OF THE
HUGO PLANNING COMMISSION
October 12, 1983
The regular meeting was called to order at 8:00 PM by Chairman
Lorch.
PRESENT: Lorch, Fashingbauer, Potts, Atkinson, Hanson, Schoeller
Mr. Raymond Olson was present and sworn in as a new member of the
Planning Commission.
Motion made by Hanson, seconded by Atkinson to approve the minutes
of September 28, 1983. All aye. Motion carried.
Joe Oman - Amended Special Use Permit
Several concerns were to be addressed, one regarding fire protection.
Pon Istovanovich was present to report on the conditions in the
existing park. He stated there was a problem hauling water through
the streets in the park, mainly because of poor snow removal in the
winter. By adding fire hydrantsin the park this road problem could
be eliminated. Mr. Oman stated if he was required to install fire
hydrants on his personal property they would not be used for the
neighboring industrial park. Ms. Carla 1,1ahl, Mr. Oman's attorney
was present and informed the planning commission that insisting
hydrants be installed would be unconstitutional. She stated that
mobile homes are regulated by the Minnesota State Board of Health
and a state pre-emption law prohibits municipalities from imposing
more stringent rules than the state. It was also noted that higher
construction standards and safety equipment have diminished the
possibilities of mobile home fires. Roger Nelson, engineer for
the park submitted the drainage plan which has already been approved
by Rice Creek Watershed. The ponding area would be located next
to the existing storm sewer system on the north and would then flow
west toward Highway 61. There would be an outlet on the bottom of
the pond for continuous drainage. It was suggested that the 3,000
(approximately) sq. yds. of earth be used as a berm near the metal
company. Mr. Pigman, a resident in the park felt the protection
was adequate considering the few fires which occur. The following
is a complete list of concerns addressed with suggestions to sol-
utions to each problem.
1. Fire protection - since further expansion to the park
would only compound the problem and since the existing
roadways may not be in compliance with existing Minn.
Dept. of Health standards, it was recommended the the
City attorney and the attorney for the applicant dis-
cuss the issue prior to the City Council meeting with
special attention to Minnesota Statute 327.10 ET SEQ
(as sited by Ms. Wahl).
2. Tornado and storm shelter - Minn. Statute 327.20

plan
and tornado shelterAto comply with state regulations.
3. A minimum of a double wide trailer be located on the first
lot east of Highway 61.
4. Ponding area - to be located near open space as per
plan presented dated 8-8-83.
5. IToise abatement - the applicant will provide the City
with an agreement that the park will disclose the noise
pollution problem to prospective tenants for lots in
the expansion and will have tenants sign a consent and
waiver cf claims based on the noise pollution.
6. Lighting - applicant will submit a plan to include a
minimum of 5 additional lights in the expansion.
7. The commission approved the site plan for 28 units as
submitted dated 8-8-83.
It was noted that the existing roads are adequate for access and
that emergency exits could be through Francesca, west of the school.
14otion made by Atkinson, seconded by Fashingbauer to recommend
approval of the Amended Special Use Permit for the Twin Pine Mobile
Home Park pending consideration of seven points herein stated.

Dick Houde attended and provided information on grant and loan
Programs which the City may take advantage of. The secretary
will send for a state and federal listing of programs.
