Ken Tschida 5, Bald Eagle Sportsman Association RE: Special Use Permit (Public Hearing) RE: Special Use Permit RE: Extension of 130th Street RE: Addition at Industrial Park RE: Special Use Permit MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION December 28, 1977 The public hearing to consider the request by Larry & Richard Schmidt for a Special Use Permit was called to order by Chairman Ehret at 7:40 p.m. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, McAllister Dan Koehler, Washington County Planning, was also present. ABSENT: Rosenquist Larry Ehret read notice of public hearing published in the Forest Lake Times December 8, 1977. Eugene Peltier — 17205 N. Forest Blvd., Hugo, Minnesota — Mr. Peltier is concerned about parking. It was a problem to him before when the Nashville North was open. People were parking in his lot. He had no other objections. Mr. Ehret stated that parking provisions are part of the requirements of the Special Use Permit. Mr. Peltier was asked how many feet there were between his property and the old Nashville North. Mr. Peltier could not state off hand. 19077.72 Feet is the depth of the property. The blacktop goes back 328 feet. The septic tank is complete except for the lift pump. Mr. Ehret read letter submitted by the Police Chief Robert Barth. Peloquin asked how many parking spaces they had. There are 122 marked spaces and there could be up to 130 spaces at this time. Larry Nielsen, Attorney representing the Schmidts, was present. He stated that the Schmidt's would like to wait a year before blacktopping to see how the business was going. Mrs. Peltier asked how many games there would be. There will be a couple pool tables and a couple foos ball machines. The public hearing was closed at 8:03 p.m. Motion made by Ehret, seconded by McAllister, to approve the minutes of the December 14, 1977, with the following changes: Page 1 (Schmidt) 9th line — 13 blue spruce instead of 13' blue spruce. — All proposed narking areas were eliminated . 10th line — after comma — there could be 5 trees. Page 4 (W.B.Rod) 2nd line — could make no comment. 7th line — The word with should be scratched. Page 5 (Proof of Ownership) — 1. that title is correct and current. 2, that title is correct and current. 3, that title is correct and current. 4. The contract holder as one of the three above. (7th line in the amendment to the motion) - be maintained by owner, RICHARD & LARRY SCEDIIDT - SPECIAL USE PMnT Mr. McAllister asked what the maximum capacity of the building was. Six hundred was the declared maximum - 250 first room (bar & lounge). The second room will be opened later. Mr. Nielsen stated that they would like to gravel the parking lot in the back rather than blacktop and they would like a variance to blacktop for one year. Mr. Schmidt quoted the State Fire Marshall saying there was a capacity of 272 people for the game room and bar & lounge. The bar room will not be opened on week nights unless on special occasions. Angle of the lights shine 50' wide and 40' deep. Mr. Schmidt stated that trees are $40.00 for a 2 foot tree. They request that they be allowed to plant trees 2' or less. Mr. McAllister asked if they would go along with the Police Department's recommen- dations. Mr. Peloquin said that he didn't think it was anyones business whether they have policemen or not. No other establishment in the city is required to have policemen. The Planning Commission took note of the Police Department's recommendations and will forward it to the City Council. McAllister made motion, seconded by Greger, to approve the Special Use Permit for Richard and Larry Schmidt with the following restrictions: 1. Curb or fencing shall be required to be installed in such a manner to„de access or egress to the back area other than the designated entrance including the unpaved areas. ti 2. That the declared maximum capacity is 600 people. 3. By September 309 1978, the owners blacktop sufficient space for 150 automobiles total, minimum to be determined by existing ordinance. By September 30, 1979, the ownersshall provide sufficient blacktop for 175 automobiles total. By September 309 1980, the owners shall provide sufficient blacktop for 200 auto- mobiles total, the declared maximum capacity. The owners shall provide a irrevocable letter of credit to the city of Hugo in the first year in the amount of $159000. The letter to be reduced by 1/3 of the face amount each year* 4. Septic system be reviewed by the Buidling Inspector semi-annually and sent to the Health Department, 5. That the screen by provided in the site plan and the trees be 2 - 3 feet and that they be maintained and replaced if necessary. $19000 irrevocable letter of credit be provided to the city until screening is completed. Screening to be completed no later than September 309 1978. Hugo Planning Commission December 289 1977 Page 3 of 6 6. That lighting be provided to illuminate entire parking area. 7. That the bumper curbing or fencing be completed by June 30, 1978, as indicated on the site plan. $29000 irrevocable letter of credit be provided to the city to insure the completion of the curbing or fencing by June 30, 1978. 8. No parking be allowed on Highway 61 or the right -of -Tway. Peloquin objected to the maximum of 600 people in the motion and to blacktopping. Mr. Peloquin would like to review the Special Use Permit on October 19 1978. Gillen made motion, seconded by McAllister, to delete "as per site plan" on motion #7 about bumper curbing. All aye. Motion carried. Mr. Nielsen stated that they had no objections to the motion other than the motion for blacktop. They didn't know if they would be able to regulate parking on Highway 61 but would do everything in their power to deal with it. Motion made by McAllister, seconded by Peltier, to amend the motion to delete the restriction on the parking on Highway 61 #8. Five ayes. Peloquin apposed. Motion carried. VOTING FOR: Greger, Gillen, McAllister VOTING AGAINST: Peloquin, Peltier, Ehret Motion failed. Mr. Nielsen asked about a mandatory review at a certain time to break the deadlock. Motion made by Ehret, seconded by Peltier, that the Special Use Permit for Larry and Richard Schmidt be approved subject to the following conditions: 1. Same as in the previous motion. 2. Same as in the previous motion. 