HomeMy WebLinkAbout1981.07.08 PC MinutesMINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION July 8, 1981 The public hearing to consider the request of Dean Nelson to rezone approximately 20 acres from CONS to AG was called to order by Theodora Peltier at 7:35 PM. PRESENT: Peloquin, Hanson, Greger, Lorch, Peltier ABSENT: Fashingbauer, Knuteson Mrs. Peltier read the public hearing notice as published in the Forest Lake Times. Mr. Nelson owns 80 acres and is proposing the rezoning of 20 acres from CONS to AG and the division of the 80 acres into a 60 acre parcel and two 10 acre parcels, if rezoned. The present house will be located on the 60 acre parcel. Mr. Nelson has relocated to Colorado, and would like to retain the two 10 acre parcels in case he moves back to Minnesota. Mr. Flannery, attorney for Mr. Nelson, wQs present, and stated that he felt the rezoning would conform with the balance of the property in the area. Some of the other parcels are much smaller. Hardwood Creek runs to the east of the property. Francis Lutz, 8112 157th Street, and Sandy Borndole, 16237 Harrow Avenue, were present, and stated that they had no objection to the rezoning request. Perc tests were provided for the lots to be rezoned. After review of the survey by Bill Greger, he did not feel that the lots constituted 10 acres. The lines on the survey were staggered because of the trees located on the land. Mr. Flannery stated that he was informed by Mr. Hult that Parcel A was 9.998 acres and Parcel B, 10.006 acres. (FASHINGBAUER ARRIVED AT 7:51 PM). Motion made by Peloquin, seconded by Peltier, to close the public hearing at 7:52 PM. All aye. Motion Carried. (KNUTESON ARRIVED AT 7:55 PM). The regular meeting was called to order at 8:02 PM. PRESENT: Peloquin, Hanson, Greger, Lorch, Fashingbauer, Knuteson, Peltier Motion made by Lorch, seconded by Peloquin, to approve the minutes of June 24, 1981, after the following corrections have been made: Minutes of June 10th meeting should have �eoeprected as follows (page 1): The Planning Commission felt that a proper application, by the fee owners of the property, would be considered under the subdivision ordinance as such division is consistent with that ordinance." Page 3 (Tom Mulner) - Mr. Mulner wanted to know the feelings of the Planning Commission about rezoning.the old Delmar Strandberg property All aye. Motion Carried. DEAN NELSON - REZONING . Hugo Planning Commission July 8, 1981 Page 2 of 5 The Planning Commision considered the request of Mr. Nelson to rezone approximately 20 acres from CONS to AG. Greger again stated that.he did not feel the two lots consisted of 20 acres and suggested Mr. Flannery have the surveyor recheck the calculations. Lorch stated that he had no objection to the rezoning because it was consistent with the balance of the property across the road and north. Motion made by Lorch, seconded by Peloquin, to recommend approval of the rezoning request of Dean Nelson to rezone 20 acres from.CONS to AG per the submitted Cer- tificate of Survey. All aye. Motion Carried. Mr. Flannery was provided an application for Land Division to divide the parcels if rezoning approved by the City Council. NORMAN HORTON - AUTO DISMANTLING LICENSES (2) Mr. Suudeen and Mr. Nelson were present and provided a picture of the yard with the new parking signs. Signs have been placed within the yard that should make it clear where patrons should park. The highway department has been contacted, and will be placing barricades along the right-of-way for further protection. Two separate licenses are required for two separate operations on the same property, with one SUP for entire piece. Motion made by Lorch, seconded by Peltier, to recommend approval for the renewal of two (2) Auto Dismantling Licenses for Norman Horton for a period of one year. The $1,500.00 bond is continuous unless notified otherwise. All aye. Motion Carried. GARY GULLIKSON - SITE PLAN APPROVAL Mr. Gullickson, 5651 180th Street, owns 2 acres in the AG zone, and would like to construct a 40 x 60 pole barn for personal storage. Mr. Gullikson stated that he has made application for a Driveway Permit. Motion made by Lorch, seconded by Greger, to recommend approval of the request of Gary Gullikson, 5651 180th Street, to construct a 40 x 60 pole barn for his per- sonal use and storage, as per the submitted Site Plan. All aye. Motion Carried. VERN PELOQUIN - MINOR SUBDIVISION Mr. Peloquin provided proof -of -ownership for the land to be divided in the park. Land to be divided is to be sold to Hubbard Broadcasting for installation of on earth satellite station and 14 x 30 building. Mr. Peloquin also submitted a letter that will be forwarded to the -City Council for reconsideration of his plat. The land to be divided will be known as Lots 11 & 12, Block 4, when the final plat is approved. Mr. Peloquin stated that he will be meeting with reps from Rice Creek Watershed to discuss the overall drainage plan in the park. . (cont) Motion made by Hanson, seconded by Peltier, to recommenS9gPYR51 Minor Subdivision for Vern Peloquin, as per Certificate of Survey dated June 30, 1981. Property located in the proposed Peloquin Industrial Park will be known as Lots 11 and 12, Block 4, after final plat approval. VOTING FOR: Hanson, Greger, Larch, Foshingbouer, Knuteson, Peltier ABSTAINED: Peloquin Motion Carried. HUBBARD BROADCASTING - SPECIAL USE PERMIT The engineers and attorney for Hubbard Broadcasting were present to discuss the application. Mr. John McDonough, attorney, stated that the Hugo site was chosen because they required a clear, quiet area. The tower will be 100' above ground