PRESENT: Bob Olson, Rudisill, Fashingbauer, Atkinson ABSENT: Schoeller, Ray Olson Motion made by Rudisill, seconded by Bob Olson to recommend approval of the Minutes of May 14, 1986, with the following corrections; John Tembreull - should not read, "accomplish division". Motion made by Rudisill, seconded by Ray Olson to adjourn at 10:45 PM. All aye. All aye, motion carried. The regular meeting was recessed and the Rust public hearing called to order at 7:05PM. Rust - Public hearing - SUP - Mr. Rust is currently operating a small nursery business at his residence, 12280 Goodview. The property would be used solely as a storage area for mulch, chips, stones, and plant material. The hours of operation are from approximately 7:00 AM - 7:OOPM. Jim Bjerkness stated he had no objection as long as there was no work done on Sunday and that equipment used would be no larger than a Bobcat. Mr. Rust had also agreed to plant some evergreens on the property line between themselves and the Bjerkness property. Dan Ford and Ron Sako, both of Goodview Ave. were concerned about the increased heavy weight traffic on the road. Mr. Rust informed them they use a one ton dump and one flat truck. There was concern about how large the operation would be allowed to get. The regular meeting was reconvened and the public hearing for Rust adjourned at 7:26PM. The regular meeting was recessed and the public hearing for Nygren called to order at 7:30PM. Zap Games - Nygren - Mr. Nygren and his partner have applied for a special use permit to operate a capture the flag game. The games are conducted in Agriculture land belonging to Chris Molitor and Martin Wegleitner. Participants are required to wear eye protection, and are provided ear plugs. The games are played in three hour intervals and air pistols with a range of approximately 100' are used. There are sanitary facilities at the sights. Maps are provided and the possibility of bussing players from one location was discussed. Months of operation would be generally April through November. Concerned residents were Sandy Malaski, Dan Ford Bob Oswald, Maurice Marvin, and Ed. Fashingbauer. Residents felt there would be large numbers of people traveling the roads, the area should be fenced, and gen- erally was too dangerous. The public hearing was adjourned and the regular meeting reconvened at 8:02PM. The Weber public hearing was called to order at 8:02PM. Weber - Public hearing - rezoning & subdivision - James and Diane Weber own approximately 16 acres on the east shore of Oneka Lake and would like to rezone Planning Commission Minutes May 28, 1986 page 2 Weber - cont. and subdivide into a six and ten acre parcel. There was no public to comment. The Weber public hearing was adjourned and the regular meeting called to order at 8:12PM. William Rust - SUP - Motion made by Rudisill, seconded by Atkinson to recommend approval of the Special Use Permit for William Rust, 12280 Goodview to operate a commercial nursery at his residence with the following conditions; 1. Hours of operation should be from 7:OOAM - S:OOPM monday through Saturday. 2. Screening to be planted for neighbors to the south. 3. Delivery of rock should be only after a freeze in late fall. 4. No vehicles larger than a bobcat. 5. Calcium chloride to be applied twice a year. 6. Only three employees on the premises. Rudisill amend motion to eliminate number 5, Atkinson seconded. Rudisill amends motion to increase employees to 6, Atkinson seconded. 6. Special Use Permit should be on an annual renewal basis. AYE: Fashingbauer, Rudisill, Olson. NAY: Atkinson. Motion carried. Zap Games - The general concensus of the Commission was that this activity would create too much traffic, attract undesireable participants and the possibility of injuries was too great. Mr. Atkinson did not feel there was any real reason to deny such a permit and the property owners should be allowed to use their property as they choose. The applicants have stated they currently have full insurance coverage and liquor is strictly prohibited, and that some car pooling is already being done. Atkinson points out that the activity has been going on for over a year and there have been no comments by residents. Atkinson made motion, seconded by Rudisill to recommend approval of two Special Use Permitsto Zap Games Inc. to operate at two locations, 7040 132nd St. and 6063 145th St. with the following conditions; 1. All participants will be required to wear eye and ear protection. 2. Number of participants on any field at any given time be limited to 30. 3. No alcoholic beverages or drugs and anyone intoxicated will not be allowed to participate. 4. Off street parking shall be provided for all participants. 5. Satellite or equal typeof facilities be provided at both sites. 6. $300,000 liability insurance shall be kept in force at all times games are operating. 7. No one under 18 years of age will be allowed to participate. 8. No Trespassing signs shall be installed on the perimiters of the playing areas and operators shall instruct participants to confine their games to the approved areas. Failing this, the City reserves the right to require fencing at some future date if damage to surrounding property becomes a problem. 9. No game shall be allowed when the temperature is 40° or lower. 