OF THE
HUGO PLANNING COMMISSION
October 9, 1985
The regular meeting was called to order at 7:OOPM by Chairman Atkinson.
PRESENT:Schoeller, GRanger, Rudisill, Atkinson, Fashingbauer
ABSENT: Ray Olson
Motion made aby Rudisill to approve the Minutes of September 25, 1985 with
the following correction;
Jeff Peterson - SUP - Silt fencing to be placed along drainage easement.
All aye, motion carried.
Mr. Atkinson welcomed new member, Robert Olson to the commission and administered
the oath of office.
The regular meeting was recessed and the public hearing called to order at 7:05PM.
Harstad-Merila - Rezoning - Mr. Jim Merila presented the preliminary plan for
rezoning and deve oping 82 acres south of 8A and east of Highway 61. The plan
is in two phases. Phase 1 would include 25 acres or 54 units which is the
northern most property. The area would be serviced by a 15" sanitary sewer,
6" water main, and prospective homes would be in the $80,000 range. Harstad
and Assoc. have completed developments in the Plymouth, Woodbury, Champlain,
and Shoreview areas. Residents in protest to the development and in attendance
are as listed;
Tim & Trudy O'Connell, Nancy Bramstedt, Ron Chamberlain, H. Schletty, Jim
Bramstedt, Louis Bailey, Mary Knebel. Primary concerns were storm water run-
off, sewer assessments to surrounding area, concern for keeping Hugo rural,
more driveways entering on 8A, low land unsuitable for building, educational
costs, no recreational area for children. Liz Flaherty, Vic Koecher, Sue
and Ricardo Byron, and Joe and Pam Monno were also concerned about police
protection.
Harstad public hearing recessed at 7:45 PM and reconvened at 8:30PM to conduct
other public hearings.
Harstad hearing recessed and Charest/Castle Design public hearing opened at 7:45PM.
Richard Charest - Castle Design - John Tschida, 12855 HOmestead and Bob Anderson,
12788 Homestead were concerned that regulations are implied but not enforced.
They feel there could be an erosion problem and would like to avoid any run-
off into Sunset Lake. They would like to see a financial guarantee required
until the time a building permit is issued to insure conformance to the permit.
Charest/Castle Design public hearing closed and the Stroman hearing called to
order at 8:11PM.
Gordon Stroman - There was no public in attendance for commenting on the
rezoning . Public hearing closed at 8:20PM.

Harstad-Merila Rezoning - The general concensus of the planning commission was that
the proposal would intrude on the rural atmosphere of the community, the soils in
the area are unstable for usch dense construction. Storm water runoff and storm
sewer could cause major problems and such a project would consist of 56% of the
projected growth for Hugo in two years which originally was expected to take 20 years.
The feeling was that it was a good plan but not for the City of Hugo.
Motion made by Rudisill, seconded by Granger to recommend approval of the Rezoning
for Harstad and Assoc. to rezone from SFE to SFU approximately 82 acres.
All opposed, motion failed.
Motion made by ATkinson, seconded by Fashingbauer to recommend denial of the rezoning
application for Harstad and Assoc. to rezone approximately 82 acres. All aye, motion
carried. Applicant will notify city hall if they wish to be placed on the Council
agenda.
Richard Charest - SUP - Motion made by Atkinson, seconded by Rudisill to recommend
approval of the request by Richard Charest for the Special Use Permit to fill lot
8, Block 1, Royalhaven Estates with the following conditions;
1. A letter of credit or bond be posted by applicant to insure;
A. Erosion control be maintained.
B. Fill to the limits of the plan accompanying application.
2. Ten foot drainage and utility easement along each lot line from Homestead to
Sunset Lake.
3. Sanitary sewer plan submittedto the City engineer and approved by the engineer
prior to issuance of building permit.
4. Footing plan be submitted and approved to the building inspector prior to
issuance of building permit.
5. A silt fence for erosion control be installled and approved by the city engineer
prior to filling.
6. Filling be limited to area and depths indicated on plan application.
7. Filling be completed within one year or permit becomes null and void.
AYE: Schoeller, Granger, Atkinson, Fashingbauer, Ray Olson NAY: Rudisill
Castle Design - SUP - Gregory Schmit- Mr. Schmit provided a topographic map of the
entire lot. Fill would be hauled from Lot 11 on the west side of Homestead Ave.
and placed on Lot 6 Block 1 on the east side of Homestead. Approximately 2,500
to 3,000 cubic yards of material will be moved. The plan includes building on
both lots in the spring of 1986.
Motion made by Atkinson, seconded by Granger to recommend approval of the special
use permit for Castle Design to fill Lot 6 and remove material from Lot 11, Block
11, 2nd Addition with the following conditions;
1. A bond or letter of credit be posted by applicant to insure;
A. Erosion control be maintained.
B. Excavate to the limits of the plan accompanying application.
2. Ten foot drainage and utility easement along each lot lien from Homestead to
Sunset Lake.
3. Perc test on both lots be done prior to building permit issuance.
4. Silt fence be installed on both lots to be inspected by the city engineer.
5. Filling and excavation shall be limited to those areas and depths as indicated
on plans accompanying application
6. Filling and excavation shall be completed within one year or permit shall be-
come null and void.
7. All slopes on fill or exposed soils shall be no steeper than 3 to 1.

8. A permit be approved by Rice Creek Water shed.
9. If filled soil on lot 6 will not sit in place for one year prior to con-
struction, mechanical means of compaction shall be used and density results
approved by the City engineer.
All aye, motion carried.
Gordon Stromen - Rezoning - Stromen's property lies within two districts, Con-
servancy and Agriculture. They would like to zone the entire piece to Agriculture
and divide their 20 acres into two ten acre parcels. Property lies south of 165th
and west of Ingersoll.
Motion made by Rudisill, seconded by Fashingbauer to recommend approval of the
request to rezone from Conservancy to Agriculture for G. Stromen. All aye,
motion carried.
Nancy Cunningham - SUP - Ms. Cunningham would like to construct a pole building
for personal use. The property is for sale and the prospective buyer plans to
store approximately 200 recreational vehicles outside and use the building for
the purpose of restoring and repairing r.v.'s. Ms. Cunningham was informed this
was not an allowable use in the agriculture zone.
Motion made by Schoeller, Olson seconded to recommend denial of special use
permit application by Nancy Cunningham. All aye, motion carried.
Walter Erickson - SUP - Mr. Erickson would like to construct a 40 X 60 pole
building for storage of farm equipment and animals. The building site is located
in the flood plain but is the highest area on the land.
Motion made by Rudisill, seconded by Fashingbauer to recommend approval of the
special use permit for Walter Erickson to construct a 40 x 60 pole building at
4551 165th ST. All aye, motion carried.
Motion made by Granger, seconded by Fashingbauer to adjourn at 10:55PM.
All aye, motion carried.
