PRESENT: Ehret, Peloquin, Peltier, Greger, Rosenquist, and McAllister Dan Koehler, Washington County Planning, was also present. ABSENT: Gillen (Mr. Gillen arrived at 11:20 PM). Motion by Peltier, seconded by Peloquin, to approve the minutes of November 16, 1977, with the following changes: Page 2 (Schmidt) — bar and restaurants are not permitted in all zoning districts. Permitted by special use only. Page 3 (Last line — 2 ty planning Page 4 0"l) — of a fence All aye. Motion carried. RICHARD BUSSE — EXTENSION OF INGERSOLL AVENUE Mr. Busse was present and stated that it would cost him $250.00 each for perc tests on the two building sites on his property. Sites would also need excavation. He had talked to Howard Kuusisto about curving the road to the present Ingersoll Avenue, and that would take 25 year old evergreens. If they cut through his property in the rear, shoring would have to be constructed, and he felt this would ruin the appearance of his home. Ehret suggested that Mr. Busse consider Planned Unit Development, and discuss the matter with Dan Koehler, Washington County. This would possibly eliminate alot of the zoning requirements. Ehret made motion, seconded by Peltier, to table Mr. Busse's request pending further investigation and consultation with Washington County Planner, Dan Koehler. All aye. Motion carried. Richard & Larry Schmidt — Special Use Permit The Schmidts' were present, and presented their site plan for the old Nashville North. A report was received from Iiugo's Fire Chief which is on file. A new septic system with two more tanks (4000 gallons) and two 15' x 100' drain fields have been installed as per recommendation from the State Health Department. The lighting, as indicated oii the site plan, was discussed. Rosenquist suggested that the Schmidts' write in on the original drawing all the comments about the drain fields and lighting as discussed. Koehler stated that the site plan should have fencing indicated around the drain field area, 3' bummer curbs or fence 1' in from lot line,13 blue spruce 10' on cen.er. If parking was eliminated from the front of the building, 4�t ck u -u<- 5 Cuzco. He stated that the county did not agree with the septic system requirements as stated by the Health Department. He would recommend that, they install water meters and ground water inspection well. Ehret said they would need to blacktop sufficient area for seating capacity (one narking spot for every three in seating capacity. Schmidt Mated that they can park 122 on blacktop now. Ehret suggested that they index on the original drawin„ the location and size of the septic system, the type of lighting, and have ready for the public hearing in December 28, 1977, proof of oimership. Hugo Planning Commission December 14, 1977 Page 2 of 5 SM2JAY HOUSE, MOVCRS — SPECIAL USE PERMIT Mr. Donald Sempel would like permission to store houses and garages on 20 acres zoned Industrial. He presented a site plan to the commission. Garages will be stored along the railroad tracks on Highway 61 (maximum of 10)9 and the houses will be stored along 165th Street (maximum of 5). He will also be const:. -acting a shop 80 x 40. The plan indicated a trailer house for a watchman. Koehler stated that if Lombardy poplars were to be used for screening, would like to see evergreens at a later time. Some members had a problem with the trailer house for watchman quarters. Rosenquist fel.- that maybe the ordinance should be looked at to allow for this in the Industrial zone to help police the area. Koehler stated that the county has already revised their ordinance for allowing a one bedroom residence. Peloquin inquired if the Semnel's would be interested in applying for. a Planned Unit Development. The Sempei's were provided information regarding PUD, and the chair ruled to table the discussion until they review the material. Mr. Sempel decided to stay with the request for a Special Use Permit along with a residence. Greger made motion, seconded by Rosenquist, that the Planning Commission recommend denial of the application for a Special Use Permit made by Safeway House Plovers reason being it violates the zoning ordinance for having living quarters in the Industrial zone. VOTIN^ FOR: Greger, Rosenquist VOTING AGAINST: Peloquin, Peltier, McAllister, and Ehret Motion failed. Peloquin made motion, seconded by Peltier, to recommend approval providing: 1. That Mr. Sempel make watchman quarters in the shop. 2. Mr. Sempel plant Lombardy trees within six months. 3. Mr. Sempel contact SCS in Stillwater for evergreens to be used for screening in the future. McAllister made motion, seconded by Peloquin, to amend the above motion: 1. That Mr. Sempel provide the city with a $19000.00 irrevocable letter of credit to be returned upon comp/etion of the planting of the required screening. 2. The planting to be completed by June 30, 197.8. 3. The trees be planted 8 feet on center, two rows. Type of evergreens to be recommended by the SCS. 4. The trees will go along entire property west of railroad tracks and will run entire property line on 165th Street. 5. Apartment in shop not be more than 700 sq. ft., one bedroom apartment. 6. Any trees that don't survive must be replanted within one year. 7. Fire lanes to x.11 buildings on the property be maintained, including snow removal.. Hugo Planning Commission December 149 1977 Page 3 of 5 McAllister made motion, seconded by Peloquin, stating that the only change in the preceding amendments is that the apartment in shop will 500 sq. ft. The rest of the amendment motion reads as stated. VOTUTG FOR: Peloquing Peltier, McAllister, and Ehret VOTING AGAIITST: Grej;�er, Rosenquist Motion Carried. (ORIGINAL MOTION) VOTING FOR: Pel.oquin, Peltier, and McAllister VOTING AGAINST: Greger, Rosenquist, and Ehret Motion Failed. Ehret made motion, seconded by Peltier, that the Planning Commission recommend approval of the request of Safeway House Movers for a Special Use Permit, provided that: 1. Evergreens, minimum of 1.0 ft in height, be planted 10 ft on center spacing along the length of 165th Street. 