April 11, 1984
The regular meeting was called to order at 7:00 111" by Chairman
Lorch.
Pn'_SENT: Lorch, Potts, Pashingbauer, ATkinson, Schoeller, Olson,
Rudisill, Charles Schwab, Charles Johnson.
Motion made by Potts, second by Atkinson to approve the minutes
of March 28, 1984. All aye, motion carried.
?ichard Granger - Public hearing - Mr. Granger .reviewed his plans
to develop approximately 50 acres into 37 lots. At this tine he
would like to have his plan for 17 lots on the western portion
of the property approved. Residents in attendance were; Pat
Svendson, 4771 126th St. Ct., Dennis Garner, 1535 Europa, Steve
Markeson, 4898 121st St., Doug `dalischek, 12566 Europa, Tony
Bloomer, 12471 Ethan, Barb Gallivan, 4.852 F^-,.lcon Ave. The fol-
lowing concerns were expressed, condition of the existing roads,
and who .,iill pay for upkeep, what type of drainage plan, would.
Europa become a through street, would the roads in the indus-
trial part; be extended and is Mr. Granger willing to upgrade
the intended park area. The public was assured Zice Creek:

The regular meeting was reconvened at 8:25 PM. Mr. Schoeller
would like the soil report dated January 16, 1984 included a
part of the minutes.
.otion made by Atkinson, second by Rudisill to table further
discussion on the Richard Gr.anrrer s1.etch'plan based on the
follo,:ring concerns;
1. =;uropa :ve. shall be extended Southerl-v to meet ro-
posed platted street because: (290-u Subd. D .?.1.
-:uroDa Ave. is assumed to have been intended to be ex-
tended when it was platted because of (290-6 Sib d. D
2). No cul-de-sac was permanently platted, a R/-1

above paragrph. V
2. Lot width at front setback line in SFE is 130 ft. Look
at lots on cul-de-sacs , front setback = 50'
3. Intersection of Everton Ave. and 122nd shall be cleaned
up and a good perpendicular connection shall be made.
4. Corner lots shall be platted at least 20 ft. wider
than interior lot, which interior lots (290-6 sub. N
P. 7).
5. Where a residential lot is not served by both community

water and sanitary seer✓er services, it shall not be
less than 160 ft. in width and contain less than 1 acre
unless otherwise provided in the zoning ordinance (290-
6 Subd. N Par. 7).
6. A plan or statement shall be submitted for over coming
soil limitation.
AYE: Schoeller, Atkinson, Potts, Rudisill, Olson, Lorch
NAY: Fashingbauer. Motion Carried.
`.►hite Bear Rod and Gun Club — Bruce P"alkerson, attorney for the
club stated they would favor leaving the special use permit as
is until further reports were submitted. Mr. Charles Johnson
stated it is legal to require changes however the court injunction
is still in effect. The commission would like the following comments
entered into the record;
A. Condition #9 of the SUP should be updated to reflect the
latest sta•us of local, state, and or Federal Noise statutes.
B. Condition #21 of the SUP should be amended to clarify that
a variance may be granted after consideration through due
process as specified in condition #16.
C. A condition should be added to make a lead shot recovery plan
as approved by the PCA and other concerned agencies, part of the
SUP as though set forth in full (similar to condition #3). This
condition shall also specify that the lead shot will be recovered
as often as the PCA dictates but no less than once annually in
September before the first frost. Failure to do so shall be
cause for revocation of the SUP. Said program shall also be
demonstrated to be in conformance with City Zoning Code 320-4,
Subd. D. pg. 21. " The proposed special use will substantially
further the purpose of managing and conserving areas that are
unsuitable for development or have special problems of develop—
ment due to wet soils or have a unique watershed or natural
ponding characteristics".
D. A condition should be added to make wildlife protection plan,
as approved by the Dept. of Natural Resources and other con—
cerned agencies part of SUP as though set forth in full (sim—
ilar to condition #3).
E. A condition should be added for a letter of Credit in a suit—
able amount to be furnished to the City of Hugo for lead shot
cleanup to prevent pollution in the event the club shuts down.
F. A condition should be added out lining state—of—the—art, un—
biased testing procedures to insure continued compliance with
noise standards and to specify the gun clubs financial obligations
for such testing.
Motion made by Potts, second by Atkinson to take no further action
on the Special Use Permit at this time. All aye, motion carried.

Len Noack — Auto dismantling; License — l"ike and Dick Brandt are
purchasing the auto yard from Mr. Noack. They stated that all
lubricants are removed from the autos inside the garage with
a concrete floor. 14r. Rudisill suggested that a water testing
system be installed to insure the continuing testing of the
water quality.
Rudisill made motion, second by Potts to recommend installation
of two monitoring wells (on the east and west side of the prop—
erty) to monitor and collect water samples for contamination by
oil, gas, lead,Petc. Sample to be taken by July 30 of each year
and the results be submitted to the City of Hugo at the time of
the annual review. All. aye, motion carried.
I -lotion made by Potts, second by Schoeller to recommend approval
of the auto dismantling license renewal. All aye, motion carried.
Arnold Palme — Major Subdivision. I"ike Gair presented the plan
to divide approximately 80 acres into five acre lots. A public
hearing was scheduled for April 25, 1984 at 7:15 PM to consider
the request.
The secretary was instructed to contact Bald Eagle Sportsmans
Association to set up an appointment to tour the grounds at the
gun club. A tentative time and date is April 14, 1984, 3:30 PI -T.
Motion made by Atkinson, second by Rudisill to adjourn at 11:25 PM