level and will be self-supporting with concrete bases, and necessary diagonals that are needed. The tower is approved by the FOC and FAA. A 14 x 30 insulated building will also be constructed, and the entire area will be surrounded by an 8' fence topped with barbwire. One mon will be checking on the area and equipment for a total of 2 hours a week. They did not feel the necessity for a parking area, but would install one if the city determined one would be necessary. Mr. McDonough stated that KSTP would be willing to install any fire or police signals on the tower. A hold harmless agreement will also be supplied. Peloquin stated that the public hearing'requirment could be waived, because of the time element, if approval was submitted from the adjoining land owners. All owners stated no objection with the exception of a comment from Joe Marier. Peloquin stated that he objected to Mr. Morier's letter that referenced"The proposed tower 100" would create no problem for the 20 acres adjacent to the east if the pro- perty would be developed toward Industrial and the necessary easements would be connected to the Peloquin property." Peloquin felt that this matter should have been addressed at the time of the public hearing for the plat for the industrial park, and should have no bearing on the application for a Special Use Permit. Motion mode by Lorch, seconded by Peltier, that the Planning Commission dispense with the need for a public hearing in view of the letters received from the adjacent property owners, and we will considertonight the application for o Special Use Permit for an earth satellite station. VOTING FOR: Hanson, Greger, Lorch, Foshingbouer, Knuteson, Peltier ABSTAINED: Peloquin Motion Carried. The Planning Commission discussed the necessity for a parking lot considering the small amount of time that anyone would be there. There was discussion about the placement of a light on top of the tower, although Mr. Merrill, engineering, stated that the FAA did not require one. KSTP was receptiveto comply with the requirements the city felt necessary. Motion made by Larch, seconded by Hanson, to recommend approval of the Special Use Permit for Hubbard Broadcasting, Inc., on land as indicated on the Certificate of Survey, to construct an earth/satellite system to include a 100 foot, self-supporting tower for micro -way antennas, on 11 meter Scientific Atlanta, Model 8007, satellite antenna, and a 14 x 30 foot equipment building. Land to be known as Lots 11 & 12, Block 4, after final plat approval. Special Use Permit subject to the following: 1. Installation to be surrounded by an 8' cyclone fence to include barbwire across the top. 2. All electrical power to be underground, if feasible. 3. A parking space to be provided within the fenced area. 4. Equipment building to be faced with similar concrete blocks to correspond with rest of industrial park. VOTING FOR: Greger, Hanson, Larch, Fashingbauer, Knuteson, Peltier ABSTAINED: Peloquin Motion Carried. George Merrill, Hubbard engineer, complimented the City Clerk on the help she provided them while working on this application JOE GLAMOS - SITE PLAN APPROVAL Mr. Glamos would -like to construct a 15,000 sq ft addition to his existing building. He hod previously attended a Rice Creek Watershed meeting, and received a permit from them subject to a drainage plan and ponding area. Mr. Glomos stated that he will not exceed 25 employees. Motion mode by Hanson, seconded by Peloquin, to recommend approval of the Site Pian for Glamos Wire Products in the Peloquin Industrial Park, to construct a 15,000 sq ft addition to the existing building, as per submitted Site Plan, subject to the following: Drainage plan approved by Rice Creek Watershed, parking spots provided as required to accommodate the number of employees (see Exhibit 11), and other plans as submitted with the application. All aye. Motion Carried. DENNIS SCHULTZ - SITE PLAN APPROVAL Mr. Schultz, 13101 Henna Avenue, would like to construct a 32 x 56 pole barn for storage. Mr. Schultz was not present, but the Planning Commission reviewed his application for Site Plan Approval. They noted that the site plan indicated a setback of 10' from the interior lot line. The requirement for AG zone is 20' sideyard setback. Motion made by Lorch, seconded by Peltier, to recommend approval of the Site Plan for Dennis Schultz, 13101 Henna Avenue, to construct a 32 x 56 pie barn for his personal use only, provided building is constructed to meet the sideyard setback of 20' in the AG zone. Hugo Planning Commission July 8, 1981 • ' Page 5 of 5 WILD WINGS GAME FARM - SPECIAL USE PERMIT AND MINING PERMIT Mr. Hughes, Wild Wings' rep, was not present, but the Planning Commission reviewed the comments submitted by Howard Kuusisto. All information for issuance of the permits has not been submitted. Motion made by Peloquin, seconded by.Lorch, to table the applications and mail a copy of Kuusisto's letter to Mr. Hughes, stating that the Planning Commission cannot act on the Special Use Permit without further information. Matter to be placed on the agenda for meeting of July 22, 1981. All aye. Motion Carried. MISCELLANEOUS Motion made by Hanson, seconded by Peltier, that the Peloquin Industrial Park final plat be reinstated to the.stotus it was at prior to the date of expiration, and to be extended for an additional six (6) months, taking into consideration the cir- cumstances surrounding the final approval of the plat. The Planning Commission has no objection to the plat in its present form. VOTING FOR: Hanson, Greger, Lorch, Foshingbouer, Knuteson, Peltier ABSTAINED: Peloquin Motion Carried.
