The regular meeting of the Hugo Planning Commission was called to order by Chairman
Rudisill at 7:01PM.
PRESENT: Blanchard, Senkler, Schreifels, Jesinski, Rudisill, Mayor Atkinson,
Councilman Olson, Carole LaBelle
ABSENT: Sullivan, Ray Olson
Motion made by Senkler, seconded by Blanchard to approve the minutes of the regular
meeting of April 27, 1987. All aye, motion carried.
Schreifels made motion, seconded by Jesinski to approve the minutes of the special
meeting of May 11, 1987. All aye, motion carried.
Ron DesLauries/Iverson - Subd. - The public hearing was called to order at 7:05PM.
Mr. Ron DesLauries and Mr. John Iverson have made
application to the City to subdivide a 34.82 acre tract of land in an agricultural
zone into three lots. Mr. DesLauries has requested a waiver of the formal subdiv-
ision requirements and has indicated that the enclosed preliminary survey will be
revised to reflect his request. The property in question is described as, all that
part of the SWJ of the NWJ of Section 30, T31,R21W, Washington County lying easterly
of the centerline of Elmcrest Ave., north as presently laid out and traveled. Mr.
DesLauries has been directed to amend the enclosed certificate of survey deleting
Tract A and Tract C and redefining tracts D and E for the final survey. The prop-
erty in question was thought to have been divided atan earlier date, however, records
indicate that although the survey was prepared it was never reviewed or approved by
the city. The proposed lots meet the lot dimension requirements for an agriculture
zone. The DesLauries' have been informed that they must have Rice Creek Watershed
review their survey and approve their plan for development prior to issuance of a
building permit. The staff recommends 12 special conditions should the Commission
recommend approval of the subdivision.
Mr. DesLauries has contacted Rice Creek Watershed, Mr. J. Penuska stated he would
review their plans. The DesLauries agreed to the special conditions which were
read and stated that they understood what they are expected to do. No one from
the audience made any comments regarding this subdivision request. The public
hearing was closed at 7:15PM.
Motion made by Senkler, seconded by Blanchard to recommend approval of the sub-
division for DesLauries/Iverson, described as all that part of the SWJ of the NWJ
of Section 30, T31, R21W, Washington County lying easterly of the centerline of
Elmcrest Ave., north as presently laid out and traveled, waiving the formal plat-
ting procedure, subject to the following conditions;
1. A final survey be submitted to the City Council within 90 days of preliminary
survey acceptance or this approval shall be null and void.
2. All conditions must be met before stamping of any deeds for recording by the
city clerk unless otherwise permitted by council action.
3. Property lines must be identified on site by the applicants to assure proper
setbacks when buildings are to be constructed if required by the building in-
spector.
4. Any commercial or industrial use of said property not specifically permitted in
this zone by the city zoning ordinance shall be strictly prohibited.
5. Driveways or drainageways must include installation of minimum 15" diameter
metal culverts in a manner acceptable to the city. Larger culverts may be re-
quired by the city engineer.

6. No building permits are to be issued until the required permits are secured
from the appropriate watershed district.
7. All fees relating to this subdivision shall be paid by the applicant including
the cost of recording documents with Washington County.
8. Any driveway permits requiring access to highways or county roads shall not be
issued until permits are secured with Washington County or MNDOT.
9. Use of this property shall not be in violation of any existing restrictive cov-
enants.
10. On-site activities permitted as a result of this subdivision will not cAe the
altering of any watercourse, ditch, or drainage system in this area.
11. Payment of parkland dedication fees shall be made at the time of final survey
approval.
12. Soil percolation tests be completed and submitted for review prior to final survey
approval.

