PRESENT: Bob Olson, Ray Olson, Rudisill, Schoeller, Atkinson ABSENT: Ann Fashingbauer MOTION: Rudisill made motion, Bob Olson seconded, to approve the minutes of July 23, 1986, as submitted. All aye. Motion Carried. KEITH HARSTAD The public hearing to consider the request of Harstad & Associates to divide approximately 27 acres into 48 homesites was called to order at 7:05 PM. John Johnson, Merila & Assoc., and Dick Widell, Harstad & Assoc., were present to explain the sketch plan and answer any appropriate questions. There was no one present to make comment at the public hearing. The City received a letter from Hickok Engineering, representing RCWD, stating what will be required to satisfy their permit process. The sketch plan submitted detailed the location of the holding ponds on the proposed site which will be required by the RCWD. There was general discussion regarding the extension of sewer and water, with mention that the City will be initiating the feasibility study for the project, as well as our Engineer overseeing the project. There was discussion regarding easements for maintenance on the ponding areas, and Mr. Johnson indicated the locations where easements will be granted. Chairman Atkinson suggested the City would require an easement along their western boundary to guarantee access to adjoining parcels for possible future development. There was dicussion regarding the locations of the ponds on the sketch plan, and Mr. Johnson stated they were placed there to satisfy RCWD requirements, but they were changeable. There was no parkland reserved on the plan. The public hearing was closed at 7:35 PM. BOB BRAMSTEDT The public hearing to consider the application of Bob Bramstedt to rezone 2.5 acres from AG to RB, and an application for a SUP for motor vehicle sales, in- cidental repairs, and exterior storage not accessory to principal use. There was no present from the public to make comment. The property lying along Highway 61 is zoned RB, and they are requesting to rezone directly to the east. At present, there are two separate parcels numbers for the property they are interested in purchasing, consisting of 7.3 acres. Ultimately, their plans are to construct a 60 x 200 building. Bramstedt, and his partner Tom Connelly, were aware they will need Site Plan Approval prior to construction as well as a permit from the RCWD because they exceed the 2A limit. The public hearing was closed at 7:47 PM. Y Hugo Planning Commission August 13, 1986 Page 2 BYRON ANDERSON The public hearing to consider the application of Byron Anderson to divide 10 acres from 60 acres was called to order at 8:00 PM. There was no one from the public to make comment. Mr. Anderson reviewed the general location for the divi- sion, and the public hearing was closed at 8:06 PM. The regular meeting was called to order at 8:06 PM. HARSTAD Ray Olson questioned Mr. Johnson about assessments and how they would be handled. The City will be doing a feasibility study, and basically oversee the public improvements through the normal legal process. MOTION: Atkinson made motion, Rudisill seconded, to recommend approval of the sketch plan for Harstad & Associates, to subdivide 27 acres into 48 homesites, subject to the following conditions: 1. Permanent easements for ingress and egress be provided for City access into the drainage areas. 2. A roadway figuration on the west end of the property be redesigned so as to provide access to the east end of the Shackle/Stewart property. 3. If as a result of that roadway realignment, any other changes in the roadway system, as proposed, are made, the Planning Commission would like Harstad to return to them. +. A deposit, in the amount of $10,000.00, to cover any engineering or legal fees be made, assuming affirmative action by the City Council on this application. 5. Parkland dedication to be determined by the City Council. All aye. Motion Carried. BOB BRAMSTEDT MOTION: Rudisill made motion, Bob Olson seconded, to recommend approval of the request of Steve Ros tach to rezone Parcel 93004-2290 from AG to RB subject to the following condition: 1. Application to be accompanied by either proof of ownership or duplicate application be filled out, signed, and returned by the current fee owner. All aye. Motion Carried. MOTION: Atkinson made motion, Ray Olson seconded, to recommend approval of the application of Bob Bramstedt for a SUP for motor vehicle sales, inci- dental repair, and exterior storage (seasonal) not accessry to the principal use, and subject to the applicants doing one of the following: 1. Provide proof to the city that we are indeed speaking of one parcel that has already been combined. 2. Undertake to create one parcel out to the two (93005-2333 and 93004-2200). Submission of proof of ownership or duplicate application signed by the current fee owner. VOTING FOR: Bob Olson, Ray Olson, Schoeller, Atkinson VOTING AGAINST: Rudisill Motion Carried. BYRON ANDERSON MOTION: Rudisill made motion, Schoeller seconded, to recommend approval of the application of Byron Anderson to subdivide 10 acres from 60 acres per the legal description. We recommend approval with the Certificate of Survey as opposed to the platting process. All aye. Motion Carried. CHERYL KOSTUCH Ms. Kostuch is proposing the division of a one acre parcel from 17 acres on the corner of 140th Street and Fenway Avenue. The proposed lot would have its own septic system and well. MOTION: Atkinson made motion, Rudisill seconded, to recommend approval of the application of Cheryl/John Kostuch to divide one acre from 17 acres per the Certificate of Survey and legal description dated 8/8/86, subject to the following conditiDns: 1. When the home is constructed, sewer and water stubs be extended from the home towards 140th Street, as provided in 290-8, Subd. A (8), to provide future connection as they become available. 2. The applicant agrees, in writing, that at such time as sewer is extended and made available, that they agree to be assessed for their portion of that installation. All aye. Motion Carried. Ms. Kostuch acknowledged that she has been notified that any further subdivision may require platting. MOTION: Atkinson made motion, Bob Olson seconded, that the Planning Commission recommends that the City Council allow this particular subdivision be registered by Certificate of Survey as opposed to a plat. All aye. Motion Carried. NnRM PnRTnM MOTION: Atkinson made motion, Ray Olson seconded, to postpose review of the two Auto Dismantling Licenses for Norman Horton until 8/27/86, and ask the secretary to write a strongly worded letter to James Flannery suggesting he missed his appointment this evening, and ask he appear in two weeks. Motion Carried. .10 Hugo Planning Commission August 13, 1986 Page 4 RICHARD OPHUS Mr. Ophus, 12930 Ingersoll, is requesting a variance from the 100' setback from Sunset Lake so that he can construct a 12 x 16 screened -in porch. The porch would be approximately 88' from the lake. MOTION: Rudisill made motion, Bob Olson seconded, to recommend approval of the application for variance for Richard Ophus to construct a 12 x 16 screened -in porch 88' from Sunset Lake, as per Site Plan. All aye. Motion Carried. NT('K MT1.i PP Mr. Miller is proposing the filling of Lot 1, Bloc: 1, Oakshore Park, for building purposes. Mr. Miller estimates that 1500 yds of fill will be needed to complete the project. MOTION: Atkinson made motion, Bob Olson seconded, to forward the application to Howard Kuusisto for his review and comments. Mr. Miller to deposit $300.00 to cover any lega.L or engineering costs incurred for this application. All aye. Motion Carried.