10. Applicants draft a hold harmless agreement in favor of the City of Hugo to indemnify and protect the City against lawsuit arising out of these activities. AYE: Atkinson. NAY: Fashingbauer, Olson, Rudisill. Motion failed. James & Diane Weber rezoning - Rudisill made motion, seconded by Fashingbauer to Planning Commission Minutes May 28, 1986 page 3 Weber - cont. recommend approval of the Rezoning of 16 acre from Ag. to RR2 and subdivision into a six and ten acre parcels. All aye, motion carried. Atkinson made motion,&Seeoopdtdca eRudisury to recommend approval of subdivision by legal description/only as opposed to a Ull plat. All aye, motion carried. J. Clemas - E & J Auto - Ernie Voigt is requesting a special use permit to perform light body and mechanical work in the building currently known as Mid American Metals. E & J indicated they work on approximately 10-12 cars per month. All work would be done inside the 6,000 sq. ft. building. Their work schedule is 8-5 Monday through Friday. Motion �mde by Rudisill, seconded by Olson to recommend approval of the Special Use Permit for E & J Auto to perform light mechanical and body work at 15657 Forest Blvd. with the following conditions; 1. No more than 8 vehicles be stored in fenced area. 2. No signs indicating retail sales or for sale signs allowed. All aye, motion carried. Richard Schuh - annual review of Mining permit - Mr. Schuh stated that the Duraine pit has been closed and restored as required. He is applying for a permit to operate the Goiffon and Hansen pits. Residents attended to voice their concerns about past violations which include speeding trucks, burning brush without a permit, hauling in material, toxic spills, extended hours of operation. Residents included, Kris Renu from, Tom & Cookie Haas, R. Malaski, Sonja Irlbeck, Gene Schultz Herb Forthuber, D. Wilske, Jim Ramacier. The general feeling of the Commission/mat there should be some steps taken to insure compliance of all regulations. Motion made by Atkinson, seconded by Rudisill to recommend approval of the Mining permit for Richard Schuh to operate the Hansen and Goiffon pits with separate per- mits being issued for each pit with the following added conditions (also including conditions from previous years permit): 1. Operator shall be required to repave Irish Ave. from access point to 8A prior to the end of this construction season. 2. Goiffon permit shall be amended to include permission to haul in used bituminous material for recycling. AYE: Olson, Rudisill, Atkinson. NAY: Fashingbauer. Motion carried. Olson made motion, seconded by Atkinson to recommend that Mr. Kuusisto make more frequent visits to the site to check the condition of the pit and necessary re- quirements are being adhered to. Also that the sheriff's department be asked to weigh the trucks and check speeds with radar equipment. All aye, motion carried. Mr. Erickson from Anderson Bros. Construction is requesting a variance from the normal 7:OOAM - 7:OOPM operating limits because of restricted working hours dic- tated by the state. Work to be done is on 35W west of Hugo. Mr. Erickson informed residents that the generator used is enclosed in a trailer and they are invited to inspect to operation to reassure themselves that no contamination of the ground occurs. He also stated that they would be willing to repave Irish Ave. His com- pany video tapes all haul roads to insure restoration. Approximately 20-23 truck loads of material would be hauled from the site. Erickson stated that fuel oil is used for coating the boxes of haul trucks and a minimal amount for final cleaning of equipment with all refuse oil being run into a pond which is lined with a vinyl material. Rudisill made motion, seconded by Fashingbauer to recommend approval of the hot mix Planning Commisison Minutes May 28, 1986 page 4 Shuh - Anderson plant for Anderson Construction of Brainerd to operate out of the Schuh pit. Hours of operation from 7:OOPM to 7:OOAM for the first ten days and the balance approximately six days, approximately S:OOAM to 9:OOPM Monday through Saturday (maximum of five work days) and further extension shall require an application to the City. This permit will apply to the Hansen pit and includes hauling in 11,000 tons of granite chips for 35W project and will be eliminated at the end of said project. All aye, motion carried. Karla Hancock - SUP - Hancock's request permission to construct a pole barn and horse barn which is zoned RR2 and Agriculture. They currently own three horses and also require aiSUP for animals on RR2 property. This is 30.76 acres recently subdivided at the intersection of 125th and Hilo. Motion made by Atkinson, seconded by Olson to recommend approval of the/application for Karla Hancock to construct a 30 X 60 barn and a 63 X 40 pole building on 30.76 acres (Yocum) as per site plan. All aye, motion carried. Motion made by Atkinson, seconded by Fashingbauer to recommend approval of the SUP for Karla Hancock to keep horses in RR2 with the following condition; 1. No more than ten horses regardless of the zone on the entire 30.76 acres. All aye. Motion carried. Keith Harstad - Kenneth Briggs presented a revised plan to subdivide property along Egg Lake Road to include approximately 48 new homesites. A public hearing was scheduled for June 25, 1986 7:30PM.
