Safeway House Movers 5, White Bear Rod & Gun Club RE: Mining Permit RE: Variance (KC Plaza) RE: Rezoning RE: Special Use Permit RE: Amended Special Use Permit MINUTES OF THE PROCEEDINGS C01a014 HUGO PLANNING COMMISSION October 269 1977 The meeting was called to order by acting Chairperson, Peltier, at 8:04 PM. PRESENT: Peltier, Peloquin, Greger, Rosenquist, and Gillen Dan Koehler, Washington County, and Larry Irsfeld were also present. ABSENT: Ehret and McAllister Motion made by Peloquin, seconded by Rosenquist, to approve the minutes of October 129 1977, after the following change is made: Page 1 (last line) add the name McCullough after Mr. All aye. Motion carried. George Indykiewicz — Mining Permit A report was submitted by Howard Kuusisto stating that the site conditions are approved. Grading and seeding have been performed. Motion made by Peloquin, seconded by Gillen, to recommend approval of the Mining Permit for George Indykiewicz. Permit to be extended until November 1, 1978. All aye. Motion carried. Dennis Killian — Variance Mr. Killian is asking for a variance to build a 24 x 24 garage on the south side of the KC Plaza. Mr. Koehler inspected the site with Killian, and could not find any other area to build a garage. He stated that the garage, as requested, would be 5 feet from the right of way line, and 25' to 26' from the edge of the road. There was no real proof on record as to the exact dimensions to use for determining the distance of the garage from the road. The existing was used for guidelines. It was suggested that Mr. Killian get a copy of the abstract. Gillen felt that there would be a safety hazard created because of all the traffic on that road. Motion made by Gillen, seconded by Peloquin, to recommend denial of the variance request of Dennis Killian because the garage would be too close to road right of way. VOTING FOR: Peloquin, Gillen, and Rosenquist VOTING AGAINST: Greger and Peltier Motion carried. Country Souire — Rezoning (Gillen abstained from discussion and voting) Mr. VanKleek presented the driveway plan for the 12 parcels to be rezoned. They would use three shared driveways. They could not run a road behind the land because it is too low. They have done some preliminary soil testing, and ran into mottling at 8j feet. Mr. Harry Weaver will be doing official soil borings. The 60 feet owned by Sophia Arcand has not been recorded and will have to be made part of the petition for rezoning. Hugo Planning Commission t October 269 1977 Pg 2 of 3 Country Squire — cont. Motion made by Greger, seconded by Rosenquist. to change the regular Planning Commission meeting of November 23, 1977 to November 16, 1977. All aye. Motion carried. Motion made by Greger, seconded by Rosenquist, to schedule a public hearing for November 16, 1977 at 7:30 PM, to consider the request of the Country Squire to rezone 9 parcels containing 1.04 acres, more or less. To include other parcels of Loren McCullough and Sophie Arcand provided the necessary information is pro— vided by Monday, October 319 1977. Land to be rezoned from Agriculture to RB. Names of property owners within 300' of the property in question to be provided. VOTING FOR: Peloquin, Greger, Rosenquist, and Peltier ABSTAINED: Gillen Motion Carried, Safeway House Movers — Special Use Permit Mr. & Mrs. Donald Sempel are interested in purchasing 20 acres on Highway 61 and 165th Street now zoned Industrial. They want the property to store houses, garages, and any other buildings they may get. Mr. Sempel stated that they really don't care to store the buildings, but because of circumstances, sometimes it is required. A copy of the earnest money contract, survey, and site plan was provided. Motion made by Rosenquist, seconded by Greger, to schedule a public hearing for November 16, 1977, at 9:00 PM, to consider the request of Safeway House Movers for a Special Use Permit for open exterior storage of buildings. Names of property owners within 300' of the property in question is to be provided. VOTING FOR: Peloquin, Greger, Gillen, Rosenquist, and Peltier Motion carried. White Bear Rod '& Gun Club — Amended Special Use Permit Mr. Jerry Perron was present and stated that they are interested in renting the building at their site for weddings, parties, etc. Peltier stated that this would not be a permitted use in Agriculture zoning. Motion made by Gillen, seconded by Greger, to recommend denial of the request of the White Bear Ron & Gun Club for an amended Special Use Permit to use the clubhouse for rental purposes, because it is not a permitted use in the Agriculture district. Perron stated that this would not be a commercial operation, and that there was a definite distinction between renting and taking tickets at the door. Mr. Koehler stated that a clubhouse would allow use by its members, but could not be rented out. Perron asked if a member wanted to use the clubhouse, could they do that. Gillen stated that he felt that would be permissible. VOTING FOR: Peloquin, Greger, Gillen, Rosenquist, and Peltier Motion carried. Hugo Planning Commission October 26, 1977 Page 3 of 3 Motion made by Peloquin, seconded by Rosenquist, to include Shepherd of the Fields, Gordon Russett, and Sandy Murphy on the agenda. Shepherd of the Fields Church — Special Use Permit A church representative submitted a Signboard Permit from the railroad. The church is requesting to place a sign on railroad property. Motion made by Rosenquist, seconded by Peloquin, to recommend approval of the sign as originally passed by the Planning Commission on September 14, 1977 along with the railroad Signboard Permit dated September 22, 1977. All aye. Motion carried. Mr. Gordon Russett Mr. Russett presented the Commission with a plan for dividing his 85 acres. The potential buyer would have clear title on 15 acres, and the balance of 70 acres would be on a contract for deed. Motion made by Peloquin, seconded by Peltier, to recommend approval of the proposed plan of Mr. Gordon Russett, adding 5 acres to 809 release 15 acres, and the balance of 70 acres on contract for deed. Greger stated that this 15 acres could be sold as is when there is more land available. There was also discussion that someone could come in at a later date and ask for a 15 acre building site on the balance of the property. Irsfeld asked if it would be possible to cut the price on 20 acres, and raise the price on balance of land on contract for deed. VOTING FOR: Peloquin, Peltier VOTING AGAINST: Greger and Rosenquist Motion failed. Motion made by Peloquin, seconded by Rosenquist, that due to failure in motion, matter be handled by City Council. VOTING FOR: Peloquin, Greger, Rosenquist, and Peltier Motion carried Sandy Murphy Ms. Murphy was present asking for information regarding the subdividing of land owned by the Hollihans, and road requirements.
