The regular meeting of the Planning Commission was called to order by
Chairman Senkler at 7:02PM.
PRESENT: Sullivan, Jesinski, Henry, Senkler, Carole LaBelle
ABSENT: Olson
Mr' Senkler informed other members on the commission of Doug Blanchard's
resignation.
A hearing was held to consider the request of Steven Downs.
Mr. Steven Michael Downs has made application to the City of Hugo for a
Special Use Permit to construct a 24' X 28' garage/accessory building on
Lots 5 and 6, Block 6 Hugo Addition (aka 14617 Finale Ave.). A special
use permit would allow for a total of 952 sq. ft. of accessory buildings
on Lots 5 and 6, Block 6. Mr. Downs has indicated that the building would
be used for residential purposes to store two motor vehicles and other-
miscellaneous
thermiscellaneous items' The property in question is zoned SFU and is
currently used for residential purposes. This matter was tabled at an
earlier meeting of the Hugo Planning Commission directing Mr. Downs to
clarify the exact lot width of the two lots in question. Mr. Downs is
treating the property in question as a single parcel and the proposed
building appears to meet the required setbacks if both lots are to be
treated as a single parcel and said lots front on Finale Ave. The
property does not meet the 130 ft. depth requirement, however, these lots
were platted prior to the adoption of the City zoning ordinance' We would
recommend that if the Planning Commission acts to approve this special use
permit that it be subject to special conditions.
Mr. Downs stated that his home has a stucco exterior and the accessory
building would be a wood grain siding, complimentary to the house. Mr.
Downs agreed that the two lots would be considered one lot.
Motion made by Henry, second by Jasinski to recommend approval of the
Special use permit for Mr. Steven Downs, 14617 Finale, to construct a 24'
X 28' garage/accessory building for personal storage with the following
special conditions;
1. The garage be designed and built similar in appearance to the house.
2. The garage be used for residential purposes only.
3. Lots 5 and 6, Block 6 be dealt with now and in the future as one
parcel of land.
4. The building be constructed in compliance with the building codes and
this permit within 180 days of SUP approval.
All aye, motion passed.
Mr. Downs has requested that this matter be placed on the December 7, 1987
City Council agenda.
Special Use Permit )
Ricky and Lori Flanagan have made application
to the City of Hugo for a
Special Use Permit to operate a landscaping and
lawn maintenance business
on their property located at 6319 175th St. No.,
Hugo (the east 330 ft. of
the west 538 ft. of the north 660 ft. of the
SW quarter of Section 4,
WIN, R21W, except the east 165 ft. of the west
538 ft. of the north 660
ft. of the SW quarter of Sec. 4, T31, R21.).
The petitioners have
indicated the property in question will continue
to be residential in
character although they would like to operate
a business on a limited
basis from their home. The property in question
is located in an
agricultural zone and landscaping businesses
are allowed by SUP. In
reviewing the legal description on the application
it does not appear to
conform with the site plan or the legal description
on the City's tax
records. The property appears to be 165 ft.
in width and approximately
538 ft. in depth Of acres). If the Planning
Commission chooses to act
favorably on this request we would recommend
said approval be subject to
special conditions.
A hearing was held for public input regarding
this special use permit
request. Mr. John Jungman, 6351 175th St. was
present and stated that he
is the only neighbor and has no objection to
the landscaping business
being operated from the Flanagan's home'
Mr. Flanagan stated that this is his full time
employment and it is
seasonal. His equipment consists of two pick-up
trucks, 2 trailers, weed
eaters, edgers, 1 18 HP tractor, shrubbery, sod,
seed. His business is
named "Yard Care" and the pictures provided with
the Natural Green truck
does not belong to Mr. Flanagan. Occassionally
Mr. Flanagan drives the
large Natural Green truck to his home for overnight
storage while on his
way to a job in the northern suburbs. This occurs
on an average of 3
times per month. Mr. Flanagan agreed that if
this were to change were
proposed he would secure an amended special use
permit. Mr. Flanagan
stated he did not use any chemicals in his business.
The material sprayed
is grass seed and water. Mr. Flanagan stated
that his truck and trailers
do remain outside, while all small equipment
used in the business is
stored in the accessory building.
Commission members felt that if the operation
of this business was a
serious problem for the complainant, he should
have attended the meeting
to express his concern. Mr. Senkler felt it
would be beneficial to limit
the size of the vehicles to be stored on the
site overnight, however, this
is virtually impossible to monitor. Members
had no objection to the
operation considering the size of the business.