3. The additional parking spaces required by ordinance be allowed to be crushed rock for a period not to exceed 2 years beginning at July 19 1978. At the end of said time the seating capacity is as was stated, that blacktop be required for additional parking spaces. A $15,000 irrevocable letter of credit shall be provided to the city to insure installation of blacktop to run concurrent with the 2 years beginning with July 19 1978. Said crushed rock to be installed by July 1, 1978. Additional motions are same as in previous motion as amended. Gillen interpreted Ehrets motion as a variance and he didn't feel that he could vote for it. Ehret stated that it was not a variance but only an extension of time. VOTING FOR: Peloquin, Peltier, Gillen, McAllister, Ehret VOTING AGAINST: Greger Hugo Planning Commission December 289 1977 Page 4 of 6 Motion carried. Ehret stated that we needed additional copies of the site plan. Recessed at 9:40. Reconvened at 9:45. JAMES BREVIG - SPECIAL USE PERMIT Ehret read request for a Special Use Permit to build a pole barn. He read an accompanied letter from property owners 350 feet from the perimeter of his property. It was unanimous that they did not object to the building of a pole barn. Those listed were: Thomas L. Bushinski, Jerome W. Hintz, Robert D. Oswald, Vincent T. Verrecchio, Richard J. Vail, Donald B. Cinoski, Delmar C. Thompson, Leonard M. KIjenski, Dennis A. Sullivan, Robert L. Waller. Proposed use of building is for storage of vehicles, campers, boats and furniture all owned by Mr. Brevig or his family. It will not be used for rental of storage space. Access to the pole building will be the same as access to the existing building. There are two accesses, one by the house and one on the north part of the property. Dan Koehler stated that anything over 1,000 sq. feet cannot be considered residential accessory structure and therefore, is consic?ered a commercial structure according to the State Building Code, Mr. Brevig said that it would be completely hid from view. The building would be 200 feet from the easement. Gillen made motion, seconded by Peloquin, to refer the Special Use Permit of Mr. Brevig to the Ordinance Committee for a clarification of accessory buildings in RR2 and all residential areas. The Ordinance Committee is to reply to the Planning Commission in a period not to exceed 45 days. All Aye. Motion carried. CHARLES SHUBAT - EXTENSION OF 130TH STREET Mr. Shubat submitted maps describing the area. McAllister submitted a note to the file on information he received from Howard Kuusisto regarding the existing cartway. Ehret stated that the request was answered by city records regarding the existence of a cartway. He told Mr. Shubat that his next step would be to get together with the city planner on how to proceed and get a formal letter from the city engineer on the status of the cartway. Mr. Shubat asked if Mr. Axelson and Mr. Molitor should be involved. Mr. Koehler said that Mr. Molitor already has an access and that he would not benefit from another access. Mr. Peloquin said he preferred a "T" rather than a cul-de-sac. Mr. Shubat was told to check with the city planner on different possibilities of a dead-end.street. A discussion was held on the definitions of minor or major subdivisions. Mr. Koehler suggested making a recommendation to the Council that any land division which creates 4 or more lots be a major subdivision. Ehret requested that the Planner contact the attorhey and city engineer on interpretations. Mr. Gillen left at 10:30. Peloquin stated that a site plan is all they needed, oy s , owner of Accessory Research Engineering stated that they are an assembly operation of ( 7 aircraft instruments and motorcycle gauges and their present plant was destroyed by a boiler fire and they are presently under an extreme hardship. Mr. Koehler agreed with Mr. Peloquin that all they would need was a site plan. Mr. Ehret stated that the site plan presented was incomplete. It did not state the type of structure - the parking lot was not located on the site plan and the parking sites were not shown on the parking lot as Mr. Tschida was instructed by Mr. Koehler, Mr. McAllister stated that he wanted to go on record as saying that he will never vote on another item from Grace Development that is incomplete. McAllister made motion, seconded by Peltier, that the request made by Grace Development be sent to the City Council without recommendations. The reason for forwarding the request to the City Council without sufficient data from Grace Development is that the Planning Commission'feels that Accessory Research Engineering is under extreme pressure and hardship at this time. VOTING FOR: Peloquin, Peltier, Greger, Gilleng McAllisterg Ehret, Motion Carried, BALD EAGLE SPORTSMAN ASSOCIATION- SPECIAL USE PERMIT Peltier felt that someone should go out and look at the Bald Eagle Sportsman Club before a special meeting is scheduled. Motion made by Greger, seconded by McAllisterg to have a special meeting for Thursdays January 59 19779 at 7:00 p.m* to consider Bald Eagle Sportsman Association Special Use Permit, All Aye. Motion carried. (Clerk to send out notices) Ehret to set up time to go through the Sportsman Club, January 2nd at 10:30 a.m. is scheduled for the time to inspect the Sportsman Club. A discussion was held on how to improve the Planning Commission procedures. Letter of credits should be automatic on certain items. We have a right to ask for City Attorney or City Engineer to attend a meeting. Dan Koehler will submit a check list for the Planning.Commission approval. It is recommended to the City Council that the changes of procedures for the Planning Commission be adopted. Hugo Planning Commission December 289 1977 Page 6 of 6 Motion made by Ehret# seconded by Peltier, instructing the secretary to send a letter to Mr. Rosenquist asking him whether he intends to be a regular member or not, and if not: that he send his letter of resignation. All Ayes. Motion carried. Motion made by Peltierq seconded by McAllister, that the Planning Commission recommends to the City Council that they reappoint Peloquin to the Planning Commission. 4 Ayes. abstained. Motion carried. Motion made by Peltier, seconded by McAllister, that the City Couucil reappoint Larry Ehret to be Chairman of the Planning Commission. All Ayes. Motion carried.
