision of the five acre tract of land in question shall be permitted or this special use permit shall be null and void. 4. No commercial use of the property shall be permitted. 5. All fees relating to the issuance of this permit shall be paid by the applicant including the cost of recording at Washington County. 6. All activities on site shall not cause the altering of any watercourse, ditch, or drainage system. 7. The applicant must provide access to the referenced site for periodic inspection by the city to assure conformance with this permit. 8. Any revisions to the approved site plan must be reviewed by the planning commission and city council. P.C. Minutes Ap[ril 27, 1988 - page 4 9. All animal feces on site as a result of boarding these horses shall be removed in a manner acceptable to the city. 10. The animal on site shall be that of the property owner and shall be for personal use only. 11. Applicant must comply with DNR recommendations. 12. Applicant identify the corral area on site plan prior to council approval. All aye, motion passed. Chairman Senkler and members discussed the possibility of reconsidering the comprehensive land map and recommendations. Members felt that with the building season coming up this matter should be looked into. A work session was scheduled for May 11, 1988, 7:00 PM to discuss the comprehensive land use map and other appropriate business. Motion made by Senkler, seconded by Sullivan to adjourn at 7:30PM.