Motion made by Sullivan, seconded by Jesinski
to recommend approval of the
Special Use Permit for Rick and Lori Flanagan
to operate a landscaping and
lawn maintenance business from their home at
6319 175th St. No., Hugo,
with the following conditions;
1. No advertising be permitted on site.
2. All equipment be stored in existing garage on site.
3' Any materials stored on site other than landscaping stock be located
to the rear of the garage in a screened area approved by the City.
4. Any modifications to the enclosed site plan be approved by an amended
special use permit.
5. Activities on site other than residential be limited to landscaping,
lawn maintenance business.
6. No additional accessory buildings be constructed without first
securing a building permit.
7' The use of this property shall not be in violation of any existing
restrictive covenenats.
B. All activities on site shall not cause the altering of any
watercourse, ditch, or drainage system in this area.
9. The storage of any chemicals on site must be in an enclosed structure
and must be in compliance with all state and county health/safety
regulations. Copies of the types of chemicals being stored and location
of said chemicals must be filed with the City of Hugo Fire Marshall.

Seuss)Subdivision Request (Tom Caruth/Fred
Mr, Tom Caruth and Mr. Fred Seuss have made application to the City of
Hugo for the Subdivision of approximately 58.5 acres into two lots, one of
ten acres in size and one of 48.5 acres. The property in question is
generally described as the east 1/2 of the SW 1/4 of the SW 1/4 of the SW
1/4 of Section 8, T311 R21W, except that part described as follows; The
west 721 ft. of the north 1201.65 ft. of the NE 1/4 of the SW 1/4 of
Section 8, T31, R21W. The applicants are requesting waiver of the formal
subdivision requirement to divide this property by certificate of survey.
If the commission acts to approve this subdivision we would recommend it
be subject to special conditions.
Mr. Seuss has purchased the property and is seeking financing and is
requesting to subdivide 10 acres for mortgage purposes. Mr. Seuss
indicates he is not intending to sell any of the property. Commissioners
did not feel this subdivision was objectionable.
Motion made by Jesinski, seconded by Henry to recommend approval of the
request for subdivision for Thomas Caruth and Fred Seuss to subdivide 58.5
acres into one 10 acre parcel and one 48.5 acres subject to the following
conditions;
1. The final survey meet all administrative requirements.
2. The final survey must be submitted to the Council for approval within
90 days of preliminary acceptance or this approval will be null and void.
3' All of these conditions must be met before the stamping of any deeds
for recording by the City Clerk unless otherwise permitted by council
action.
4. All property lines must be identified on site by the applicants to
insure propert setbacks when buildings are to be constructed, if required
by the building inspector.
5. All driveways and drainage areas must include installation of minimum
15" diameter corrugated metal culverts in a manner acceptable to the City'
6. All fees relating to the subdivision approval shall be paid by the
applicant including the cost of recording documents and parkland
dedication.
7. On site activities permitted as a result of this subdivision shall not
cause the altering of any watercourse, ditch, or drainage system in this
area.

Mr. John Kostuch and James Olson have made application to the City of Hugo
for the rezoning of a 7 acre +- tract of land from Industrial to SFU to
accommodate the proposed subdivision plat identified as Sunny Creek
Acres. The tract of land in question is described as That part of Lot 35,
of County Auditor's Plat No. 7 being the North 859.61 ft. of the south
1,224.2 ft lying easterly of the west 452.2 ft. measured along the south
line easterly from the southwest corner of the southwest quarter of
section 20, T31, R21W in Hugo, Washington County, Minnesota. The
subdivision of this property will provide consistency with regard to the
zoning districts in proposed Sunny Creek Acres. The applicants have
indicated that there is an adequate amount of vacant industrial land in
the City and would like to develop the property in question for
residential purposes. The property north, east, and south of the tract in
question is zoned industrial, the property west of this tract is zoned
SFU. The property owned by Mr. Olson which is a part of this request
could be served by utilities at the time improvements are installed for
Proposed Sunny Creek Acres.
Motion made by Henry, seconded by Sullivan to recommend approval of the
rezoning for John Kostuch and James Olson to rezone approximately 7 acres,
as described above from Industrial to SFU.

1pecial Use Permit (Todd BeegrQ11.
Mr. Todd Beecroft and Mr. Paul Beecroft have made application to the City
of Hugo for a special use permit to operate a landscaping business on
their property generally described as the west 278.7 ft. of the east 460.2
ft' of the west 1/2 of the sw 1/4 of the sw 1/4 of Section 6, T31N, R21W,
Washington County, Minnesota consisting of approximately 8.5 acres' The
property in question is zoned agricultural and landscaping businesses are
permitted in an agricultural zone by special use permit. Mr. Beecroft is
also requesting authorization to install an advertising sign on the site
in question as indicated on the proposed site plan. Mr. Beecroft is also
proposing the construction of a 17' X 20' greenhouse made of hoops and
poly plastic. Reviewing this plan was somewhat difficult in that Mr.
