Safeway House Movers Re: Special Use Permit Re: Special Use Permit (public hearing 9:00) MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION November 16, 1977 The public hearing to consider the rezoning request of Country Squire was called to order by acting Chairperson Peltier at 7:35 PM. PRESENT: Greger, Peltier, Gillen, McAllister Dan Koehler, Washington County Planning, was also present. ABSENT: Peloquin, Ehret, and Rosenquist Mr. Gillen noted that he would add to the discussion, but abstain from voting. Peltier read the public hearing notice as published in the Forest Lake Times. Mr. Van Kleek, Country Squire, was present at the meeting. Mr. Koehler stated that the property could not handle an on site sewer system, and the only remedy would be holding tanks. The tanks are considered only a temporary measure (5 - 10 years). The Comprehensive Sewer Map, and it was determined that sewer is estimated to be extended to the property in question between 1985 and the year 2000. Koehler stated that that would be too long for the use of holding tanks. Van Kleek questioned the possibility of using the mound system, and Koehler stated that the county did not approve the use of the mound system. Gillen stated that the mound system could be constructed with impermeable botton, and Koehler again stated that this was not permitted by the county. The public hearing was closed at 8:02 PM. Ehret arrived at 8:06 PM. The regular Planning Commission meeting was called to order by Ehret at 8:12 PM. PRESENT: Ehret, Peltier, Greger, Gillen, and McAllister ABSENT: Peloquin and Rosenquist Motion made by Peltier, seconded by Greger, to approve the minutes of November 9, 1977 as presented. All aye. Motion carried. COUNTRY SQUIRE - REZONING The rezoning request includes 12 parcels along Highway 61 to change from Ag to RB. Koehler presented a map showing the layout of the property, and soil borings. He restated that he recommended that rezoning be approved only if the city could be assured that sewer would be extended in the near future to eliminate the use of holding tanks (5 - 10 years). He recommended concentrating on the rezoning now and platting later. Ehret stated that in view of the fact that soils are low and wet, it is a major problem with sewage. There is a large amount of open land in the area, and might force p=remature development. Van Kleek wanted the rezoning taken care at this time so that he could construct his model home. He would check with Washington County again for possible alternatives to the sewage problem. Koehler said you can have one principal structure on one parcel of land, and there are two separate parcels being considered in the rezoning request. The construction could take place subject to permit for a septic system. There was some discussion Hugo Planning Commission November 16, 1977 Page 2 of 4 as to the rezoning of the 60' owned by Sophia Arcand. Wondered if they would be creating a building site. Koehler stated it can be handled in the platting pro— cedure that the city request that 60' be dedicated as outlot for ingress and egress to the property in the back. Motion made by Greger, seconded by Peltier, that the Planning Commission recommend approval of the rezoning request of Country Squire. We are acting on all three (3) parcels simultaneously. VOTING FOR: Greger, Peltier, McAllister, and Ehret ABSTAINED: Gillen Motion carried. RICHARD & LARRY SCHMIDT — SPECIAL USE PERMIT The Schmidts' presented a site plan, and the adjoining property owners within 3001. McAllister stated that bar and restaurants are permitted ftablitel by Special Use Permit only. Mr. Schmidt stated that their seating capacity will be from 600 — 700. There 3.e an estimated 3000 gallons of usage on a full night, and they are now equipped for a capacity of 1500 gallons. Gillen felt the commission should know more about building exits, fire lanes, and their lighting plan. Koehler said they wouldn't be able to park on the drain field, and to con— sider this in their planning. Ehret told the Schmidts that they would have to have an answer to the sewer problem, and would need, in detail, the actual parking spaces marked off, the width of traffic lanes, location and type of lighting, type of screening along US 61, and fire lanes. McAllister asked that the secretary write a letter to Hugo's Fire Chief, asking for his comments and recommendations regarding the business as to seating capacity, alarm system, and whether we can handle if necessary. McAllister stated that the last valid liquor license was issued in 1975, and would be in favor of a public hearing. Gillen made motion to table the request until we have the necessary information and schedule a public hearing at that time. Withdrawn for lack of second. Motion made by Gillen, seconded by Greger, to table the request until the meeting of December 149 1977, and schedule a public hearing for December 28, 1977, subject to having all required information to the Planning Commission for the meeting of December 14, 1977. All aye. Motion carried. SAFEWAY HOUSE MOVERS — SPECIAL USE PERMIT A recess from the regular meeting was asked for and the public hearing considering the request for a Special Use Permit by Safeway Howe Movers was called to order by Chairman Ehret at 9:20 PM. The notice of publication was read. Mr. Sempel presented a site plan proposing the construction of 3 buildings, and the storage of a maximum of 10 buildings. He was considering the construction of a residence for a watchman, but was informed that it was not a permitted use in the Industrial zone. Copies of soil borings was presented, but no perc test is on record. There is only one place on the 20 acres, where a good perc test can be taken. Mr. Walt Blowers and Mr. Mallinger, adjoining property owners, were present stating their objections to the request. Mr. Greg Cardinal, adjoining property owner, was present stating that he had no objection. There were no written responses. Mr. Sempel stated his was a profit making business, and they didn't buy deteriorated houses. Their main purpose is not to store these houses, but have a place if needed. Mr. Blowers was informed that if a Special Use Permit was granted, it would automatically be re— viewed annually for possible violations to the conditions. The public hearing was closed at 10:00 PM. The regular meeting was called to order at 10:13 PM. Numerous regulations and alternatives were discussed at this time. Mr. Sempel stated that he employs six (6) people, but maybe only one would be in the shop. This would be his sole storage site. Motion made by McAllister, seconded by Gillen, to recommend denial of the request for Special Use Permit by Safeway House Movers, VOTING FOR: Gillen and McAllister VOTING AGAINST: Greger, Peltier, and Ehret Motion failed. Motion made by McAllister, seconded by Gillen, to recommend denial of the request for Special Use permit by Safeway House Movers for the following reasons: 1. Not consistent with the Comprehensive Plan. (restrict development on Highway 61) 2. Mr. Sempel's plan for policing the business be having a residence is not consistent with zoning ordinance. VOTING FOR: Gillen and McAllister VOTING AGAINST: Greger, Peltier, and Ehret Motion failed. Mr. Sempel stated he would agreeable to the stipulation of not storing a building over 12 stories. Mrs. Sempel again asked that the commission consider the sewer system for 20 acres. Gillen made motion, seconded by Peltier, to table the matter until the meeting of December 14, 1977, for futher input from the Planning Commission members (ideas on restrictions and recommendations for the operation). VOTING FOR: Greger, Peltier, Gillen, McAllister, and Ehret Motion carried. The Sempels were instructed to provide the following information: 1. Fairly detailed idea of how you would fence. 2. Yard lighting 3. Number of buildings (where and spacing) 4. Show layout for maximum number they would have sitting there 5. Contact count Planning Department for ideas on screening and fencing along 165th St. Hugo Planning Commission November 16, 1977 Page 4of4 Motion made by McAllister, seconded by Peltier, to review the plans of Mr. Gillen for screening along auto distmantling yards. VOTING FOR: Greger, Peltier, McAllister, and Ehret ABSTAINED: Gillen Motion carried. Motion made by Ehret, seconded by Peltier, to recommend approval of the plan granting: 1. Variance to heighth of fence keeping in mind the purpose of fence. 2. Variance to the requirement of facing to exterior property to allow for alternating facing of fence. 3. The signs, as included in plan, be omitted or adhere to city sign ordinance. VOTING FOR: Greger, Peltier, McAllister, and Ehret ABSTAINED: Gillen Motion carried.
