Members present: Blanchard, Sullivan, Schreifels, Senkler, Jesinski, Rudisill Absent: Olson Chairman Rudisill then called on City Administrator Huber to give the commission and audience a background of the Wm. Wunderlich special use permit tabledfrom the April 22, 1987 Planning Commission meeting. Mr. Huber stated that Mr. Bill Wunderlich Sr. has made application to the City of Hugo for a special use permit to allow for the construction of a 40' X 48' accessory building on his property in an agricultural district. The property consists of approximately ten acres that is gen- erally described as part of section 14, T31N, R21W, also known as 15939 Ingersoll Ave. No. The total square footage of allowable accessory building in the zoning district is 3600 sq. ft. for lots less than 20 acres in size. This request by Mr. Wunderlich would allow for the con- struction of a building between the house and Ingersoll Ave. and access- ory building exceeding 3600 sq. ft. limit. There were no objections to the issuance of this special use permit and variance request. At the pre- vious meeting Mr. Wunderlich had indicated he would be prepared to explain his hardship regarding the need to locate the accessory building in front of the house. We would recommend that if the planning commission chooses to approve this special use permit and variance request that it be subject to the special conditions as discussed. Commissioner Blanchard inquired as to whether the commission could deal with these requests in a single motion. The City Administrator responded in the affirmative. Mr. Rudisill requested that the administrator read the 13 special conditions as rec- ommended by the staff. Mr. Rudisill then asked Mr. Wunderlich if he had any objections to the special conditions and Mr. Wunderlich responded in the negative. For further discussion Commissioner Blanchard moved to ap- prove the special use permit and variance for Mr. Wm. Wunderlich to allow for the construction of the 40' X 48' accessory building between his home and Ingersoll Ave. on a ten acre tract of land in Section 14, T31N, R21W (aka 15939 Ingersoll Ave. No.) subject to the following conditions; 1. The SUP approval be subject to securing the required variance from the city council to allow the construction of this building between the prin- cipal building and Ingersoll Ave. 2. Any and all conditions of this SUP must be met within 90 days, unless other- wise stipulated in this permit. If these conditions are not met this per - met will be null and void. 3. A building permit must be applied for within 120 days of permit approval and substantial construction of any building or improvements must be underway within 120 days of permit issuance. 4. Property lines mu$t be identified on site by the applicant to assure proper setbacks when buildings are to be constructed. 5. Any commercial or industrial use of said property not specifically permitted in the zoning district by the city zoning ordinance shall be strictly prohibited. 6. All driveways built over ditches or drainage areas must include install- ation of a 15" corrugated metal culvert installed in a manner acceptable to the city. 7. No building permits will be issued until the required permits are secured from the appropriate watershed district where applicable. Planning Commission Meeting May 11, 1987 page 2 8. No significant deviations from the approved site plan shall be permitted unless reviewed by the planning commission and city council followed by an amended SUP. 9. All fees relating to the issuance of this permit shall be paid by the applicant inlcuding the cost of recording this permit with Washington County. 10. Any exterior storage on site relating to activities of this SUP must be confined to a fenced area approved by the city. Said fencing to be con- structed in a manner that will allow for screening from view of the general public. 11. No fences, structures, or vegetation may be placed in on-site easements. 12. Activities on-site will not cause the altering of any watercourse, ditch, or drainage system. 13. Property owner will provide access to the site for periodic inspection to insure compliance with the SUP. Motion seconded Commissioner Sullivan. All members voting aye, motion carried. Chairman Rudisill acknowledged the presence of Vern Peloquin, Mr. Mike McAllister, Ms. Theodora Peltier, Mr. Howard Schletty who appeared at the meeting this evening to give the commisison some background on why the comprehensive land map was not adopted at the same time the city's current comprehensive plan was approved. A lengthy discussion ensued regarding the history of the land use map, with Mr. McAllister and Mr. Peloquin stating that the map was prepared by Mr. Carl Dale and the city was not happy with how Mr. Dale handled the preparation of the map. Mr. McAllister stated that the final product prepared by Mr. Dale was how Mr. Dale felt the community should develop as opposed to how the community leaders felt it should be dev- eloped. It was stated that the city zoning map has been used as a comprehen- sive plan map for the last several years and that the planning commisison is on track in its efforts to update the comprehensive map. In a motion by Senkler, seconded by Blanchard, all members voting aye the meeting was adjoured at 8:56 PM. Ken Huber City Administrator
