Commercial/recreation activities in Agriculture and Conservancy Districts MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION October 12, 1977 The meeting was called to order by Chairman Ehret at 8:04 PM. PRESENT: Ehret, Peloquin, Peltier, Greger, Gillen, and McAllister Dan Koehler, Washington County, was also present. ABSENT: Rosenquist Motion made by Peloquin, seconded by Gillen, to approve the minutes of September 28, 19779 as presented. All aye. Motion carried. DENNIS KILLIAN — VARIANCE Mr. Killian wants to purchase the KC Hall on Bald Eagle Lake, and construct a 24 x 24 garage on the south ease side of the building. Mr. Killian presented a site plan of what he hopes to do. The garage would be 26' from the road right— of-way. After further discussion, Ehret determined that the garge would actually be only 6' from the right—of-way of the road. Ehret asked as to the possibility of constructing the garage to the north, and Killian stated that would create a more expensive project calling for major remodeling. Mr. Koehler felt that 6' would be much too close to the road, and agreed to meet with Mr. Killian at the site to find a possible answer to the problem. Motion made by Peltier, seconded by Gillen, to table the Dennis Killian variance request until October 26, 1977, Mr. Killian to review possible alternatives, and contact Washington County Planning for assistance. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret Motion Carried COUNTRY SQUIRE — REZONING Mr. Van Kleek, representing Country Squire, is requesting to rezone 9 parcels each having 100 feet of frontage on Forest Blvd. from Agriculture to RB. Gillen went on record stating.that he wished to refrain from the discussion and voting regarding this matter. An aerial photo of the property in question was presented to the Commission. Mr. Koehler inquired as to the type of businesses that would be going in there. Mr. Van Kleek stated that four lots are tendatively set for a nursery, an office for cement contractor, another office building, and a model home. Was not sure about the balance of the lots. Mr. Koehler also stated that the Commission should review the soil borings and perc tests for these lots. The Commission also felt that there should be some kind of plan for access to these lots, rather than nine individual driveways. Mr. Van Kleek stated that north of the 900 feet, there is a 66' easement owned by Sophia Arcand. Peloquin stated that McCullough should get the 300 feet north of the easement rezoned to RB also, and McCullough agreed. Motion made by Peloquin, seconded by Peltier, to table the Country Squire's applica— tion for rezoning until October 269 1977, awaiting the requested information. VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret ABSTAINED: Gillen Motion Carried SHIRLEY DUCKSTAD — SPECIAL USE PERMIT Mrs. Duckstad would like to have a beauty shop in her home at 6800 177th Street. They showed proof of ownership of 13 acres. Mrs. Duckstad stated there was ample room for parking, and she had no objections from the adjoining property owners. She also stated that she will be getting a license from the state to run the shop. Motion made by McAllister, seconded by Gillen, to recommend approval of the application for a Special Use Permit by Shirley Duckstad, subject to the following: 1. Special Use Permit is not transferable to a new property owner. 2. The beauty shop be restricted to one operator. 3. Permit one sign on the property within the restrictions of the sign ordinance. VOTING FOR: Peloquin, Peltier, Greger, Gillen, McAllister, and Ehret Motion Carried RAYMOND OLSON — VARIANCE Mr. Olson requested a variance to build a 40 x 26 garage prior to the construction of his home. He stated he will be building the home in the spring of 1978. Peltier read the ordinance, 320-5, Subdivision H, stating that no accessory building or use shall be constructed or developed on a lot prior to the time of construction of the principal building to which it is accessory, except by Special Use Permit (page 38). Mr. Olson will be purchasing approximately 5.28 acres. McAllister stated that he should get a letter from an attorney stating that he is the owner of the property. Koe,stated that he would not like to see approval because many people do not follow Aith the construction of the house. McAllister suggested that Mr. Olson obtain a bond or irrevocable letter of credit in the amount of $59000 to assure that a home is constructed. Motion made by McAllister, seconded by Greger, to recommend approval of the Special Use Permit for Raymond Olson, subject to the following: 1. That construction of Mr. Olson's home begin no later than June 19 1978. 