HUGO PLANNING COMMISSION
May 13, 1981
The meeting was called to order by Chairwoman Theodora Peltier at 8:04 PM.
PRESENT: Peloquin, Lorch, Knuteson, Peltier
ABSENT: Hanson, Greger, Fashingbauer
Motion made by Lorch, seconded by Peloquin, to approve the minutes of April 22,
1981, as submitted.
All aye. Motion Carried.
CRAIG GREEDER - SPECIAL USE PERMIT
Mr. Greeder owns 10 acres lying along County Road 10 in Section 35, zoned Agriculture.
}{e would like authorization to construct a 50 x 80 pole barn to store equipment
to be used in his tree business. A permanent residence will be constructed on
the property at a later date. A Special Use Permit is required for the commercial
sale of the trees, and the`.building exceeds the 3600 square footage requirement.
Motion made by Peloquin, seconded by Lorch, to recommend approval of the Special
Use Permit for Craig Greeder to construct a 50 x 80 pole barn to be used for
storage of equipment needed in his commercial tree operation.
All aye. Motion Carried.
VERNON GIESE - SITE PLAN APPROVAL
Mr. Giese, 14227 Forest Boulevard, would like to move in a 14 x 20 garage for their
personal use. The land is zoned RB, and requires Site Plan Approval. (HANSON
ARRIVED AT 8:23 PM). Mr. Giese corrected his submitted plan from an interior
sideyard setback of 6' to the required 101. (GREGER ARRIVED AT 8:25 PM).
Motion made by Peloquin, seconded by Lorch, to recommend approval of the Site
Plan Approval for Vernon Giese, 14227 Forest Boulevard, to move in a 14 x 20 garage.
The Site Plan has been corrected to allow for setback requirements (sideyard 10',
and rear yard approximately 1601).
All aye. Motion Carried (LORCH LEFT MEETING AT 8:26 PM)
The garage has been inspected by Tom Crever and meets with his approval according
to Mr. Giese.
LEONARD NOACK - JUNKYARD LICENSE
Mr. Noack was present and stated that he has planted approximately 75 trees, 51- 12'
in height, and in a single row. His Special Use Permit states that the southern
screening should be double row, but Peloquin felt that the city should wait one

year to see if the newly planted trees will survive. If they do grow, another
row of trees should be required.
Motion made by Peloquin, seconded by Peltier, to recommend approval of the Junk-
yard License for Leonard Noack for a period of one year. At renewal time of 1982,
inspection should be mad to see if trees planted in 1981 have grown. If trees
have grown, another row -trees to be planted. If trees have died, the city should
look at another form of screening.

JEFFREY BARBOUR - AMENDED SPECIAL USE PERMIT

Mr. Barbour was present and outlined the property that is now included in the

kennel operation (approximately 120 acres). Peltier felt that Condition #15
should be added to the existing Special Use Permit tying the balance of land

with the kennel. Mr. Barbour was reluctant to commit himself to this condition

in case that at some future time he would be forced financially to sell a portion

of his property. Peloquin stated that the permit should address the total acres
needed for the kennel operation, and in the future, should Barbour consider the

sale of additional property, an Amended Special Use Permit would have to be

applied for and the city would consider his request. The Planning Commission
o
sugge:;ted that Mr. Barbour delete the 3 acres lying across County Road 8A from
the kennel boundaries.

Motion made by Peltier, seconded by Peloquin, to recommend approval of the Amended
Special Use Permit for Jeffrey Barbour, Benson Kennel, with the addition of Condi-

tion X15 stating that the kennel operation consists of approximately 117 acres, as

indicated by the red lines on the Site Plan. If more land is to be sold, an Amended
Special Use Permit will have to be applied for and require city approval.

ART LACASSE - DIVISION OF LAND ON ELMCREST AVENUE
Mr. LaCasse had been before the Planning Commission previously regarding the division
of 27 acres in Agricultural zone. Mr. LaCasse stated that his son will be pur-
chasing 10 acres and that he has another buyer for the 17 acres. Mr. LaCasse was
advised that he will need Land Division and to appear before the City Council.
BILL STOUVENEL - SALE OF BLDG IN BALD EAGLE INDUSTRIAL PARK
Mr. Stoevenel, agent for PHD Industry, has sold the property to The Bottle Company
(Lot 3, Block 2).
Motion made by Peloquin, seconded by Peltier, to add Mr. Stoevenel for all purposes.
All aye. Motion Carried.
Mr. Stoevenel stated that the new business makes plastic bottles (injection molding),
and employs approximately 10 people. They are aware of the assessments for the
street and storm sewer improvement. Mr. Stoevenal was informed that a Special Use

Permit would be required for the new business so that Hpgo is informed as to
what type of business is located in the park. The Planning Commission questioned
the necessity of the Special Use Permit, because this type of operation appears
to be allowed in the industrial zone. Stoevenel stated that the original plat
of this property consisted of 4} acres, but only a portion of that would be sold
for the new business (1.32 acres). Evidently, Ken Tschida holds an unrecorded
transaction tying up the parcel until July 23, 1981. Peloquin felt that the city
should be looking at a Minor Subdivision for the sale of the 1.32 acres. The
Planning Commission did not feel that they could act on an application for a Special
Use Permit at this time, because the property has not been clearly defined.
Motion made by Peloquin, seconded by Greger, that because of the time deadline
(closing of June 1, 1981), the entire matter be handled by the City Council after
consultation by the realtor with the City Attorney.

PETE 14ADEAU AND DON OLSON - CONSTRUCTION OF HOME
Mr. Olson is interested in purchasing the lot located at Highway 61 and 150th Street
(south east corner). This property lies in the SFU zone. Mr. Nadeau presented
the Planning Commission with a legal description dated 1947 with a lot size of
40 x 150. Peloquin reviewed the Pine Tree Addition plat and it was determined that
the lot is actually 40 x 129 because of the upgrading of Highway 61 in the 1950's.
Mr. Nadeau felt that this should be a buildable lot because the owner has been
paying assessments on the lot for a number of years. ',As the lot sits, it would
be impossible to meet the setback requirements for interior lot lines. The
Planning Commission stated that they would not approve variances for the con-
struction o0house on this lot.
Motion made by Lorch, seconded by Hanson, that Mr. Olson appear, before the City
Council at.their meeting of May 18, 1981, and at that time, with the help of the
City Attorney, determine if there is any way this can be a buildable lot, and if
the city has any legal responsibility to make into a buildable lot.
All aye. Motion Carried.
The Planning Commission did not discuss. the change in State Statute regarding division
of large lots.
Motion made by Hanson, seconded by Lorch, to adjourn at 10:45 PM.