Beecroft did not dimension the site plan as required. Mr. Beecroft also
identifies a proposed 17' X 20' greenhouse, however, photographs of the
site indicate that there is already a structure at that location. Mr..
Beecroft also proposes the installation of two 4' X 8' signs on the site
but does not indicate what the signs will look like and how they will be
maintained. We would recommend that the Planning Commission members visit
the site in question and look at the proposed signs as designed by Mr.
Beecroft. If the Planning Commission chooses to approve this special use
permit we recommend it be subject to special conditions.
Mr. Beecroft indicated he would be using the property to replant small
trees and shrubs for use in landscaping jobs away from the site. The
greenhouse would hold flowering and green plants. Paul Beecroft stated he
did not intend to sell retail. Mr. Beecroft also stated he had no
objection to removing the lights which had been on the signs in the
landscaped area of his yard, if his application is approved for the
signs. Mr. Beecroft stated he did not use chemicals of any kind but would
provide a list of chemicals if they were used in the future' Equipment
used in the"business includes one F350 dump truck, saws, shovels. All
equipment with the exception of the truck is kept inside.
Mr. Henry had reservations regarding the placement of advertising signs in
a residential area for a commercial business.
Motion made by Henry, seconded by Jesinski to recommend approval of the
special use permit for Todd and Paul Beecroft to construct a 17' X 20'
greenhouse and operate a landscaping business at 9365 122nd St. subject to
the following special conditions.
AYE: Henry, Jesinski, Senkler
NAY: Sullivan
Motion passed
Motion made by Senkler, seconded Sullivan to recommend approval of the
Special use permit to install two 4' X 8' advertising signs at 9365 122nd
St. subject to the following special conditions.
AYE: Senkler, Sullivan, Jesinski
NAY: Henry.
Motion passed.
1. All equipment storage and parking be located behind the house and on
the driveway running to the existing 22' X 27' shed located on the
east property line.
2. Landscaping and greenhouse facilities be located as identified on the
approved site plan and changes or additional buildings must be
approved by amended special use permit.
3. The proposed signs must be located where identified on the site plan
and must be maintained in a manner acceptable to the city at all
times.
4. No lighting shall be permitted on the advertising signs.
5. A landscaping plan for the area around the signs must be prepared and
said landscaping installed no later than May 1, 1988.
6. All activities on site shall be limited to those customary
to a
greenhouse and landscaping business and no retail
sales will take
place on site.
7. No structures and facilities may be added to the site
in question
without first securing a building permit.
8' On site activities permitted shall not cause the altering
of any
watercourse, ditch, or drainage system in this area.,
9' This permit must be submitted to the City Council
for approval within
90 days of Planning Commission recommendation'
10. Failure to comply with all conditions of this special
use permit shall
be grounds for permit revocation.
Auto Dismantlinq License )
Representatives of Modern Auto Parts of Hugo had been
requested to appear
before the commission to discuss some of the activities
taking place on
his site with regard to construction of dikes and ditches
and their impact
on stormwater drainage in this area. Mr. Dupaul was also
requested to
provide water samples on site and said water samples as
of yet have not
been submitted to the City. The City also requested that
Mr. Dupaul
provide a detailed site plan of his facility. The activities
of Mr.
Dupaul have been reported to Rice Creek Watershed District
and an
investigation with regard to said activities is currently underway.
Mr. Dale Eklin, from Rice Creek Watershed informed the
City that all
digging activity had ceased during the summer when he
investigated this
matter. Mr. Dupaul is aware he must obtain a permit from
RCWD for
excavating. Mr. Dupaul stated that his test well had
been run over and as
soon as the reorganization of the yard was complete he
would install a new
test well. All specifications were provided to him by
Washington County'
Mr. Dupaul has all hazardous waste material stored in
compliance with the
DNR and Washington County Health Department.
Motion made by Senkler, seconded by Sullivan to recommend
approval of athe
continuation of the Auto Dismantling License for Roger
Dupaul, Modern Auto
Parts, 16813 Forest Blvd. subject to all existing conditions
and a
dimensioned site plan, drawn to scale be provided to the
City Council
prior to the November 2, 1987 meeting. Including the installation of a
new monitoring well, with test results to be provided
at the next annual
review.
All aye, motion passed.
Mr. Henry indicated that he feels a member of the staff
or city official
should contact the PCA to be advised on the standards
and recommendations
for test wells similar to those required by the auto dismantling
operations. The concensus was that even when the information
is acquired
no one has the knowledge to interpret the results. This
discussion may be
continued at an �pcoming meeting.
Motion made by Jesinski, seconded by Sullivan to adjourn at 9:17PM.