2. Seedlings, same spacing, be planted on west side of railroad tracks the length of the property. 3. The buildings be parked on the property as described in accampanying drawing. If the bui:dings are not placed on the square as per diagram, the Special Use Permit will be declared null ana void after a period of 30 days. Notice of such to bc: given to property owner. 4. That said trees be planted no later than June 30, 1978. 5. That all dead trees be replaced within a period of one year. 6. !t "1,000.00 irrevocable letter of credit be provided to insure the planting of the trees. 7. They would like to extend 130th Street eastw-lrd 13320 ft, and subdivide 120 acres into 10 acre building sites. The extension will runaon�, the north line of the NVE'- of the: `Afj of Section 33. Peloquin stated that -the cit;► does not accept a cul-de-sac more than 660 ft. He also questioned whetlier road requirenent:, would detract from the minimum lot size. Ehret said that right- of-ways are to be considered as part of the lot size. Ehret stated that currently the city would not allow 132019 however, if it is a preexisting street that would be another matter. Rosenqui3t made motion, seconded by Peltier, that Mr. Shubat bring in more information on proof of existing road. Matter to be tabled until that time. All aye. Motion carried. Hugo Planning Commission December 14, 1977 Page 4 of 5 11HITE BEAR ROD & GUN CLUB — FILLING OF RICE LAKE The Planning Commission was directed by the City Council to review the application. A letter was received from Howard Kuusisto stating that he couldtmake comment on the application because of lack of information. Mayor LaValle was present, and stated that the city would not incur the cost of obtaining soil borings at the site. Ehret related Mr. Gillen's opinion that the city should not consider any application from the gun club because of ;,heir current status (court ruling). The club would like to fill. ' wetland m+iW sand as a possible solution to recovery of lead shot. The city has been asked for input, but the DER will make a ruling without it. The city has until January 1, 1978 in which ;;o reply. Rosenquist felt that it would be impossible for the Planning Commission to review because of lack of information, and lack of engineering knowledge. 7hret made motion, seconded by Peliter, directing the secretary to write a letter to the city Exi ineer instructing him to get additional information needed, either through the gun club or any other way he wants. Report by December 289 1977. VOTING FOR: Peltier VOTING AGAINST: Peloquin, Greger, Rosenqu st, McAllister, and Ehret Motion Failed, Mr. Perron stated that the land in question is all brush, and there is no water standing after a significant rain. Part of the land is already high, and to the east they plan to fill about 18". Ehret made motion, seconded by Rosenquist, that it is the opinion of the Planning Conmission that the following technical data should be a matter of record before any comments can be made: 1. Topographical information 2. �imount of fill required 3. Relationship of the support ability of the soil underneath Ione of this information is available to the city. The city respectfully requests that the Department of Natural Resources investigate all of these areas thoroughly prior to issuing of said permit. The DER is also requested to review the public interest input that is a matter of record.. All aye. Motion carried. MIGO A & W — SPECIAL USE PERMIT aosenquist made motion, seconded by Peltier, that the Planning Commission recommend to the City Council to release the bend of the Hugo A & ':•;, pertaining to their Special. Use Permit. VOTING FOR: Peloquin, Peltier, Greer, Rosenquist, Gillen, McAllister, and Ehret Motion carried. BALD EAGLE SPORTSAIaT ASSOCIATION — SPECIAL USE P,RI=:IT Members McAllister, Peloquin, and Peltier reviewed the minutes of Oneka Township, and were unable to find any mention of a shotgun club, bu: does refer to it as a rifle range. Bald Eagle's attorney, Mr. Peters, provided the city with copies of the association's Articles of Incorporation. They were unable to provide copy of the original by—laws. Ehret stated that the Bald Eagle Sportsman Association must get a Special Use Permit to continue in operation as per the zoning ordinance. The club installed skeet houses in the summer of 1977. The trap houses were in before 1970. Gillen made motion, seconded by Peltier, that the request for a Special Use Permit by the Bald :Eagle Sportsman Association be denied until new intensified mechanical devices ars removed from the Bald Eagle facility. Devices installed this past summer (1977). They include mechanical throwing devices of a more modern type than previously authorized and that pertinent structures installed at the same time also be remcired. VOTING 1'OR: Peltier, Greger, Gillen, and McAllister VOTING AGAINST: Peloquin and Ehret ABSTAINED: Rosenquist Motion Carried. ORDINANCE ON MULTIPLE FAMILY DWELLINGS IN SFE ZONING DISTRICT Peloquin made motion, seconded by Peltier, to set a date for a public hearing; regarding multiple family dwellings in SFE zoning district for January 25, 1978, Hugo City Hall, at 7:30 PM. All ay -e. Mlot.ion Carried, PROOF OF 0 ITE- RSHIP Let the record show that the City Attorney was present at the Planning Commission meeting. The subject of proof of ownership was brought up, and the City Attorney stated that when he reviews proof of ownership, one of these four (4) x-rays is acceptable: 1. Letter from abstractor or abstract company. 2. A letter from an attorney licensed in the State of Minnesota dating; back 6 months, stating that he has examined the abstract.'-- V t& t- er-2� . 4 -Lu -4 3. Suggest to City Council approval of a letter or a form showing these instructions will be provided to each applicant prior to the Planning; Commission meeting.