2, Mr. Olson to provide the city with an irrevocable letter of credit from a recognized lending institution in the amount of $5000.00 3. Mr. Olson to provide proof of ownership to the City Council within the esta— blished guidelines. 4. The irrevocable letter of credit to be released when a Building Permit for a residence is obtained. VOTING FOR: Greger, Gillen, McAllister, and Ehret VOTING NO: Peltier ABSTAINED: Peloquin Motion Carried BALD EAGLE SPORTSMEN CLUB — CONDITIONS OF SPECIAL USE PERMIT Foster Hinton and Mike Prokosch represented the club. Peltier stated that there never was a Special Use Permit issued to the club. They were grandfathered in. Mr. Crever, Building Inspector, commented at the last City Council meeting that there were two new skeet houses on the property. Mr. Hinton stated that that was correct, but all material and labor was donated keeping the cost to under $100.00. They felt that they didneed a building permit. Mr. Hinton stated that the skeet facilities were already there. They just built around them. Gillen stated that they were concerned with the matter of intensification. Mr. Prokosh said that they did not have permanent trap housesuntil 1971. Gillen stated that if they are grandfathered in, no improvements should be made. Dan Ford questioned the hours of operation, and Mr. Hinton replied 9 to 9. They obviously could not shoot in the dark. Mr. Ed Fashingbauer stated that he would have to get a building permit to construct a garage even if the material and labor were free. He also stated that any improvements to the facility would draw more people. Grace Axelson felt that after a conversation with a club member, they were trying to get as many members as they could possibly get. Ehret stated that the Commission should get a legal opinion as to what is considered an intensification. He also suggested that the club begin work on a Special Use Permit that will be needed January 11, 1978. b Motion made/McAllister, seconded by Ehret, that the secretary contact the city attorney requesting his opinion as to whether the construction of two skeet houses at the Bald Eagle Sportsmen Club would be considered intensification of that operation. VOTING FDR: Peloquin, Peltier, Gillen, McAllister, and Ehret VOTING NO: Greger Motion Carried Gillen left the meeting at 10:15 PM. The chair recommends to the Bald Eagle Sportsmen Club that they file an application for a Special Use Permit so action can be taken prior to January 19 1978. Motion made by Peloquin, seconded by Peltier, to recognize Mr. and Mrs. Gordon Russett. All aye. Motion carried. The Russetts' are in the process of selling their home and 85 acres on 165th Street. They were not aware they had to sell with 20 acres, and were wondering if they give the buyer a deed for 10 acres and the balance of acreage on contract for deed. The Russetts are in the Conservancy district (20 acres). Mr. Peloquin will contact the city attorney and try and resolve the problem for the Russetts. Hugo Planning Commission October 129 1977 Page 4 of 4 REVIEW OF DRAFT ON MULTIPLE FAMILY USES Motion made by Ehret, seconded by Peloquin, to approve the multiple family ordinance with the following exceptions: 1. Discrepancy in square footage in Zoning Ordinance Page 52 of zoning ordinance — 121,000 square feet) Zoniiig-Ordinance 320-5, subdivision 0 — 109400 square feet) The proposed multiple family zoning ordinance to correspond with the 10,400 sq. ft. 2. Swimming pools shall not be placed within 15 feet of residences not part of the complex. 3. Eliminate the Police Department from Item D, page 4. 4. Item N, page 5 — Two and one half (2J) parking spaces per unit shall be provided on the same site as the dwelling unit. 5. Item N (iii) — Bituminous or concrete driveways and parking areas with concrete or bituminous curbing shall be required. All aye. Motion carried. COMM/REC ACTIVITIES IN AGRICULTURE AND CONSERVANCY DISTRICTS Motion made by Ehret, seconded by Peltier, that commercial/recreation activities in the Agriculture and Conservancy districts stand as printed in the current Zoning Ordinance. All requests will be handled by Special Use Permit. Refer to City Council minutes of February 7, 1977, Item 3. VOTING FOR: Peloquin, Peltier, Greger, McAllister, and Ehret Motion carried Motion made by Peltier, seconded by Peloquin, to adjourn at 11:32 PM. All aye.
