November 18, 1987
The regular meeting was called to order by Chairman Senkler at 7:03PM.
PRESENT: Sullivan, Henry, Senkler, Jesinski, Administrator Huber,
Carole LaBelle
Motion made by Jesinski, seocnded by Sullivan to approve the minutes of
October 29, 1987.

Ms. Jeanette Pfurtsheller has made application to the City of Hugo for a
Special Use Permit to board horses on their property located at 8745 122nd
St., Hugo. The property in question is zoned RR2 and consists of
approximately 16.9 acres. The permit to construct the 30' X 48' pole
building to house the animals in question was approved by the city October
of 1986. When this structure was approved, it was specified that the
building was not to be used to house animals. The applicants are now
requesting that this building be used to house animals, although they have
failed to specify how many. It is our understanding that the applicants
have proceeded with the remodeling of the building in question and that
the required building permit to make such modifications has not been
secured. If the Planning Commission chooses to approve the special use
permit in question we would recommend said approval be subject to special
conditions.
Mr. Huber informed the commission that the language on the building permit
issued in October of 1986 was to inform the applicants that animals
require the issuance of a special use permit to be kept in an RR2 zone.
Mr. Bill Simonet representing Ms. Pfurtscheller and stated they had
inadvertently neglected to obtain the building permit for construction
within the pole building. He stated that there is a designated area next
to the existing pole building used as a pasture/corral. The corral is
approximately 1 acre in size and surrounded by electric fencing. Mr.
Simonet state that there would be no advertising signs on the property.
The animals are and will be kept the required distance from the
lakeshore. Mr. Simonet stated that there is no commercial operation
taking place, and the city would be allowed on the premises for inspection
to insure the continuance of all requirements.
The public hearing was attended by Mike Ball, 8715 122nd St. and Jo
Lovegren, 8355 122nd St. who opposed the addition of animals into the area
surrounding the lake. Mrs. Lovegren has had numerous conversations with
the DNR and found that the runoff from pastures has a negative effect on
the quality of the lake water. Mr. Ball stated that the easement
providing access to the Pfurtscheller's property crosses his property and
the additional traffic generated from the boarding of horses at
Pfurtscheller's would be detrimental to the roadway.
Mr. Glen Bjornson felt that the animals would not be harmful to the lake
or the environment and that the real problem was the speed boats on the
lake.
Mrs. Pfurtscheller stated the animals are hay fed and each of the three
boarders buy their own feed. The people boarding horses are friends or
relatives of the property owner and the owners receives no consideration
for keeping of the animals.
The question of animal feces disposal was raised and the applicant stated
that removal from the property would be possible.
Motion made by Sullivan, seconded by Henry to recommend approval of the
Special Use Permit for Jeanette Pfurtscheller, to board horses at 8745
122nd St. subject to the following special conditions.
1. Animals be restricted to the area identified on the site plan and no
animals be allowed to graze within 500' of the Round Lake shoreline.
2 Permit approval shall be subject to the approval and recommendations
from the state Department of Natural Resources.
3. Double permit fees be charged for proceeding with this land use and
construction prior to securing the required permits.
4. A building permit must be applied for within 30 days of special use
permit approval for remodeling work: done without required permit.
5. A fully dimensioned site plan must be provided showing the precise
location of buildings and corral area for future reference.
6. Any resubdivision of the 16.9 acres in question shall render this
permit null and void.
7. No advertising signs shall be permitted on site.
G. All fees relating the review and issuance of this permit shall be paid
by the applicant including the cost of recording this permit with
Washington County.
9. All activities shall not cause the altering of any watercourse, ditch,
or drainage system.
10. The applicant must provide access to the referenced site for periodic
inspections to assure conformance with this permit.
11. Any revisions to the approved site plan must be reviewed by the
Planning Commission and approved by the City Council.
12. Number of animals on site shall be limited to horses and shall not
exceed 6.
1:. No commercial use of this property shall be permitted.
14. All applicable conditions of this special use permit must be met
within ..30 days unless otherwise stipulated in this permit. If these
conditions are not met the permit shall be null and void.
15. Animal feces to be disposed of a minimum of 500' from Round Lake
shoreline.

Mr. Ray Olson submitted his letter of resignation from the Planning
Commission because of conflicts with work.
Motion made by Sullivan, seconded by Henry to adjourn at 7:52PM.