Harstad Companies - Subdivision - The public hearing was called to order at 7:20PM.
On behalf of Harstad Co.'s, Mr. Keith Harstad has made application to the City to
subdivide a 24.75 acre tract of land into 48 single family lots. The property in
question is zoned single family urban and located south of County Rd. 8A between
Highway 61 and Goodview Ave. (part of the NEJ of Section 29, T31, R21W, in the City
of Hugo). On August 13, 1986 the planning commission reviewed the sketch plan and
made five recommendations. The Harstad Companies have complied with the special
conditions and the petitioners are now requesting the preliminary plat be reviewed
for approval by the commission. The city engineer has completed a feasibility report
which can be reviewed in its entirety in the clerk's office. We would recommend
that if the planning commission recommends approval of this subdivision it be sub-
ject to 17 special conditions.
Mr. John Johnson and Dick Wedell presented the Harstad Co.'s plan with revisions.
The original proposal indicated three holding ponds. One has been eliminated
identified as pond 412. The other ponds have been moved further from the homes.
Harstad will extend the existing sewer east on 8A and loop it through the devel-
opment. Rice Creek Watershed has approved the subdivision plan and are pleased
that the development releases the water from the property at a rate slower than
it is currently being released. Mr. Johnson stated they will not be modifying the
protected wetlands in any way. The area identified as pond 412 will have water
only during a heavy rain. This water will drain through a pipe into pond 413.
Ponds 1 & 3 will contain approximately 3-5 feet of water each. The RCWD required
that the ponding areas be physically separate from the ditch. Mr. Johnson stated
that the backyards where pond 2 was prosed will be lower than they are now but
will not contain water. Stone rubble /will placed around the culvert to keep silt
and sand from filling the culvert and allow proper drainage. These stones will
be grouted to remain in place. These stones are also placed at the down end of
the culvert and the culvert will have a control structure to allow for the release
of the water. The ponds will have a 6 to 1 slope which is quite gradual.
There are 9 existing lots along 8A where construction is proposed as soon as possible.
However, Harstad understands that no certificates of occupancy will be issued until
utilities are installed. It is proposed that in the event the remainder of the pro-
perty is developed the two roads running basically north and south will be extended
to serve the south area. Properties with drainage easements will have this noted
on the deeds. Mr. Johnson stated they understand that it will be/obligation of the
property owners to maintain these drainage easements.

Access to pond #1 will bethrough aleasement along the southerly property line
of Lot 1, Block 4. Pond #3 will be accessed directly from the road.
Residents, surrounding the area were concerned about the increased housing and
diminishing the rural atmosphere in Hugo, also the added driveways onto County
Rd. 8A. There was also concern that other governmental agencies are controlling
the City. Some residents felt that Hugo is becoming an unattractive city and
officials should proceed cautiously as to whom they allow further construction
and development.
Mr. Johnson stated they would prefer to pay a fee for parkland dedication but they
would be willing to identify a 6 acre area for parkland if the entire area is
developed, however, 1.7 to 1.9 would be dedicated for the current project. Harstad
indicated they would be willing to participate in the maintenance of the ditch
while they still had an interest in the property but when all the lots are sold
they felt they should no longer be involved. The public hearing was closed at
8:20PM.
Commissioners Jesinski and Blanchard were concerned that the ponds and the traffic
on 8A would create a hazard to small children in the area and suggested some type
of walkway to divert pedestrians and possibly fencing to deter children from the
water areas. Mr. Senkler expressed his view regarding the maintenance of the
drainage easement. Specifically what does the maintenance entail and who would
determine when the improvements should be done. The question of the driveways
along County Rd. 8A was addressed by Washington County stating that possibly there
would be a common driveway for two homes, reducing the contact areas to the road.
Mayor Atkinson noted that the City Council hoped to have an updated comprehensive
land use plan prior to acceptance of land or money for parkland dedication from
Harstad Co.'s. If the parkland area was designated near the wetland culverts
would be installed for access to the park. It was noted that approximately 1.5
acres is needed for a small ballfield. It is recommended that a larger area
be specified for ballfields but when planning for a park a larger portion of the
population should be considered other than just small children.
It was the general concensus of the commission that parkland area with improvements
be designated rather than money.
Senkler made motion, seconded by Jesinski to recommend approval of the preliminary plat
of Hugo Meadows to subdivde 24.75 acres, zoned SFU described as, part of the NEJ
or section 29, T31, R21W, subject to the following conditions;
1. A final survey be submitted to the council for approval within 120 days of pre-
liminary plat acceptance or the preliminary plat must again be reviewed by the
Planning Commisison at the property owners expense.
2. All conditions must be met prior to the stamping of any deeds for recording
by the city clerk unless otherwise permitted by the city council.
3. The property lines must be identified on site by the applicants to assure
proper setbacks when buildings are to be constructed.
4. Restrictive covenants be provided prhibiting the re -subdivision of platted lots
and the prohibiting of commercial activity in this subdivision.
5. Driveways or drainageways must include minimum 15" diameter corrugated metal
culverts in a manner acceptable to the city.
6. A final plat will not be approved until the required permits are secured from
the appropriate watershed district and the DNR where applicable.

