PRESENT: Bob Olson, Schoeller, Granger, Fashingbuaer, Rudisill, Ray Olson, Atkinson. Motion made by Ray Olson to approve the minutes of January 22, 1986 as submitted, second by Atkinson. All aye, motion carried. The regular meeting was recessed and the public hearing for Vern Peloquin called to order at 7:05 PM. Vern Peloquin - Subdivision - Mr. Peloquin would like to divide 5.8 acres to be sold to Twin Pine Trailer Park for expansion of the park. The property was rezoned prior to the subdivision application. A letter from Fred Rierman, owner of American Structural Steel was read, stating he has no objection to the ex- pansion as long as residents are aware of the noise factor involved with living in that portion of the park. The Peloquin public hearing was recessed at 7:20 PM. The public hearing for Cal Garley was called to order at 7:30 PM. Cal Garley - Public hearing - Joyce Merwin was representing Mr. Garley and noted work he had done in Shoreview. She recommended contacting them for references. They are proposing six sites for building. Residents concerned with the proposed subdivision included, Vern Peloquin, Sterling Ashby, Oneka Lk. Blvd., Howard Moe, Dennis Schultz, 13101 Henna, Kathy Ashby, 5980 Oneka Lk. Blvd.. Primary concerns were the water problem north of Oneka Lake Blvd., the plugged culverts at Geneva and 147th, and whether the property would be sold or rental units. The Garley public hearing was closed and the Schumann public hearing called to order at 7:52PM. David Schumann - Public hearing - Mr. Schumann would like to continue his existing auto dismantling business being conducted at 7630 132nd St. No special use permit has been issued in the past. Mr. Schumann used a topographic map to show the area which he would be using to continue his operation which is in a low area a distance from the road. Residents in attendance; Bill Hansen Dennis Schultz Kendall Lorch Wayne Rood Dick Houde 7525 137th St. 13101 Henna 15608 Homestead 12899 Henna 7695 137th Concernsof the neighbors were the unsightliness of such an operation, dangers to area children, pollution to water, other environmental hazards, advertising Planning Commission February 12, 1986 page 2 signs in a residential area, and that the permit (if issued) to be confined to one parcel. Fencing would be one primary concern for area residents if the operation would continue. Mrs. Schumann felt that the residents were misinformed regarding the business. She stated that it would be a small operation with few auto's, no employees, and that many load of debris had already been removed from the property. They have lived on the property for two years and have worked to eliminate the accumulation of refuse. The Schumann public heairng was closed and the regular meeting called to order at 8:45PM. Vern Peloquin - Subdivision - Motion made by Ray Olson, Seconded by Schoeller to recommend approval of the application for subdivision of 5.8 acres north of Twin Pine Trailer Park by Vern Peloquin. All aye, motion carried. Motion made by Atkinson, seconded by Rudisill to recommend to the City Council that this subdivision be handled as a full subdivision with hardshell require- ments. AYE: Bob Olson, Grnager, Rudisill, Atkinson NAY: Schoeller, Fashingbauer, Ray Olson Motion carried. Cal Garley - Subdivision - Motion made by Rudisill, seconded by Fashingbuaer to recommend approval of the plot plan, comceptual approval only. All aye, motion carried. Hardshell would be required for final approval. David Schumann - Special Use Permit - It was the general concensus of the commission that this use would not be conducive to the area. That it is generally unsightly and potentially hazardous to the neighborhood. Rudisill quoted Minn. Statute 161.242, Junkyard Act. Mrs. Fashingbauer felt because of its existence for a number of years some special consideration should be given and that a non- transferrable permit might be issued. Motion made by Rudisill, seconded by Atkinson to recommend denial of the Special Use Permit application by David Schumann to continue an auto dismantling op- eration at 7630 137th St., Hugo., because the proposed facility is capable of causing detrimental effects on the physical and economical well being of the neighboring properties. Motion made by Schoeller, seconded by Ray Olson to amend the previous motion to say it is inconsistent with the area. AYE: Bob Olson, Schoeller, Granger, Rudisill, Ray Olson, Atkisnon NAY: Fashingbauer Vote on original motion with amendment to deny Schumann special use permit; AYE: Bob Olson, Schoeller, Granger, Rudisill, Ray Olson, Atkinson NAY: Fashingbauer Rudisill's comments on decision found at end of minutes. Motion carried. Lloyd Chalupsky - SUP - Mr. Chalupsky would like to fill Lot 3, Block 1, Royal - haven Estates with material from Lot 9, Block 2. Aletter from Howard Kuusisto was reviewed and this matter is on the Rice Creek Watershed agenda for Feb. 24, 1986. Atkinson made motion, second by Fashingbauer to recommend approvel of Lloyd Chalupsky's request for a Special Use Permit to fill Lot 3, Block 2, Planning commission Feb. 12, 1986 page 3 with material from Lot 9 as per plan submitted including silting fence, with the following conditions; 1. a $300.00 deposit is required. 2. Ten foot drainage easement dedicated to the City of Hugo along each property line, north and south, from the lake to the road (Lot 3). 3. Perc test and drainfield location should be determined before buidling permit is issued. 4. a hold harmless clause to the City of Hugo to cover any damage resulting from the filling. 5. foundation to be on undisturbed land. 6. All slopes should be 3 to 1 or greater 7. Maintain or establish outlet as proposed on plan. 8. A permit be received from RCWS. 9. An appropriate bond for compliance or existing bond to be released when work is completed (bond to represent lots 3 & 9) 10. Work is to begin within one year. All aye, motion carried. Verna Larsen - Subd - Mrs. Larsen received the letter signed by Strandberg's who are the fee owners of the property. Mr. Atkinson felt this letter and the copy of the deed in the file would serve as proof of ownership. Motion made by Schoeller, seconded by Atkinson to recommend approval of the sub- division for Verna Larsen/Strandbergs as per plot plan dated 2/12/86. All aye, motion carried. Motion made by Atkinson, seconded by Bob Olson to recommend waiving the hardshell requirement. all aye, motion carried. Fashingbauer left at 10:20 PM. Jim Howe - SPA - The application was received at the meeting. This matter was tabled until March 12, 1986 to give the commission an opportunity to view the property because there are currently a number of buildings on the property. Motion made by Granger, seconded by Schoeller, to adjourn at 10:35 PM. Carole LaBelle, Secretary Hugo Planning Commission Planning Commission Feb. 12, 1986 page 4 Rudisill comments; Therefore I feel it is only reasonable to apply the same legislative definitions to this application (David Schumann, 7630 137th St.). Even though this proposed auto dismantling yard is not on a trunk Highway. 1. I feel it would be detrimental to the value of the existing neighboring properties. 2. I feel the appearance of an auto dismantling yard; even with screening is incompatable with the existing neighboring properties. 3. Located at the top of the water supply system for the metro area there will be a potential possibility of surface and ground water contamination.
