PRESENT: Peloquin,Hanson, Greger, Fashingbauer, Lorch,Knuteson, Peltier Motion made by Hanson, seconded by Greger, to approve the minutes of March 25, 1981, after the following corrections have been made: Page 2 (Zimmco Wood) - insert - Mrs. Peltier would like to make an on-site in- spection of the Zimmco property. Page 3 (Richard Vail) - 3rd paragraph (Greger stated that motion for denial was made because corner lot should be wider than interior lot.) All aye. Motion Carried. RONALD REICHSTADT - SPECIAL USE PERMIT AND VARIANCE Mr. Reichstadt, 12768 Irish Avenue North, has made application to construct a 30 x 60 pole barn ahead of the principal building. He owns 5 acres in the RRII district. This matter was tabledfrom the last meeting so that the Planning members could make an inspection of the property. Hanson commented that he had a problem with the location of the proposed building, with respect to the adjoining property owner. The only place where a house could be constructed would result in that person facing the pole barn. Mr. Reichstadt stated that he located the building where he did because of slope from his existing driveway, and because of his drain field being located behind his house. Greger also expressed his concern for the adjoining property owner, who is affected by the variance. He stated that if the adjoining property owner had no problem with the location of ts�oylding he could recommend approval of the request. Peloquin did not feel the city create a hardship on property owners in order to satisfy their neighbor. Motion made by Hanson, seconded by Greger, to recommend denial of the request of Ronald Reichstadt for a variance to construct a 30 x 60 pole barn ahead of the principal building, on the basis that it will adversely effect the property to the south. VOTING FOR: Greger, Hanson, Lorch VOTING AGAINST: Fashingbauer, Peltier ABSTAINED; Peloquin, Knuteson MOTION CARRIED SPECIAL USE PERMIT Peloquin did not feel that the loafing shed (13 x 36) should be considered as part of accessory acreage because it was just a shelter and had no flooring. Greger suggested that Mr.Reichstadt appear before the City Council to see what action they migr, take on the variance request. If they deny also, Mr. Reichstadt will have to relocate his proposed building. If they approve, Mr. Reichstadt will have to go back to the Planning Commission so that they can make a recommendation on the request for SUP. The Planning Commission felt they could not make a recommendation on the SUP because of the denial for the variance request. Mr. Reichstadt was also advised to provide Hugo Planning April 8, 1981 Page 2 of 3 ssion written comments from the adjoining property owners stating they have no objection to the construction of his pole barn in the proposed location. RICHARD VAIL - PRELIMINARY PLAT APPROVAL Mr. Vail presented a new plan indicating the change in width for Lots 1 and 2. Motion made by Hanson, seconded by Peltier, to recommend denial of the preliminary plat of Richard Vail for Shamrock Glen subdivision, for the following reasons: 1. . Low density of lots. 2. Anticipated cost to the city for snow removal. 3. Anticipated problems with traffic through existing lots due to shortest path school, downtown area, and playground. 4. No pedestrial pathway provided in the subdivision, as the street will be used for water runoff. VOTING FOR: Peloquin, Greger, Hanson, Fashingbauer, Knuteson, Peltier VOTING AGAINST: Lorch MOTION CARRIED EDWARD RILER - SITE PLAN APPROVAL Mr. Ridley, 6875 170th Street North, would like to construct a 32 x 48 pole barn for his personal use. He owns 10 acres in the Agricultural district. Motion made by Hanson, seconded by Peloquin, to recommend approval of the Site Plan for Edward Ridler, to construct a 32 x 48 pole barn for personal storage only. All aye. Motion Carried. JEFFREY BARBOUR - LAND DIVISION WALLY OTTO - SPECIAL USE PERMIT Jeff Barbour stated that when the original Special Use Permit was applied for, he and Mr. Fred Benson were partners. The original permit included a total of 217 acres. As a result of the split in partnership, Mr. Benson assumed control of the north i of the property and Barbour the south J. It was agreed that Mr. Benson would benefit from the sale of the proposed lots lying along County Road 8A. The kennel now has a total of 134.5 acres, which includes the 15 acres to be sold to Wally Otto. If Land Division approved, the kennel would consist of approximately 120 acres. If Mr. Otto ever intended to sell the 15 acres in the future, Jeff Barbour has been assured that he will have first option to purchase. Barbour stated that he would be able to meet the requirements of the Special Use Permit with the 120 acres, specifically, Item 6 (no shooting or training within 200' of the outside boundaries of the property). Peloquin stated that he would be in favor of the sale of the 15 acres to Wally Otto, and that an Amended Special Use Permit should be applied for indicating the perimeters of the actual kennel excepting the 10 acres for the residence. The Planning Commission reviewed each condition of the Special Use Permit, and felt that all should remain as stated. Regarding requirement for tree shelter, Barbour stated that he has 2500 trees on order. Barbour was instructed to submit a detailed Site Plan showing actual perimeters of kennel operation, in- cluding the driveway easement and an outline of the 10 acre parcel for the house. Barbour also stated that Mr. Benson's attorney was aware that Land Division approval would be required from the city before any deeds could be recorded at Washington County. Hugo Planning Commission April 8, 1981 Page 3 of 3 Motion made by Peloquin, seconded by Peltier, to recommend approval of the Land Division of Jeffrey Barbour, to sell 15 acres to Wally Otto as outlined on the submitted Certificate of Survey, with the understanding that Jeffrey Barbour is to provide proof of ownership by the April 20th meeting of the City Council. All aye. Motion Carried. WALLY OTTO - SPECIAL USE PERMIT Mr. Otto is now making application to construct a 45 x 108 pole barn to be used for agricultural storage. The Special Use Permit is required because the existing buildings located on the property far exceeds the accumulative square footage requirement. Motion made by Peloquin, seconded by Peltier, to recommend approval of the Special Use Permit for Wally Otto, to construct a 45 x 108 pole barn with the following conditions: 1. ;!r. Otto make financial adjustment for permit fee ($10.00 paid for Site Plan application - balance of $25.00 due). 2. Proof of ownership to be provided prior to City Council meeting of April 20th. 3. The Site Plan previously submitted will be used as part of the application for a Special Use Permit. 4. Mr. Otto agree to combine both parcels (15A & 5A) under this Special Use Permit. 5. The proposed pole barn to be used for agriculture equipment and products only. VOTING FOR: Peloquin, Greger, Lorch, Knuteson, Fashingbauer, Peltier VOTING AGAINST: Hanson (excessive size of building) MOTION CARRIED Motion made by Peloquin, seconded by Peltier, to adjourn at 10:55 PM.