7. All fees relating to this subdivision approval shall be paid by the applicant
including the cost of recording documents with Washington County.
8. Any driveway permits requiring access to highways or county roadways may not be
issued until permits are secured from Washington County or MNDOT.
9. Payment of the required parkland dedication and/or fees must be made at the time
of final plat approval. No significant deviations from the approved preliminary
plat shall be made unless reviewed by the planning commission. Street signs and
street lighting shall comply with city standards and the cost shall be born by the
developer.
10. No fences, structure, or trees shall be placed in on-site easements.
11. The cost of utilities extended to the site and all on-site improvements to be
born by the developer.
12. Utilities and other improvements become a part of the city system and must be
designed to city standards
13. Stormwater holding ponds and ditches must be approved by a watershed district
and maintained by the property owners(ownership to be determined by city attorney).
14. Developer agrees to participate in the cost of ditch cleaning as outlined in
development agreement.
15. The DNR must review and approve any disruption of designated protected wetlands
areas.
16. Public parkland be dedicated and conveyed by deed to the City of Hugo at a loca-
tion approved by the city council. Location to be such that it will allow for
the expansion of the park to a minimum of six acres in size in the future.
17. The final plat must comply with all requirements of the city subdivision ordinance.
18. Any connections to utility lines, to be installed, other than by the developer
is to be addressed in the developers agreement prepared by the city attorney
and city staff.

The planning commission also requests that the city petition the appropriate auth-
ority to reduce the speed limit on 8A to 35 Ales per hour from Highway 61 to
Goodview Ave. They also suggest contacting/ city attorney regarding liability of
the city rising from the development and specifically the ponding areas.
Bald Eagle Sportsmans Association - Special Use Permit Review - Mr. Mike Prokosch
was representing the gun club in Mr. Timm's absence. He stated that the club
is requesting two revisions in the special conditions regulating the club. The club
is located in the east } of the SWI of Section 33, T31, R21. A copy of their
schedule is provided in the file in the clerk's office and is available for review.
The club's request is to reinstate the muzzleloader shooting and to calcium chl-
oride Goodview Ave. once per year. Mr. Prokosch stated that at their meeting the
previous evening the possibility of extending the chloride was discussed and will
be decided at the next meeting. Neighboring residents reiterated their complaints
of busy roads, dust, shooting during off hours, and continued noise. Mr. Senkler
felt that noting two complaints through the year did not seem unreasonable and it
was suggested that at the time of the violation the residents notify the sheriff's
office. Mr. Schreifels felt that there was some discrimination with regard to the
muzzleloaders in that they are generally no louder than 12 guage shotguns. The
general concensus of the commission was that there were/s°ustantial complaints to
warrant the changing of any of the existing conditions.

Senkler made motion, seconded by Schreifels to recommend approval of the B.E.S.A.
Special Use Permit subject to existing 24 special conditions;
1. Any and all conditions of the Special Use Permit must be met within
6:; days, unless otherwise stipulated in this permit. If conditions
are not met, the Speciai Use Permit approval will be null and void
and a new application must be f lled out.
2. A sign listing the name, hours of operation, club and emergency
telephone number (911), be installed at the main gate. The safety
rules are to be posted on the sign, which shall be 4 x 8 feet
lateral dimension.
3. A legal fence to be maintained in a tight and upright condition.
Signs identifying the property be posted so that at no point is
there not a sign readable.
4. Membership not to exceed 350. An annual declaration of membership
shall be filed with the City.
5. The City of Hugo be provided with a current list of names, addresses,
and phone numbers of club's officers. This list should be filed
annually, or when there is any change of officers.
6. A min irmam of replacement trees be planted each year. A reforestation
plan shall be filed with the City and revised annually.
7. A range officer must be on duty at all times the club is opened to the public.
8. The club's hours will be as follows:
SUNDAYS
The club will be opened the last two (2) Sundays in September, and four (4)
Sundays in October. Hours of operation to be from 12 o'clock noon until
6:00 PM.
MONDAY THROUGH FRIDAY
Hours of operation — 8:00 AM until 8:00 PM
SATURDAY
Hours of operation — 10:00 AM until 5:00 PM
HOLIDAYS
The club will close Memorial Day weekend, Labor Day weekend, and the week
of the 4th of July.
9. Unlimited use of off hours on the days the club is authorized to be opened
for youth groups and firearm safety programs. Limited to 22 caliber rimfire.

