PRESENT: Schoeller, Ray Olson, Rudisill, Atkinson ABSENT: Fashingbauer, Bob Olson The regular meeting was recessed and the public hearing for Sullivan called to order at 7:05 PM. Gerald Sullivan - Subdivision - Mr. Sullivan is attempting to join an existing 7.76, 10.0, and 2.51 acre parcels into one leaving a newly created 2.83 parcel which would be owned by Myrtle Gessner. There was no public in attendance to comment. The public hearing was closed at 7:15PM. The special meeting was reconvened at 7:15PM. Sullivan - Motion made by Atkinson seconded by Rudisill to recommend approval of two subdivisions for Gerald Sullivan, one being ten acres on the west noted on survey as parcel 1 from 80 acres and also subdivide Parcel 3 from the Gessner property with the following conditions; after the subdivisions are granted that the three parcels be combined into one parcel with one tax number, also noted that the council may require a bond letter of credit, or cash deposit to guarantee the combining of the property. All aye, motion carried. The special meeting was recessed and the Molitor public hearing called to order at 7:30PM. Molitor - Public hearing - There was no public to address this subdivision. The public hearing was recessed and the regular meeting reconvened at 7:45. Bob Olson arrived at 7:45. Chris Molitor - Mr. Molitor originally thought his land totaled 30 acres. the survey shows the property being 29.4 acres. His request was to divide this into three 10 acre parcels. He has changed his request to one ten acre parcel with 19.4 remaining. Motion made by Rudisill, seconded by Ray Olson to recommend approval of the subdivision request for Chris Molitor to divide 10 acres from 29.4. All aye, motion carried. Allan & Karla Hancock - Hancocks own 30.76 acres at Hilo and 125th. They have obtained a SUP to construct two out buildings. The construction of their home and the building;;was to begin simultaneously, however the home will not be built until early 1987. They are now requesting a SUP to construct the buildings before the construction of the home. Motion made by Atkinosn, seconded by Ray Olson to recommend approval of the SUP for Allan & Karla Hancock to construct their out buildings as in- dicated in file 1986-30 with a financial guarantee in favor of the City of Hugo Planning Commission Special Meeting October 1, 1986 page 2 Hancock - cont. Hugo until the certificate of occupancy is issued. Construction to begin on or prior to July 1, 1987. Amendment by Ray Olson, seconded by Bob Olson to change certificate of Occupancy to issuance of a building permit. Aye: Rudisill, Bob Olson, Ray Olson, Schoeller Nay: Atkinson Vote on amended motion: All aye, motion carried. Jim Gese - Variance - Mr. Gese is constructing a home at 10249 Kerry Ct., Because of the water in the rear of the property an 18 ft. variance is needed. Motion made by Rudisill, seconded by Schoeller, to recommend approval of the 18' variance for Jim Gese at 10249 Kerry Ct. to construct his home 22' from the front property line provided he sign a hold harm- less agreement to protect the City from any potential water or drainage problems, or traffic problems which could result from this variance. All aye, motion carried. Cary Weisner - SPA - Mr. Weisner owns one acre zoned industrial at 140th St. He would like to add a building to his property for rental purposes. This would house an auto related business. Mr. Johnson has verified that this is a legal use. Motion made by Atkinson, seconded by Rudisill, the Planning Commission makes the determination that this application is not in the scope of duties but make the following comments; 1. The total of the two buildings do not exceed the required 40%. 2. Access to the rear building is a concern. 3. Potential drainage problems. 4. Possibility of two principle uses on one property. 5. If the Industrial site plan should be approved, PC should be consulted if a SUP were necessary. All aye, motion carried. Motion made by Bob Olson, seconded by Rudisill to adjourn at 9:35PM.