10. Impulse noise levels shall at no time exceed the levels to be drawn up by
the Pollution Control Agency. The City of Hugo keeps the option of setting
more restrictive levels, if needed, because of the general quiet nature of
the City.
11. The owners shall have sixty (60) days from the date they are notified that
they exceed these standards to prepare and submit to the City Council and
Planning Commission, detailed plans for abatement of noise so that the
operation will be brought within the required standards. Once the plans
are approved by the City Counci v
, the owners will have six (6) months to
ca -p fete construction in accordance with the abatement plans so approved.
12. At no time shall there be a change in the physical operation of the club
without notification to the City, and at no time shall the current size
of the physical operation of the club be increased.
13. The 200 yard range to be discontinued at its current location. The 200
range may be reinstated only after approval by the City.
14. Should the City Council determine that any of the conditions of the Special
Use Permit have been violated, and that said violation has not been cor-
rected within thirty (30) days of notification of the property owner of said
violation, the City Council shall schedule a public hearing, with notice to
the owners, to consider the violation or violations, and thereafter may
suspend, modify, or revoke the Special Use Permit, giving reason for the
action taken.
15. The facility may open to the public only on Saturdays and Sundays. At all
other times, use of the facility shall be limited to members and their
immediate families; and bonafide guests, which shall not exceed three (3)
guests per member present.
16. The club shall file, with the City, its scheduled operations as it relates
to all Sunday activities, and to any regularly scheduled events within the
facility, in March of each year. The City shall be notified, at least
ten (10) days in advance of any Sunday during.which extended hours will
be used.
17. The owners shall hold the City of Hugo harmless from any loss, expense,
damage, incuding reasonable attorney's fees, that may be incurred as a
result of granting the within Special Use Permit.
18. The owners shall provide the City with a performance bond, in the amount
of $5,000.00, to insure maintenance of the physical facilities in the
condition herein outlined.
19. The Special Use Permit shall be reviewed on an annual basis.
20. The existing facilities are as shown on Exhibit A, and shall not be changed
as herein provided.
21. Muzzleloaders will not be permitted to use the facility.
22. The BESA will absorb the cost to calcium chloride Goodview Avenue approxi -
irately 8/10's mile.
23. BESA will provide the names of three people responsible for maintaining
the rules of the club so that they can be contacted in case of any rule
infraction. The club will provide a copy of their shooting schedule to
any neighbor requesting a copy. A copy to be provided to City Hall as well.
24. Two days, in both July and August, will be designated as DCM shoot days.

Ron Gray - Special Use Permit/Variance - Ron and Brenda Gray have made application to
the city for a special use permit and variance to allow for the construction of a 4'
high cyclone fence on their property. Said fence is to be located 14' from the 147th
St. right-of-way and 44' from the Foxhill Ave. right-of-way. Property in question
is zoned SFU and is generally described as Lot 1, Block 1, Husnik's Two Inches Subd.
(aka 14740 Foxhill Ave.) Mr. Gray is also requesting a variance to allow for an 8'
X 20' addition to his existing garage located off 147th St. This request exceeds
the 720 sq. ft. garage requirement by approximately 160 sq. ft. Mr. Gray has indicated
that the fence will help keep his children in his yard and off the road and the addi-
tion to the small garage will be used for persona storage. The only concern of the
city staff is that the fence be constructed so as not to obstruct visibility from
Foxhill Ave. No. and 147th St. The city staff would recommend special conditions
should the commission recommend approval.
The planning commission could not find sufficient hardship to the land to recommend
a variance for the construction of the garage addition. It appears that the storage
space could be located anywhere on the property. The issue of the fence was slightly
different in the enormous excavation would have to occur to comply with the fence
ordinance without a variance.
Blanchard made motion, seconded by Jesinski to recommend approval of the SUP
for Ron Gray to install a 4 ft. cyclone fence at 14740 Foxhill Ave. as specified
above.
All aye, motion carried.
Motion made by Senkler, seconded by Rudisill to recommend denial of the Variance
for Ron Gray for the 8' X 20' addition to his garage because of a lack of hardship,
property located at 14740 Foxhill Ave.
All aye, motion carried.
Richard Schuh - Mining Permit Review_ /Special Use Permit - Mr. Schuh was unable to
attend the May 27, 1987 meeting.
Motion made by Rudisill to table the Schuh application until the meeting of June 24,
1987.
All aye, motion carried.
The Planning Commission will hold a comprehensive plan meeting June 10, 1987, 7:OOPM.
